About approval of Safety rules and labor protections on road transport

For the purpose of implementation of the Law of the Republic of Kazakhstan "About road transport" and determinations of single requirements to safety and labor protection on road transport of the Republic of Kazakhstan, I ORDER:

1. Approve the enclosed Safety rules and labor protections on road transport.

2. To management of road transport of the Ministry of Transport and Communications of the Republic of Kazakhstan (Makhanov Sh. K.) provide submission of this order for state registration in the Ministry of Justice of the Republic of Kazakhstan.

3. To impose control of execution of this order on the Vice-Minister of Transport and Communications of the Republic of Kazakhstan Koshanov E. Zh.

4. This order becomes effective from the date of state registration in the Ministry of Justice of the Republic of Kazakhstan and becomes effective from the date of its official publication.

Safety rules and labor protections on road transport

1. General provisions

1. These rules of safety and labor protection on road transport (further - Rules) are developed according to the Laws of the Republic of Kazakhstan "About safety and labor protection" and "About road transport".

Rules determine the main requirements for safety and labor protection in case of work, connected with repair, maintenance and operation of the vehicles used when transporting passengers, baggage and loads, and also handling works and establish complex of the legal, organizational and technical, sanitary and epidemiologic, treatment-and-prophylactic and fire-proof requirements aimed at safety, preserving health and efficiency of workers of road transport in the course of work.

2. Action of these rules extends to physical persons and legal entities, irrespective of patterns of ownership.

3. The solution of questions on observance of requirements of these rules in case of operation of production facility is assigned to the head of the organization (employer).

4. The state control and supervision of observance of these rules exercise authorized state body on safety and labor protection and its territorial subdivisions, and also authorized state body in the field of industrial safety and other authorized bodies.

5. Public control in the field of safety and labor protection in the organization is performed by the public safety inspectors appointed by trade-union body of the organization, and in case of its otsutstviiobshchy meeting of workers.

2. Organization of works on safety and labor protection

6. The common directorship on safety and labor protection in the organization is assigned to her head (employer).

7. For the purpose of ensuring compliance with safety and labor protection in the organizations numbering more than fifty workers the employer creates security service and labor protections which is effective according to the legislation of the Republic of Kazakhstan on safety and labor protection.

According to the status the security service and labor protections is equated to the main production services and liquidated only in case of the organization activity termination.

If the quantity of working does not exceed fifty workers, the decision on introduction of position of the security specialist and labor protection is accepted by the employer taking into account specifics of activities of this organization, or obligations on safety and labor protection are assigned in combination to other specialist. In the organizations, numbering more than fifty workers the rooms for office on labor protection equipped according to the legislation of the Republic of Kazakhstan on safety and labor protection are allocated.

8. Training, instructing, examination of workers in safety issues and labor protections are carried out by the employer at the expense of own means, according to the procedure and the terms established by the legislation of the Republic of Kazakhstan.

9. On nature and time of carrying out the personnel safety notification (further - instructing) is subdivided on:

1) introduction;

2) primary on workplace;

3) repeated;

4) unplanned;

5) target.

10. Primary instructing on workplace, repeated, unplanned and target is carried out by the direct works manager.

About carrying out primary instructing on workplace, repeated, unplanned, training and the admission to work the works manager instructing makes the log entry of registration of instructing on workplace (Appendix 1).

11. The induction is held with all employed, irrespective of their education, length of service by this profession or position, and also with the temporary employees sent the pupils and students who arrived to inservice training or practice.

The induction is held by the security specialist and labor protection, or person to who these obligations, in office of safety and labor protection with use of appropriate means of training and visual aids are assigned (posters, natural exhibits, prototypes, models, videos, movies and filmstrips).

The induction is held according to the program approved by the head of the organization developed by security service and labor protections taking into account requirements of occupational safety standards system (further - SSBT), and also according to the operating regulatory legal acts in the field of safety and labor protection.

12. The program of induction includes the following questions:

1) general information about the organization and its activities;

2) basic provisions of the legislation of the Republic of Kazakhstan in the field of safety and labor protection, and also basic provisions of the legislation on work in the Republic of Kazakhstan;

3) employment policies and procedures in the organization;

4) the organization of work on safety and labor protection in the organization;

5) general rules of conduct of workers in the territory of the organization, in production and auxiliary rooms, arrangement of the main services, production and auxiliary rooms;

6) major dangerous and harmful production factors characteristic of this type of activity, methods and warning facilities of accidents and occupational diseases, means of collective protection, posters, safety signs, alarm system, main requirements for electrical safety;

7) main requirements of production sanitation and personal hygiene;

8) individual protection equipment (further - SIZ), procedure and regulations of issue of SIZ, terms of their use;

9) circumstances and the reasons of separate characteristics of accidents, accidents, the fires happening because of violation of safety requirements;

10) procedure for investigation and registration of accidents, occupational diseases;

11) industrial and fire safety, methods and means of prevention of the fires, explosions, accidents, actions of personnel in case of their origin;

12) measures of rendering primary medical and sanitary help to victims, actions of workers in case of accident on the site, in the workshop.

