According to the Law of Ukraine "About consumer protection" and the resolution of the Cabinet of Ministers of Ukraine of 15.06.2006 No. 833 "About approval of the Procedure of trading activity and rules of trade servicing of the population" I ORDER:

1. Approve Rules of retail trade by nonfoods which are applied.

2. Declare invalid the order of the Ministry of Economy and European Integration of Ukraine of 11.03.2004 No. 98 "About approval of Rules of retail trade by nonfoods", registered in the Ministry of Justice of Ukraine 29.03.2004 for No. 379/8978.

3. To impose control of execution of this order on the deputy minister Slyusarenko O. O.

Rules of retail trade by nonfoods

Section I. General provisions

1. These Rules regulate procedure for acceptance, storage, preparation for sale and sales of nonfoods through retail retail chain stores, and also determine requirements concerning observance of the rights of consumers of rather proper quality and safety of goods and level of trade servicing.

2. These Rules extend to all subjects of housekeeping in the territory of Ukraine irrespective of patterns of ownership which underwent state registration in accordance with the established procedure and perform activities in the field of retail trade by nonfoods.

In the cases provided by legal acts, the subject of housekeeping which performs activities in the field of retail trade by nonfoods shall receive the relevant documents of allowing nature.

3. Retail trade by nonfoods is performed through specialized enterprises, the companies with the universal range of nonfoods, specialized departments (sections) of the companies with the universal range of food products, small retail retail chain stores.

4. The subject of housekeeping independently resolves issue of providing trade rooms (places) with the equipment, registrars of settlement transactions according to the legislation.

5. Means of the measuring equipment which are used in trading activity shall be in good repair, have testing brand and undergo periodic checking in the procedure established by the legislation.

6. The subject of housekeeping shall provide acceptance, storage and sale in retail network of nonfoods according to requirements of the legislation.

Nonfoods which sale can do harm to human health are subject to the state sanitary and epidemiologic examination in the procedure established by the legislation.

7. Workers of the subject of housekeeping who perform consumer service shall have special professional training: know assortment and quality characteristics of goods of certain group, signs of defects of production nature; rules of preparation of goods for sale; principles of placement, calculation of goods and window dressing; methods of display and packaging of goods; storage precautions of goods and terms of their realization; rules of work of registrars of settlement transactions and procedure of payments with consumers; types of trading equipment, stock, tools and instruction for use them; rules of the address with container; rules of sanitation and hygiene, and also safe engineering and fire safety and so forth.

8. Workers of the subject of housekeeping can have uniform.

9. To representation of goods to the trade (demonstration) floor workers of the subject of housekeeping carry out preparation of goods for sale (unpacking, integrity checking of individual packaging, seals of the manufacturing company, availability of marking data and quality, cleaning, ironing, verification of presence of maintenance instructions, technical data sheets, warranty cards, completeness of products, work check in operation and so forth).

10. In case of damage (attrition) of marking label of the manufacturing company the subject of housekeeping transfers all marking data to the duplicate of commodity label which certifies the signature person responsible for acceptance of goods. The duplicate of commodity label is attached to goods.

11. Sale of nonfoods is performed by self-service method, with individual servicing, on samples or via vending machines.

12. The subject of housekeeping shall assist in every possible way the consumer in the free choice of goods and additional services, according to its requirement to carry out quality check, safety, completeness, measures, weight and price of goods with provision to it instrumentations, documents which confirm quality, safety, the price of goods.

The seller shall check operability of product, show its work in process of forces and inform the consumer of instructions for use.

13. In the trade (demonstration) floor the goods or their samples which are available for the subject of housekeeping in complete assortment shall be exposed.

The sales of goods which have no corresponding marking, proper trade dress on which the term of suitability is noted or noted with violation of requirements of regulatory legal acts which term of suitability expired, and also that which arrived without documents, stipulated by the legislation, including which certify their quality and safety are forbidden.

14. The subject of managing shall provide informing consumers on retail prices on goods in monetary unit of Ukraine by means of labels of the prices (price labels) or indexes of the prices.

The subject of managing can apply to nonfoods which realizes, discounts or reduction of the price, to hold their sale according to the procedure, established by the law.

The subject of managing shall bring to consumers goods price information which was established prior to application of discounts or reduction of the price, holding the corresponding sale, and also the goods price established after their beginning.

15. During sale of nonfoods of national and foreign production, workers of the subject of managing shall provide to consumers necessary, available, reliable and timely information in the accompanying documentation which is attached to products, on the label, and also in marking or in a different way (in available evident form), accepted for separate types of goods, in the relation:

names of goods, the name or reproduction of sign for goods and services under which they are implemented;

main properties of goods, nominal quantity (weight, amount and so forth), use conditions;

contents of noxious to health substances which are established by regulatory legal acts, and cautions concerning use of separate goods if such cautions are established by regulatory legal acts;

availability as a part of products of genetically modified organisms;

prices (rate), conditions and rules of purchase of goods;

dates of production;

storage conditions;
