About approval of Fire safety regulations for the companies for conversion of essential oil-bearing raw materials

In pursuance of the Program of ensuring the fire safety for the period till 2010 approved by the resolution of the Cabinet of Ministers of Ukraine of 01.07.2002 N 870, and according to requirements of the Law of Ukraine "About fire safety" we ORDER:

1. Approve Fire safety regulations for the companies for conversion of essential oil-bearing raw materials (further - Rules) (are applied).

2. To department of the food industry (Kishchak Yu. P.), to the Ministry of agrarian policy of the Autonomous Republic of Crimea, head departments of agro-industrial development of regional public administrations and Management of agro-industrial development of the Sevastopol city public administration to organize studying and fulfillment of requirements of Rules at the companies of all patterns of ownership for conversion of essential oil-bearing raw materials.

3. To department of engineering facilities of Minagropolitiki of Ukraine (Datsenko M. S.):

3.1. In accordance with the established procedure to provide the order on state registration to the Ministry of Justice of Ukraine.

3.2. Organize the edition of Rules in three-months time after registration in the Ministry of Justice of Ukraine.

4. To heads of State department of fire safety, head departments (managements) of the Ministry of Emergency Situations of Ukraine in the Autonomous Republic of Crimea, regional, in the cities of Kiev and Sevastopol, to rectors of higher educational institutions of the Ministry of Emergency Situations of Ukraine, the chief of the Vinnytsia highest professional school of civil protection to inform administrative board of governing bodies of system of the Ministry of Emergency Situations of Ukraine and to organize studying by staff of the divisions of the specified Rules subordinated to them.

5. To impose control over the implementation of the order on the deputy minister of agrarian policy of Ukraine of Motsny V. K. and the chief of State department of fire safety of the Ministry of Emergency Situations of Ukraine Ulints E. M.

Fire safety regulations for the companies for conversion of essential oil-bearing raw materials

1. General provisions

1.1. These Rules regulate the main and special requirements of fire safety during operation, reconstruction, technical retrofitting of the companies for conversion of essential oil-bearing raw materials (further - the companies).

Rules extend to all companies performing conversion of essential oil-bearing raw materials irrespective of patterns of ownership and departmental accessory.

Ensuring fire safety, it is also necessary to be guided by the Law of Ukraine "About fire safety", Fire safety regulations in Ukraine (further - the NAPB A.01.001-2004) approved by the order of the Ministry of Ukraine concerning emergency situations and for protection of the population against effects of the Chernobyl catastrophic crash of 19.10.2004 of N126 and registered in the Ministry of Justice of Ukraine 04.11.2004 for N1410/10009, standards, construction regulations and rules, "Regulations for electrical installation" (the 6th edition processed and added, Energoatomizdat, 1986) (the abbreviation is reproduced in Ukrainian as "PUE"), Regulations for electrical installation. Electric equipment of special installations (further - DNAOP 0.00-1.32-01), Rules of safe operation of electroinstallations of consumers approved by the order of the Ministry of Labour and Social Policy of Ukraine of 21.06.2001 of N 272, (further - DNAOP 0.00-1.21-98), approved by the order of Committee on supervision of labor protection of the Ministry of Labour and Social Policy of Ukraine of 09.01.98 of N4 and registered in the Ministry of Justice of Ukraine 10.02.98 behind N93/2533, and other regulations regulating requirements of fire safety for the companies.

1.2. Ensuring fire safety of the companies is assigned to their heads authorized by them persons if other is not provided by the relevant agreement.

1.3. Ensuring fire safety during expansion, reconstruction and technical retrofitting of the companies, buildings and constructions is assigned to bodies of architecture, customers, builders, the project and construction organizations.

1.4. The beginning of work newly created and commissioning of the new, reconstructed, production facilities, implementation of new technologies, transfer to production of samples of new fire-dangerous machines, mechanisms, the equipment and products, lease of any rooms without the permission of bodies of the state fire supervision is forbidden (further - the State Fire Safety Service).

Issue of the corresponding permission to the beginning of works is performed according to article 10 of the Law of Ukraine "About fire safety", and the Procedure for issue by bodies of the state fire supervision of permission to the beginning of work of the companies and lease of rooms approved by the resolution of the Cabinet of Ministers of Ukraine of 14.02.2001 of N150 (further - NAPB B.07.018-2001).