Holding induction is fixed by the log entry of registration of induction (Appendix 2) with the signature instructed and instructing, and also in the document on employment.

13. Primary instructing on workplace is carried out with all workers: again accepted in the organization, transferred from one division to another, sent, studying, the students who arrived to inservice training or practice with the workers performing work, new to them, and also with the citizens performing construction works in the territory of this organization.

14. The program of primary instructing on workplace includes the following questions:

1) general information about engineering procedure and the equipment on this workplace, production site, in the workshop, the major dangerous and harmful production factors, threshold limit values (further - maximum allowable concentration) and noise levels;

2) safe organization and content of workplace, danger areas of the machine, mechanism, device, equipment security aids (safety, brake mechanisms, barriers, systems of blocking and alarm systems, safety signs), requirements for the prevention of electroinjury rate;

3) procedure for preparation for work (check of operability of the equipment, starting equipment, tool and devices, blocking of grounding and other remedies) according to requirements of rules of technical operation (further - PTE) and safety regulations (further - PTB) in case of operation of electroinstallations;

4) safe acceptances and methods of work, action in case of dangerous situation;

5) SIZ on workplace and instructions for use them;

6) the scheme of safe movement working at the territory of the workshop, site;

7) intra shop transport and load-lifting means and mechanisms, safety requirements during the handling works and cargo transportation;

8) characteristic reasons of accidents, explosions, fires, cases of industrial injuries, occupational diseases and poisonings;

9) measures of the prevention of accidents, explosions, fires, actions in case of accident, explosion, the fire, methods of application of the fire extinguishing means which are available on the site, antiemergency protection and the alarm system, the place of their arrangement.

15. Primary instructing on workplace is carried out with each worker individually with demonstration of safe acceptances and methods of work.

For the purpose of assimilation of skills of safe working methods, all workers after passing of primary instructing on workplace are assigned to experienced workers during the first two-five shifts (depending on kind of work, qualification of the worker) then the head of this site, having convinced of assimilation by again arrived worker of safe working methods, draws up the admission it to independent work.

16. Repeated instructing there undergo all workers irrespective of qualification, educations, years of service, nature of the performed work at least once a half-year, in case of accomplishment of especially dangerous works at least once in three weeks.

Repeated instructing is carried out individually or with employee group, servicing the same equipment, and within general workplace according to the program of primary instructing on workplace in full.

17. Unplanned instructing is carried out:

1) in case of enforcement new or modification of the existing standards, rules, security guidelines and labor protection;

2) in case of change of engineering procedure, replacement or upgrade of the equipment, the devices and the tool, initial raw materials, materials and other factors influencing labor safety;

3) in case of violation by workers of safety requirements of work which can bring or were led to injury, occupational disease, poisoning, accident, explosion or the fire;

4) upon the demand of state control bodies in the field of labor protection;

5) in case of work stoppages: more than thirty calendar days - for works to which impose the additional (raised) safety requirements of work, and for other works - sixty days.

18. The amount and content of instructing determine in each case depending on the reasons and circumstances which caused the necessity of its carrying out.

19. Target instructing is carried out in case of:

1) accomplishment of the one-time works which are not connected with direct obligations in (loading unloading, cleaning of the territory, one-time works out of the organization, the workshop);

2) mitigations of consequences of accidents of natural and technogenic nature;

3) works on which the work permit is drawn up;

4) holding excursions on production facility, the organization of mass actions.

20. Target instructing with workers is fixed in the work permit in case of works in the conditions of the increased danger in the organizations of different pattern of ownership and managing or other documentation resolving works.

21. The personnel of the organization which are affected by harmful, dangerous and adverse production factors pass in accordance with the established procedure preliminary, in case of revenues to work, and periodic medical examination.

22. The workers having profession and documents on passing of the corresponding training are allowed to independent work without preliminary training after passing of introduction and primary instructing.

Workers gain knowledge of labor safety in case of advanced training.

23. The workers of road transport occupied at works to which additional or increased requirements of safety are imposed (Appendix 3), examinations in accordance with the established procedure and receipts of the certificate on the right of works and servicing of certain equipment are allowed to independent work only after course training in standard programs.

24. Further annually the workers specified in Item 23 of these rules are exposed to examination of safe methods and acceptances of works which is drawn up by the protocol (Appendix 4). Persons whose knowledge is recognized as unsatisfactory are not allowed to independent work and undergo repeated training with the subsequent examination.

25. The examination of the workers occupied at work with the increased danger is performed by the commission which structure is approved by the head of the organization in coordination with labor union.

