Rules of boundary regime

These rules of boundary regime * (1) N4730-I "About Frontier of the Russian Federation" * are developed for the purpose of implementation of article 16 of the Law of the Russian Federation of April 1, 1993 (2) and establish specific content, space and temporary limits of their action and the group of people concerning which they act.

I. Rules of boundary regime in border area

1. Rules of entrance (pass), temporary stay, movement of persons and vehicles in border area

1.1. Entrance (pass) of citizens of the Russian Federation, foreign citizens, subject foreign states, stateless persons * (3) and vehicles in border area it is performed:

a) under identity documents;

b) according to the individual or collective omissions issued by border management of FSB of Russia on subjects of the Russian Federation (in the directions) * (4) or the divisions of border management of FSB of Russia which are directly performing protection and protection of frontier, protection of internal sea waters, the territorial sea, exclusive economic zone, the continental shelf of the Russian Federation, the Azov and Caspian seas and their natural resources * (5), in the presence of identity documents.

Places of entrance (pass) to border area are established on means of communication and designated by the warning signs according to sample (appendix 1).

1.2. Entrance (pass) to border area under identity documents, is performed:

a) persons, the replacement positions established by the Constitution of the Russian Federation, the Federal Laws for direct execution of powers of federal state bodies and the positions established by constitutions, charters, the laws of subjects of the Russian Federation for direct execution of powers of state bodies of subjects of the Russian Federation in the territory of which the border area * is established (6);

b) officials of local self-government of municipalities in the territory of which the border area * is established (7);

c) the citizens of the Russian Federation having registration in the place of stay or at the place of residence within the municipal district (the city district) in the territory of which the border area, or the city district located within the municipal district in the territory of which the border area is established is established and which territory covers the territory of the city district;

d) foreign citizens, citizens of foreign states and stateless persons * (8), constantly or temporarily living, temporarily staying in the Russian Federation, having registration at the place of residence and (or) in accordance with the established procedure the stay in limits of the municipal district (the city district) registered in the place in the territory of which the border area, or the city district located within the municipal district in the territory of which the border area and which territory covers the territory of the city district is established is established;

e) the military personnel passing military service under the contract, the staff of law enforcement and monitoring bodies:

the stay having registration in the place or at the place of residence outside the municipal district (the city district) in the territory of which the border area is established or the city district located within the municipal district in the territory of which the border area and which territory covers the territory of the city district is established of the place of permanent military service (service), work or sending of which are located in border area;

following to the new place of military service (service), work or the venue of leave located in border area;

e) the military personnel undergoing military service:

g) employees of the companies and their associations, organizations, organizations and public associations * (9):

the stay having registration in the place or at the place of residence outside the municipal district (the city district) in the territory of which the border area is established or the city district located within the municipal district in the territory of which the border area and which territory covers the territory of the city district is established of place of employment or sending of which are located in border area;

the following to the new place of employment located in border area;

h) members of families of the military personnel passing military service under the contract, the staff of the law enforcement and monitoring bodies following to the new place of military service (service), work, the venue of leave located in border area;

i) the members of families, relatives and close faces of the military personnel undergoing military service in the places located in border area, following for their visit;

j) members of families of employees of the organizations, the following to the new place of employment located in border area;

k) citizens of the Russian Federation, following in medical, improving institutions, the organizations of rest, the organization of rest of children and their improvements located in border area on treatment (inspection), rest or for visit of the children who are in the specified organizations and the organizations;

l) the citizens following en route through border area including in case of departure from the Russian Federation or entry into the Russian Federation;

m) the citizens of the Russian Federation having in ownership, use and (or) the order the gardening, gardening, seasonal or livestock parcels of land, premises which are not their place of stay or residence, located in border area;

o) the personnel of all types of public transport of the suburban and local message, drivers of other vehicles managing vehicles owing to execution of the labor or service duties which routes of regular movement are in the limits of border area, and also transport drivers performing the international motor transportations;

o) employees of the organizations providing repair and operation of the means of communication, the corresponding vehicles, oil pipelines, gas pipelines, communication lines and electricity transmission, and also performance of works connected with mitigation of consequences of emergency situations of natural and technogenic nature in case of office need in the limits set for them labor obligations and sites of work;

p) the citizens of the Russian Federation following in border area in cases of serious condition of health, death (death) of their close relatives, relatives or close persons living in border area, the fire which comprehended them or other natural disaster and in other cases when presence of citizens is necessary;

c) the students and pupils of educational institutions of the higher and secondary professional education following to the places of practical training or training located in border area;

r) the tourists from among citizens of the Russian Federation following to the place of temporary stay in medical and improving, recreational, cognitive, sports, professional and business, religious and other purposes, except for the tourists organizing travel independently.

1.3. Entrance (pass) to border area according to individual or collective omissions, is performed by persons which are not specified in Item 1.2 of Rules.

The individual or collective omission for entrance (pass) of persons and vehicles to border area * (10) - the document of the established sample which is the basis for entrance (pass) of faces and vehicles in border area.

Data on vehicles are entered in the omission of persons driving in border area.

1.4. Citizens * (11) or the organizations direct for the purpose of obtaining:

a) individual omissions - applications in person of citizens * (12) (appendices 2, 3) or the petition of the organizations * (13) (appendix 4);

b) collective omissions - petitions (appendix 5) with appendix of three copies of personalized lists of the groups of citizens which are orderly driving (passing) in border area (at least two people) in whom surname, the name, middle name, birth date and birth place, the residence (stay) of citizens, series, number, date and the place of issue of the identity document of the citizen are entered. Personalized lists of the groups of citizens which are orderly driving (passing) in border area are signed by heads and sealed the organizations.