1.5. Financing of works in case of new, reconstruction, restorations, capital repairs of buildings and other objects, expansion and technical retrofitting of the companies can be carried out only on condition of availability of the positive conclusion of complex state examination which shall contain surely the positive expert opinion of body of the state fire supervision as component of complex state examination.

Complex state examination is carried out according to the resolution of the Cabinet of Ministers of Ukraine of 11.01.2002 of N483 "About Approval Procedure of Investing Programs and Construction Projects and Conducting Their Complex State Examination" and other existing regulatory legal acts.

1.6. Persons guilty of violation of the requirements of fire safety established by the legislation, creation of obstacles for activities of officials of bodies of the state fire supervision, failure to carry out of their instructions, bear responsibility according to the law.

2. Determination of terms

The terms and determinations used in these Rules have the following value:

2.1. Outside technological installation - the complex of devices and processing equipment located outside of buildings openly or under canopy with the bearing, servicing and trellised protective designs.

2.2. The lower (upper) concentration bound of distribution of flame - the minimum (maximum) content of combustible substance in homogeneous mix with the oxidizing circle in case of which distribution of flame on mix on any distance from ignition source is possible.

2.3. The explosive zone - space in the room or around outside installation in which there is explosive environment or it can be formed owing to production factors in the quantity requiring special measures in electric equipment design during its installation and operation.

2.4. Fire hazardous zone - space in the room or beyond its limits in which constantly or periodically are (are stored, used or allocated during engineering procedure) combustible substances both in case of normal engineering procedure, and in case of its violation in such quantity which requires special measures in electric equipment design during its installation and operation.

2.5. Explosive installation - the separate technological device or set of processing equipment in which are stored or are directly used in engineering procedure combustible gases, LVZh, GZh, combustible dust or fibers in quantity in case of which formation of explosive zones is possible.

2.6. Explosion-proof electric equipment - electric equipment which is executed with exception of possibility of ignition of the surrounding explosive environment during its operation.

2.7. Hydrodistillation - steam distillation of essential oil-bearing raw materials in the water circle.

2.8. Distillate - product of condensation of mix of vapors of water and essential oil which are received during steam distillation of essential oil-bearing raw materials.

2.9. Mistsela - solution of essential oil and other ekstraktovy substances in the solvent.

2.10. Hot work - the production operations connected using naked flame, sparking or heating of details to temperatures capable to cause ignition of materials and designs.

2.11. The danger area - space in which impact on the worker of dangerous and (or) harmful production factor is possible.

2.12. Automatic installation of fire extinguishing - installation of fire extinguishing with automatic method of actuating.

2.13. Installation of the fire alarm - set of the technical means established on the protected object for identification of the fire, processing, transfer in the set type of the message on the fire on this object, special information and (or) transfers of commands for inclusion of automatic installations of fire extinguishing and technical equipment.

2.14. Flash temperature - the smallest temperature of substance at which on the established testing conditions over its surface vapor capable to lead to flash in air under the influence of ignition source is formed, but the speed of formation of vapors is insufficient for maintenance of permanent burning.

2.15. The minimum flegmatiziruyushchy concentration - the smallest volume concentration of this phlegmtizator sufficient for flegmatizirovaniye of gas mixes of certain combustible substance with certain oxidizer in case of any ratio of these two components in the conditions of special testing.

2.16. Phlegmtizator - the substance capable in case of introduction it on combustible environment under certain conditions to transform it on nonflammable.

2.17. The minimum fire-fighting concentration - the smallest volume concentration of this gas fire-fighting substance in mix with certain oxidizer, sufficient for flame-out in it certain combustible substance in the conditions of special testing.

2.18. Other terms and determinations, are applied in the values given in DSTU 3855-99 Fire safety. Determination of fire risk of materials and designs. Terms and determinations, DSTU of 2273-93 SSPB. Fire fighting equipment. Terms and determinations, DSTU 3958-2000 Gas fire-fighting substances. Quality indicators, general technical requirements and test methods, GOST 12.1.044-89 "SSBT. Fire-and-explosion hazard of substances and materials. Product indicators and methods of their determination" and DNAOP 0.00-1.32-01.

3. Designations and reducings

NAPB - the regulation on fire safety;

GNAOT - the state regulation on labor protection;

LVZh - flammable liquid;

GZh - combustible liquid;

NKGRP - the lower concentration bound of distribution of flame;

OOPS - installations of the fire alarm;

AUP - automatic installations of fire extinguishing;

THAT is maintenance;

The Party of Pensioners of Russia - scheduled preventive maintenance;

KOPS - complex of the guarding fire alarm;

RTP - the head of fire extinguishing.

