According to the subitem 15) of Article 16 of the Labor code of the Republic of Kazakhstan of May 15, 2007, I ORDER:

1. Approve enclosed:

1) Rules and regulations of issue to workers of milk and treatment-and-prophylactic food at the expense of means of the employer;

2) Rules of providing workers with special clothes, special footwear and other means of individual and collective protection, sanitary and household rooms and devices, at the expense of means of the employer.

Declare invalid orders of the Minister of Labour and Social Protection of the population of the Republic of Kazakhstan of January 27, 2005 No. 22-p "About approval of Rules of providing workers with means of individual, collective protection, sanitary and household rooms, devices and treatment-and-prophylactic means" (registered in the Register of state registration of regulatory legal acts of 23.02.05 for No. 3456, published in the Bulletin of regulatory legal acts of the Republic of Kazakhstan, 2005, No. 15, of the Art. 100) and of June 29, 2005 No. 170-p "About approval of regulations of issue of milk, treatment-and-prophylactic food at the expense of means of the employer" (registered in the Register of state registration of regulatory legal acts of July 20, 2005 for No. 3739, No. 202 published in "The legal newspaper" of November 2, 2005 (936) with amendments, brought by the order the deputy. 5. This order becomes effective after ten calendar days from the date of its first official publication.

Rules and regulations of issue to workers of milk and treatment-and-prophylactic food, at the expense of means of the employer

1. General provisions

1. These rules are developed according to the subitem 15) of Article 16 of the Labor code of the Republic of Kazakhstan of May 15, 2007 and establish procedure for providing workers with milk and treatment-and-prophylactic food, at the expense of means of the employer.

2. Actions of these rules extends to individual entrepreneurs, physical persons, and also legal entities irrespective of patterns of ownership (further - the employer) and workers, constantly or temporarily fulfilling labor duties on terms of employment which activities are connected with impact harmful (especially harmful) and dangerous (especially dangerous) to life and health of factors.

2. Procedure for issue to workers of milk and treatment-and-prophylactic food, at the expense of means of the employer

3. Milk and treatment-and-prophylactic food (further - LPP) and vitamin medicines are issued to workers by results of certification of production facilities under the terms of work, for the purpose of the prevention of occupational diseases and poisonings, strengthening of their health.

4. Milk is issued on liter 0,5 for change irrespective of its duration in days of the actual employment of the worker at the works connected with production or use of chemicals (Appendix 1).

5. Appointment and issue of LPP is made according to the List of productions in which work grants the right to workers of certain professions and positions on obtaining at the expense of means of the employer of treatment-and-prophylactic food and vitamin medicines in connection with especially harmful working conditions (Appendix 2) and according to Regulations of issue of diets of treatment-and-prophylactic food (Appendix 3) and vitamin medicines (Appendix 4).

6. Employees of the organizations, irrespective of patterns of ownership which professions and positions are provided in the corresponding productions of the specified List, in days of the actual employment use the right to LPP and vitamin medicines.

7. Appointment and issue of treatment-and-prophylactic food and vitamin medicines is carried out on the basis of fiziologo-hygienic assessment of diets of LPP, studying of the food status (what workers, depending on profession, place of employment and working conditions shall receive food on the corresponding diet.

8. Treatment-and-prophylactic food and vitamin medicines are issued also to the employees of other organizations occupied full time on construction, construction, repair and construction and commissioning, to the workers making cleaning and preparation of the equipment for repair and preservation - in the operating productions with especially harmful working conditions in which both for the main workers, and for maintenance force this food is established.

9. Issue of treatment-and-prophylactic food is made in the form of hot breakfasts before work. In some cases, issue of LPP in lunch break is allowed. To workers in the conditions of elevated pressure (in caissons, pressures chamber, at diving works), LPP shall be issued after vyshlyuzovaniye.

10. Treatment-and-prophylactic food is not issued:

1) in non-working days;

2) in vacation days;

3) in days of official journeys;

4) in days of study with separation from production;

5) in days of performance of works on other sites where LPP is not provided;

6) in the period of temporary disability.

3. Requirements imposed to issue of milk and treatment-and-prophylactic food to workers at the expense of means of the employer

11. Issue of LPP lately or for several changes forward, and also compensation for treatment-and-prophylactic food uncollected in time is not allowed.

12. The room where preparation and issue of LPP and vitamin medicines is made, shall meet on the device and content construction standards and rules, sanitary and epidemiologic rules and regulations.

13. Preparation and issue of LPP and vitamin medicines are made according to the approved diets and regulations. According to the list of products menus layouts for every day according to the approximate six-day menu layout of hot breakfasts of treatment-and-prophylactic food on diets and with the scheme of the tables constituted in case of fiziologo-hygienic assessment of diets of treatment-and-prophylactic food shall be constituted (Appendix 6).

14. The menu, responsible for creation, is the production manager of the organization having the right to cooking.

15. Replacement of one foodstuff with others is allowed in exceptional cases within regulations of interchangeability of products (Appendix 5).

16. To the workers receiving free of charge treatment-and-prophylactic food in connection with especially harmful working conditions, issue of milk or other equivalent foodstuff is not made.

17. Responsibility for providing workers with milk, LPP and observance of these rules is assigned to the employer.

18. Control over the implementation of Rules of free issue of milk, treatment-and-prophylactic food and vitamin medicines in the organizations with especially harmful working conditions, irrespective of patterns of ownership, is assigned to bodies of State Labour Inspection and the state sanitary and epidemiological surveillance, regarding the questions concerning their competence.

Milk issue regulations to workers at the expense of means of the employer

1. Milk it is issued on liter 0,5 for change irrespective of its duration in days of the actual employment of the worker at the works connected with production or use of the following chemicals:

1) aliphatic and alicyclic hydrocarbons (saturated and unsaturated):

hydrocarbons of number of methane: butane, isobutane, pentane, isopentane, hexane, octane, isooctane, nonyl hydride;

hydrocarbons of number of ethylene: butylene, amilena, isobutylene;
