Provisional rules of transportation of passengers by road transport in the Republic of Tajikistan

Chapter I. General provisions

These rules of transportation of passengers by road transport (further - Rules) are developed according to articles 10 of the Law of the Republic of Tajikistan "About transport", the Charter of road transport of the Republic of Tajikistan the approved order of the Government of the Republic of Tajikistan No. 396 of 14.09.1999 and the order of the Government of the Republic of Tajikistan of 28.12.2006 for No. 602 "About the Ministry of transport and communication of the Republic of Tajikistan", and establish procedure for the organization and implementation of transportation of passengers on road transport. Rules act on all territory of the Republic of Tajikistan and are obligatory for all legal entities and physical persons irrespective of patterns of ownership, transporting passengers.

General principles of implementation of motor transportations of passengers

3. On nature of the organization motor transportations of passengers are subdivided on regular and irregular.

4. Regular motor transportations of passengers are performed by buses, minibuses and automobile taxi along the routes approved by the relevant state bodies.

Under the organization of regular motor transportations of passengers on city routes vehicles (buses, minibuses and automobile taksomotor) which will be used for implementation of transportations are determined in advance.

5. When implementing regular motor transportations of passengers the carrier provides availability on the vehicle of the route sheet (approved by the order of the Minister of Transport of the Republic of Tajikistan No. 258 of 23.09.2005) with marks about passing of pretrip (prereplaceable) medical examination of the driver and technical inspection of the vehicle.

6. Irregular motor transportations of passengers will be organized by carriers on own initiative and performed with use of the buses, minibuses and cars conforming to requirements of these rules.

7. Irregular transportations of passengers are subdivided into transportations of one-time nature, transportation by custom buses, minibuses, and also into transportations to automobile taksomotor of taxi.

Requirements to vehicles

8. Vehicles having certificate determining compliance to safety requirements, medical and sanitary regulations, regulations of labor protection and ecology, to the international and state standards and specifications, and also registered in the established legislative procedure are allowed to motor transportations of passengers.

On routes of regular city and suburban motor transportations use of the city buses (class I) having at least two passenger doors, minibuses, and also intercity buses (class II) on routes of regular suburban motor transportations is allowed;

On routes of regular long-distance and international motor transportations intercity buses (class II) or buses of distant following shall be used (class III). At the extent of these routes to 100 kilometers it is allowed to use minibuses.

9. The buses used on routes of regular long-distance and international motor transportations of passengers and baggage shall have soft sitting with folding backs. If the extent of route constitutes more than 400 km, then in inside of the bus the place for the driver relief shall be provided.

10. On mountain routes buses with run more than 500 thousand kilometers or being exposed to capital repairs are not used.

11. The buses, minibuses and automobile taxi used in case of motor transportations of passengers shall be completed:

- the medical first-aid kit (motor transportation) with necessary set of drugs and medical means;

- parking means (boots), for fixing from spontaneous movement in case of the parking on the road with bias;

- sign of emergency stop;

- operational fire extinguishing means;

- information plates in inside of buses, minibuses about methods of the emergency opening of emergency hatches, doors, windows and removals of glasses in case of the road accident;

- hammers for dissecting of glasses of inside of the bus, the minibus in case of impossibility of exit of passengers from the bus through doors.

12. The buses and minibuses used in case of motor transportations of passengers shall have:

- doors of passenger salon and emergency hatches which are opening and closed without any hindrances. Doors shall not have ledges, sharp or far remote from their surface;

- roof, emergency hatches and windows which in the closed condition completely prevent hit of atmospheric precipitation in cabin of the driver and passenger salon;

- firmly the fixed hand-rail and sitting;

- net and without rushes of covering of seats and backs of chairs for passengers;

- equal, without speakers or loose details, footboards and floor of salon.

Floor covering of salon shall be made of continuous material without rushes;

- the transparent glasses of windows purified of dust, dirt, paint and other objects reducing visibility through them. Each window opening shall not be closed by information or promotional materials more than for 30%;

- the passenger salon heated in cold and ventilated in hot season, which is not encumbered with the tool and spare parts.

