About measures for further development of the rent relations in agricultural industry

In pursuance of the Presidential decree of the Republic of Uzbekistan of March 24, 2003 and for the purpose of acceleration of processes of reforming of the production and economic relations in agricultural industry on the basis of broad development of the rent relations and forming of real owners in the village the Cabinet of Ministers decides No. UP-3226 "About the Most Important Directions of Deepening of Reforms in Agricultural Industry":

1. Take into consideration that according to new edition of part one of article 14 of the Law of the Republic of Uzbekistan "About agricultural cooperative (shirkat)" it are provided to shirkata of the earth of agricultural purpose in lease for a period of up to fifty years, but for thirty years at least, with the target direction for conducting commodity agricultural production.

2. To provide to the ministry of agricultural and water economy, the Ministry of Economics, the Ministry of Finance of the Republic of Uzbekistan, the State committee on land resources, Council of Ministers of the Republic of Karakalpakstan, khokimiyats of areas and areas in 2003-2004 transfer of all agricultural cooperatives (shirkat) into rent form of use of the parcels of land.

Approve the schedule of renewal of the rights of agricultural cooperatives (shirkat) to the parcels of land in the form of long-term lease in the Republic of Karakalpakstan and areas in 2003-2004 according to appendix No. 1.

3. Determine that the payment for use of the parcel of land provided to agricultural cooperative (shirkat) in long-term lease is levied in the form of the single land tax at the rates and in the terms established by the legislation.

4. Approve:

The standard agreement of long-term lease of the parcel of land by agricultural cooperative (shirkaty) according to appendix No. 2;

The approximate charter of agricultural cooperative (shirkat) according to appendix No. 3;

Regulations on procedure for renewal of the rights to the parcels of land and lease agreements of agricultural cooperatives (shirkat) and farms according to appendix No. 4.

Determine that along with renewal of the rights of agricultural cooperatives (shirkat) to the parcels of land renewal of lease agreements of farms from hokima of areas in the territory of which they are located is made.

5. To provide to Council of Ministers of the Republic of Karakalpakstan, khokimiyats of areas and areas together with the State committee on land resources of the Republic of Uzbekistan:

renewal of the rights of agricultural cooperatives (shirkat) to the parcels of land in the form of lease, and also renewal of lease agreements with farms according to the established Schedule and the Provision according to appendices No. 1 and 4 to this resolution;

re-registration of agricultural cooperatives (shirkat) and farms in process of the conclusion (renewal) of lease agreements.

Determine that for renewal of the rights of agricultural cooperatives (shirkat) to the parcels of land, with farms, re-registration of farms and agricultural cooperatives (shirkat) availability of the statement of agricultural cooperative (shirkat) and farm is enough renewal of lease agreements. Establishment of other requirements or conditions, and also collection of any additional fares and charges is not allowed.

Hokima of areas bear the personal responsibility for implementation of the specified actions at the scheduled time and strictly according to this resolution.

6. To the state committee on land resources, the Ministry of agricultural and water economy, the Ministry of Economics, the State committee according to the statistics of the Republic of Uzbekistan together with Council of Ministers of the Republic of Karakalpakstan, khokimiyats of areas in three-months time to study condition of use of the parcels of land in pilot, educational-experimental, subsidiary farms by the ministries and departments.

Following the results of studying to make suggestions for improvement of their activities in new conditions of managing, and in cases of identification of the facts of irrational use of the parcels of land - to consider question of their withdrawal.

7. Uzteleradio, to the Uzbek agency on seal and information, the Ministry of Agriculture of the Republic of Uzbekistan systematically to light in the mass media the course of implementation of actions provided by this resolution.

8. Make changes and additions to some decisions of the Government of the Republic of Uzbekistan according to appendix No. 5.

9. To impose control over the implementation of this resolution on the Counselor of state of the President of the Republic of Uzbekistan Dzhurabekov I. H. and Deputy prime minister of the Republic of Uzbekistan Azimov R. S.
