1. Approve the enclosed Requirements for the organization of protection and the device of premises of banks of the second level and the organizations performing separate types of banking activities (dalee-Trebovaniya).

2. This resolution becomes effective after fourteen days from the date of its state registration in the Ministry of Justice of the Republic of Kazakhstan.

3. To department on work with cash (Mazhitov D. M.):

1) together with Legal department (Sharipov S. B.) to take measures to state registration of this resolution in the Ministry of Justice of the Republic of Kazakhstan;

2) in ten-day time from the date of state registration in the Ministry of Justice of the Republic of Kazakhstan of this resolution to bring it to the attention of the interested divisions of central office, branches of National Bank of the Republic of Kazakhstan, the Ministry of Internal Affairs of the Republic of Kazakhstan, the Ministry of Emergency Situations of the Republic of Kazakhstan, Agency of the Republic of Kazakhstan on regulation and supervision of the financial market and the financial organizations, banks of the second level and the organizations performing separate types of banking activities.

4. To the organizations performing exchange transactions with cash foreign currency in the Republic of Kazakhstan within six months from the date of enforcement of this resolution to bring into accord with requirements of the Instruction the operating rooms of exchange points.

Requirements for the organization of protection and the device of premises of banks of the second level and the organizations performing separate types of banking activities

Chapter 1. General provisions

1. These Requirements are established on the organization of protection and the device of premises of banks of the second level (including branches and their additional rooms), the organizations performing separate types of banking activities and their branches (further - the Object).

2. Okhrana Objektov it shall be performed by the subject performing security activities (further - the subject Okhrany), certain Law of the Republic of Kazakhstan "About security activities" of October 19, 2000 (further - the Law on security activities).

3. Activities of the subject Okhrana for protection of the Object are regulated by the Law on security activities, the Law of the Republic of Kazakhstan "About law-enforcement bodies of the Republic of Kazakhstan" of December 21, 1995, the Law of the Republic of Kazakhstan "About the state control of turnover of separate types of weapon" of December 30, 1998, the Law of the Republic of Kazakhstan "About licensing" of January 11, 2007, the orders of the Government of the Republic of Kazakhstan, orders and other regulatory legal acts of the Republic of Kazakhstan, the contract for rendering security services, Rules of the organization of the access and inside control on the Object and these Requirements.

4. Control functions behind activities of subjects of Protection are performed by division of public service of protection of territorial authorities of internal affairs (further - territorial subdivision of public service of protection).

Workers of subjects of Protection without fail shall render assistance to law enforcement agencies during suppression of criminal infringement of the Object.

Chapter 2. Organization of protection of the Object

5. Premises of banks of the second level (including branches and their additional rooms) shall be protected by armed security forces and be equipped with special technical means of protection.

6. Functions of the subjects of Protection performing protection of banks of the second level (including branches and their additional rooms), are determined by the head of the protected Object according to the legislation of the Republic of Kazakhstan and these Requirements, approved with heads of territorial authorities of internal affairs.

7. On the protected Objekta the access and inside control determining procedure for the admission of personnel and visitors shall be set. Rules of the organization of the access and inside control affirm the head Objekta and are approved with the subject Okhrana's head providing accomplishment of the access and inside control on Objekta.

8. For protection of bank of the second level and its branches and providing the access and inside control specially equipped and isolated room of protection equipped with security systems, special technical means of protection and communication shall be provided. The head of bank of the second level shall determine need of availability of the room of protection for additional premises of branch.

9. In premises of the organizations performing separate types of banking activities, and their branches the armed protection posts, except as specified stipulated in Item 39 these Requirements shall be established. Functions of the armed posts of protection are determined by the first head of the protected Object.

10. The quantity of posts of protection and their location on the Object is determined by heads of the Object and the subject Okhrana taking into account providing safety conditions for personnel, clients and inventory items.

Chapter 3. Acceptance and delivery of the protected Objects on Item of centralized observation

11. Acceptance and delivery under protection of Objects on Item of centralized observation is made based on the contract for rendering security services.