3. Functions on safety and labor protection of the head, specialists and other workers

1. Functions of the head of the organization (employer)

27. The head of the organization (employer) provides:

1) safe operation of factory buildings, constructions, the equipment, safety of engineering procedures according to safety and security legislation and labor protections;

2) effective operation of means of collective and individual protection;

3) observance of work-rest schedule of workers according to the legislation of the Republic of Kazakhstan on work;

4) workers the necessary number of sanitary and household rooms and the equipment, control of work and their use to destination according to these rules and the legislation of the Republic of Kazakhstan;

5) on working condition workplace according to requirements of the legislation of the Republic of Kazakhstan about work, these rules and other regulatory legal acts;

6) development and accomplishment of actions for safety and labor protection, fire safety;

7) passing by employees of the organization, preliminary and periodic medical examinations according to the existing orders of the Ministry of Health of the Republic of Kazakhstan;

8) carrying out with participation of employee representatives periodic and obligatory certifications of production facilities according to the legislation of the Republic of Kazakhstan on safety and labor protection;

9) holding the actions directed to the prevention of accidents on hazardous production facilities;

10) development and approval of security guidelines and labor protection, and also ensuring acquaintance with them all workers;

11) training, carrying out timely instructing and examination by workers of regulations and instructions for labor protection and fire safety;

12) workers at the expense of own means high-quality special clothes, special footwear and other individual protection equipment according to the legislation of the Republic of Kazakhstan, their timely washing (dry cleaning) and repair, and also the washing-away and neutralizing means;

13) indemnification, caused to health to workers owing to adverse and dangerous working conditions, according to the legislation of the Republic of Kazakhstan;

14) informing workers on condition of conditions and labor protection on workplace, about the existing risk of damage of health and individual protection equipment relying workers, compensations and privileges;

15) distribution of functions on labor protection between specialists;

16) timely investigation of the labor accidents which happened to employees of the organization;

17) the free admission of representatives of state supervision bodies and control, and also public control for conducting checks, investigation of accidents and occupational diseases in the organization;

18) necessary measures for ensuring preserving life and health of workers in case of emergencies, including measures for the organization of primary medical and sanitary help to victims;

19) compulsory social insurance or compulsory liability insurance of the employer for damnification of life and to health of workers in case of execution of labor service duties by them;

20) the workers occupied at works with harmful working conditions as milk and other equivalent foodstuff according to the legislation of the Republic of Kazakhstan.

21) accomplishment of instructions of control facilities and provision of information on working conditions in the organization and accidents which happened in the organization.

 

2. To function of security specialists and labor protection

28. Security specialists and labor protection provide:

1) development and functioning of management system of safety and labor protection in the organization;

2) implementation of methodical management and single procedure for the organization of works on safety and labor protection;

3) control of observance of requirements of these rules, legislations of the Republic of Kazakhstan on work and on safety and labor protection, standards, rules and regulations of labor safety;

4) organization of training of technical and other workers in safety rules and labor protections, industrial safety and fire safety;

5) control of observance of fixed terms of testing of mechanisms, electroinstallations, equipment and means of collective and individual protection;

6) imposing of prohibition on work on certain sites, machines, mechanisms and machines under conditions, life-threatening and health of workers;

7) issue to the head (employer), heads of structural divisions for execution of instructions about elimination of the revealed violations in the field of safety and labor protection and industrial safety;

8) discharge from work of persons which allowed violations of requirements of Rules of industrial safety, these rules and regulations of labor safety;

9) participation in investigation of accidents, occupational diseases and professional poisonings, development of actions for their prevention and control of their accomplishment;

10) observance by the head (employer) and structural divisions of the organization of the legislation of the Republic of Kazakhstan on safety and labor protection;

11) development of comprehensive plans of improvements of working conditions and safe engineering, control of their execution;

12) preparation of summary reports, information, certificates of work of the organization in the field of safety and labor protection;

13) participation in project development of regulating documents, rules and instructions on safe operation in the organization; preparation of offers on their change and amendment;

14) control of equipment of the organization by the equipment and mechanisms improving working conditions and also means of collective and individual protection;

15) consideration of offers and statements of workers on the safety issues and labor protections entering their competence.

 

3. Functions of employees of the organization

29. Employees of the organization:

1) respect the rules, rules and security guidelines and labor protection, fire safety, the device and safe operation of objects of the increased danger - the load-lifting constructions, coppers, vessels and pipelines working under pressure, the Republic of Kazakhstan;

2) is observed by requirements of Rules;

3) is applied to destination by collective and individual remedies, according to the legislation on safety and labor protection;

4) are reported without delay to the direct head about each accident and professional poisoning which occurred on production which he witnessed and also signs of occupational disease and the arisen situation which creates threat of life and to human health;

5) give to the victim primary medical and sanitary help and help to bring him to the medical organization (medical aid station);

6) undergo obligatory medical examination according to the legislation of the Republic of Kazakhstan on safety and labor protection.

4. Requirements to platforms, territories, production and auxiliary rooms
