1. Approve the enclosed Rules of the simplified state regulation of activities of subjects of natural monopolies of low power.

2. Recognize to invalid:

1) the order of the Government of the Republic of Kazakhstan of September 21, 2005 No. 935 "About approval of Rules of the simplified state regulation of activities of subjects of natural monopolies" (SAPP of the Republic of Kazakhstan, 2005, No. 35, the Art. 485);

2) the order of the Government of the Republic of Kazakhstan of September 15, 2006 No. 869 "About modification and amendments in the order of the Government of the Republic of Kazakhstan of September 21, 2005 No. 935" (SAPP of the Republic of Kazakhstan, 2006, No. 35, the Art. 375).

3. This resolution becomes effective after ten calendar days from the date of the first official publication.

Rules of the simplified state regulation of activities of subjects of natural monopolies of low power

1. General provisions

1. Rules of the simplified state regulation of activities of subjects of natural monopolies of the low power (daleepravil) are developed according to the Law of the Republic of Kazakhstan of July 9, 1998 "About natural monopolies and the controlled markets" and determine the simplified procedure for state regulation of activities of subjects of natural monopolies of low power.

2. In these rules the following basic concepts are used:

authorized body - the state body performing management in spheres of natural monopolies and in the controlled markets;

the request for approval of rate (the price, rate of charge) - the written appeal of the subject of natural monopoly of low power to authorized body about approval of rates (the prices, rates of charge) on regulated services;

unreasonably gained income - the additional income gained by the subject of natural monopoly of low power as a result of collection of payment at the cost exceeding rate level (the prices, rates of charge) or its limit approved by authorized body and (or) inappropriate use of means of the depreciation charges provided by the tariff estimate, non-executions of cost items of the tariff estimate more than for five percent from the sizes approved by authorized body;

the subject of natural monopoly of low power - the subject of natural monopoly rendering services:

on production, transfer, distribution and (or) supply with heat energy from heating boiler rooms with general installed capacity to twenty Gcal/hour inclusive;

water supply and (or) water disposal in amount to hundred fifty thousand cubic meters a year;

in the field of sidings in amount to one thousand the car/km;

the emergency regulating measures - the measures taken by authorized body for the purpose of protection of life, health of citizens, property of physical persons and legal entities, and also environmental protection;

rate of the London interbank market - offer rate in the London interbank market on six-months single currency deposits at cost for the first date of the period of charge of percent (or in case of initial stage of charge of percent on cost on interest payment date or in day of such period of charge of percent, or next day, preceding the first day of percentage charges) which is expressed as annual interest.