4. Organizational measures for ensuring fire safety

4.1. Ensuring fire safety of the companies is component of productive activity of heads, officials and employees of the companies. It shall be displayed in employment contracts and charters of the companies.

4.2. At the company taking into account its fire risk the all-object instruction on fire safety and the instruction for all explosive and fire-dangerous rooms (sites, workshops, warehouses, workshops, laboratories, etc.) shall be developed and approved by the order of the director it agrees to the Main requirements to instructions about measures of fire safety (appendix 1).

4.3. At the company taking into account its fire risk fire prevention regime shall be set by the order (instruction), including are determined:

possibility (place) of smoking, use of naked flame, household heating appliances;

rules of journey and parking of vehicles;

places for storage and admissible amount of raw materials, semifinished products and finished goods which can be at the same time in production placements and on the territories (in storage locations);

procedure for cleaning of combustible dust and waste of vegetable raw materials, storage of the oiled overalls and rags, cleanings of air ducts of ventilating systems of combustible deposits;

procedure for disconnection from network of electric equipment in case of the fire, accident;

procedure for safe storage of substances and materials;

procedure for carrying out hot work;

inspection routine and closings of rooms after completion of work;

procedure of control of fire prevention regime by workers of protection (watchmen, porters, guard, etc.), survey of the territory, procedure for their actions in case of identification of the fire, operation of means of the fire alarm;

procedure for training of officials and check of their knowledge of questions of fire safety, procedure for carrying out with workers of instructing in questions of fire safety (further - fire-proof instructing) and training sessions fire technically to minimum with appointment responsible for their carrying out;

procedure for the organization of operation and servicing of technical means of fire protection (fire-proof water supply system, installations of the fire alarm and automatic fire extinguishing, fire extinguishers, etc.);

procedure for the organization and carrying out Party of Pensioners of Russia and surveys of electroinstallations, heating, ventilating, processing and other engineering equipment;

actions of workers in case of fire identification;

procedure for collection of members of voluntary fire team and responsible officials in case of the fire, challenge at night, days off and holidays.

4.4. The head (owner) of the company shall determine obligations of officials by fire safety, to appoint separate production sites, the processing and engineering equipment, responsible for fire safety.

Obligations on ensuring fire safety, content and operation of technical means of fire protection shall be displayed in job descriptions and are approved by the director.

4.5. The head (owner) of the company shall:

organize fulfillment of requirements of these Rules, and also orders and determinations of bodies of the State Fire Safety Service;

develop complex measures for ensuring fire safety, implement positive experience;

provide necessary assignments for accomplishment of the planned actions for ensuring fire safety, content in operating state of installations of fire automatic equipment, means of communication and alarm system, emergency firefighting equipment;

include question of fire protection in functional obligations of heads of structural divisions and engineering employees;

organize studying by service personnel of the company of these Rules and the instructions developed on their basis about measures of fire safety, carrying out fire-proof instructing and training fire technically in minimum;

provide documents on condition of fire safety, and also on the happened fires and their effects upon the demand of officials of the State Fire Safety Service;

set fire prevention regime at the company and to constantly control its observance by all employees of the company;

periodically, at least once a quarter (during seasonal work of the capital production equipment monthly) to check condition of fire safety of the company, availability and operability of technical means of fire protection;

accept (within the rights granted to it) adequate measures of response to the facts of violations or failure to carry out by officials, other workers participating in operation and repair of processing equipment, the set fire prevention regime, requirements of the fire safety regulations and other regulations existing in this sphere;

organize the fire and technical commission and the voluntary fire team (VFT) according to requirements of the order of the Ministry of Ukraine concerning emergency situations and for protection of the population against effects of the Chernobyl catastrophic crash of 11.02.2004 of N70 "About Approval of the Regulations on Voluntary Fire Teams (Teams) and Standard Regulations on the Fire and Technical Commission" registered in the Ministry of Justice of Ukraine 19.02.2004 for N221/8820;

report about the fires, death of people and loss of property in accordance with the established procedure.

4.6. Heads of production divisions (or other officials on whom the order confers responsibility for fire safety of these divisions) shall:

know fire risk of engineering procedures and the equipment, substances and materials which are applied or stored in division, not to allow abuses of regulations of their storage and application, conducting engineering procedures and operation of the equipment;