13. Wet cleaning of insides of buses, the minibuses used in case of regular motor transportations of passengers is carried out at least two times to change and in process of pollution.

14. The buses and minibuses used on routes of long-distance and international motor transportations of passengers shall have luggage compartments, and also are in addition completed with reserve wheel and jack.

15. Control devices of registration of work-rest schedule of drivers (tachographs) the buses used when implementing are subject to the equipment:

- international motor transportations of passengers and baggage;

- long-distance interregional regular and irregular motor transportations of passengers and baggage.

16. In inside of the buses, minibuses and automobile taxi used in case of regular city and suburban motor transportations of passengers near cabin (place) of the driver the information display containing shall be located:

- full name of carrier;

- numbers of contact telephone numbers of carrier, the organizer of transportations, and also territorial administrations of Transport inspection of the Ministry of Transport and Communications, and the State automobile inspection of the Ministry of Internal Affairs of the Republic of Tajikistan (further - bodies of TI and GAI);

- copy of the scheme of route and schedule of movement;

- the established fare along route and conveyance. For routes of regular suburban motor transportations the grid of rates depending on trip distance shall be provided;

- size of penalty for unpaid journey and/or conveyance;

- rights and obligations of passengers.

The buses and minibuses used in case of regular city motor transportations of passengers shall be equipped with loud-speaking installation and the device of automated control system (further - ACS) for control of work on the line (in case of the relevant requirement of the organizer of transportations).

17. In the front and back parties of buses (minibuses) used in case of regular city and suburban motor transportations of passengers cliches with indication of the name and numbers of route are established.

Texts shall be written in black color (font height at least 120 mm) on light yellow background. In case of implementation of express transportations on cliche at number of route there shall be text "Express" of red color (font height at least 60 mm).

18. On the right side of the buses used on city routes regular motor transportations of passengers near one of passenger doors of salon the cliche with number and the short description of route (the name of intermediate and final stops, the main streets on which there passes the route, socially significant places) shall be located on the state and Russian languages.

19. On the front, back and right parties of the buses used on routes regular motor transportations of passengers (except city routes), cliches with indication of starting, main intermediate and terminal points of route are established.

Texts on cliches shall be carried out in the state and Russian languages in color, contrast in relation to cliche background, and font at least 60 mm high.

20. Front and back cliches shall have illumination in night-time.

21. The buses intended for motor transportation of organized groups of children shall have at least two doors. Besides, by these buses identification marks "Transportation of children" and the flashing indicator of yellow color are in front and behind established.

22. On the front and back parties of the vehicles used when transporting passengers by custom buses, minibuses and cars - cliches with text "Custom" are established.

23. Places for disabled people, pensioners, expectant mothers and passengers with children of preschool age are provided in front part of inside of the buses used in case of regular motor transportations of passengers. Near these places the information display specifying their purpose shall be located.

Procedure for opening, inspection and creation of the scheme of routes of regular motor transportations of passengers

27. The Ministry of Transport and Communications of the Republic of Tajikistan, local executive bodies, physical persons and legal entities can act as initiators of opening of routes of regular motor transportations of passengers.

28. On opening of routes of regular motor transportations of passengers the Ministry of Transport and Communications develops the scheme of route and the schedule of movement for the solution of questions on it and directs them for approval:

- along routes of regular international, long-distance (interregional) motor transportations of passengers - in the Ministry of Transport and Communications of the Republic of Tajikistan;

- along routes of regular suburban and long-distance (intraregional) motor transportations of passengers - in territorial administrations of the ministry of transport of the Republic;

- along routes of regular city motor transportations of passengers - in local executive bodies of the city.

29. The reopened, and also operating routes of regular motor transportations of passengers are surveyed for the purpose of assessment of conformity of technical condition and level of content of road infrastructure to safety requirements of transportations.

30. Examination is conducted at least once in three years of the commission approved depending on route type by the relevant organs specified in Item 40 of these rules.

At the same time the commissions are included representatives of road or utility authorities, bodies of transport inspection, bodies of GAI and representatives of societies of consumer protection, trade-union and public associations of motor transportation transportations can be included.
