About traffic regulations of the Republic of Tajikistan

(as amended on on January 14, 2010)

According to the Law of the Republic of Tajikistan "About traffic" the Government of the Republic of Tajikistan decides:

1. Approve the enclosed Traffic regulations of the Republic of Tajikistan and Basic provisions according to the admission of vehicles to operation and obligation of officials on traffic safety.

To provide to the ministries and departments, chairmen of the Gorno-Badakhshan Autonomous Region, areas, cities and areas of republican subordination the organization of traffic on streets and roads according to requirements of these rules and Basic provisions, and also to bring into accord with them the regulations and decisions.

2. To the Ministry of Internal Affairs of the Republic of Tajikistan and the Ministry of Defence of the Republic of Tajikistan in 1998 to develop procedure for the admission of drivers-military personnel to transportation of people on cargo vehicles.

3. To provide to the Ministry of Internal Affairs of the Republic of Tajikistan, the Ministry of Transport and Road Facilities of the Republic of Tajikistan, the Ministry of Education of the Republic of Tajikistan and the Ministry of Culture and information of the Republic of Tajikistan the edition in enough: Traffic regulations, Basic provisions, the collection of regulations concerning traffic, educational and methodical literature and visual aids for promoting of these Rules and Basic provisions.

Traffic regulations of the Republic of Tajikistan

1. General provisions

1.1. These rules of traffic (1) establish procedure for traffic in all territory of the Republic of Tajikistan. Other regulations concerning traffic shall be based on requirements of the Law of the Republic of Tajikistan "About traffic" and these rules and not contradict them.

1.2. In Rules the following basic concepts and terms are used:

"Highway" - the road designated by sign 5.1(2)

"Bicycle" - the vehicle, except wheelchairs, having two wheels or more and set in motion by the muscular strength of the people who are on it.

"Driver" - person managing any vehicle, the driver conducting on the road of pack, riding animals or herd. To the driver it is equated training to driving.

"Forced stop" - the termination of movement of the vehicle because of its technical defect or danger created by the transported load, condition of the driver (passenger) or emergence of obstacle in the road.

"The main road" - the road designated by signs 2.1, 2.3.1-2.3.3. or 5.1 in relation to crossed (adjoining), or any road in relation to departures from the adjacent territories is expensive with hard surface (asfalto-and цементобетон, stone materials and so forth) in relation to soil, or. "Motorized vehicle" - the vehicle, except the moped, set in motion by the engine. The term extends also to any tractors and self-propelled machines.

"Moped" - two or the three wheeled vehicle set in motion by the engine with working amount no more than 50 cm3 and having the maximum constructive speed no more than 50 km/h. Bicycles with the outboard motor, mokik and other vehicles with similar characteristics are equated to mopeds.

"Motorcycle" - the two-wheeled motorized vehicle with side trail car or without it. Are equated to motorcycles three - and the four-wheel motorized vehicles having weight in the equipped condition no more than 400 kg.

"Settlement" - the built-up territory on which entrances and departures with which are designated by signs 5.22-5.25.

"Insufficient visibility" - visibility of the road less than 300 m in the conditions of fog, snowfall rain and so forth, and also in twilight.

"Overtaking" - the advancing of the moving vehicle connected with departure from the occupied strip.

"Organized road convoy" - group of three and more motorized vehicles, the following directly one after another on the same lane with constantly included headlights accompanied by the head vehicle with the switched-on flashing indicator of blue color or indicators of blue and red colors.

"Organized pedestrian column" - the group of the people jointly moving on the way to one direction designated according to Item 4.2 of Rules.

"Stop" - the deliberate termination of movement of the vehicle for a while up to 5 minutes, and also bigger if it is necessary for landing or disembarkation of passengers, or loading or unloading of the vehicle.

"Intersection" - the place of crossing, adjunction or branching of roads at one level limited to the imagined lines connecting respectively opposite, the most remote from the center of the intersection of the beginning of curves of carriageways. Departures from the adjacent territories are not considered as intersections.

"Pedestrian" - the person who is out of the vehicle on the road and not performing on it work. The persons moving in wheelchairs without engine, conducting the bicycle, the moped, the motorcycle carrying the sledge, the cart, the nursery or wheelchair are equated to pedestrians.

"Crosswalk" - the site of the carriageway designated by signs 5.16. 1, 5.16.2 and (or) marking 1.14 1-1.14.3(3) and allocated for movement of pedestrians across the road. In the absence of marking width of the crosswalk is determined by distance between signs 5.161 and 5.16.2.

"Lane" - any of longitudinal strips of the carriageway designated or not designated by marking and having width sufficient for movement of cars in one row.

"Benefit (priority)" - the right to first-priority movement in the planned direction in relation to other participants of movement.

"The adjacent territory" - the territory directly adjacent to the road and not intended for end-to-end movement of vehicles (the yards, residential arrays, car parks, gas station, the companies and so forth).

"Trail car" - the vehicle which is not equipped with the engine and intended for movement in structure with the motorized vehicle. The term extends also to semitrailer trucks and pole trailers.

"Carriageway" - the road element intended for movement of trackless vehicles.

"Dividing strip" - structurally allocated road element dividing adjacent carriageways and not intended for movement or stop of trackless vehicles and pedestrians.

"The permitted maximum weight" - the mass of the equipped means with load, the driver and passengers established by manufacturer as the most admissible. The amount of the permitted maximum mass of the vehicles which are part is accepted to the permitted maximum mass of structure of the vehicles that is linked and moving as single whole.

"Traffic controller" - the police officer, military traffic police, the employee of road and operational service, the person on duty on the railway crossing, ferry crossing, the combatant, the freelance employee of militia having the corresponding certificate and equipment (uniform or distinctive mark - armband, staff, disk with red signal or the reflector, red lamp or tag).

"Parking" - the deliberate termination of movement of the vehicle for the reasons which are not connected with landing or disembarkation of passengers either loading or unloading of the vehicle.

"Night-time" - period from the end of evening twilight prior to the beginning of morning twilight.

"Vehicle" - all types of cars, tractors and other self-propelled machines, trolleybuses, and also motorcycles and other mechanical means with engine capacity more than 50 cm3 (or the maximum constructive speed more 40km/hour).

"Sidewalk" - the road element intended for movement of pedestrians and adjoining the carriageway or separated it by lawn.

"Give way (not to create hindrances)" - the requirement designating that the participant of traffic shall not begin, renew or continue movement, perform any maneuver if it can force other participants of movement having in relation to it advantage, to change the direction of movement or speed.

"The participant of traffic" - person using the highways or other places intended for movement of people and loads by means of vehicles and the being directly involved in movement process as the pedestrian, the driver, the passenger of the vehicle, the driver of animals, the cyclist.

1.3. Participants of traffic shall observe strictly requirements of the Law of the Republic of Tajikistan "About traffic" and these rules and other regulations on traffic safety issues in the part concerning them.

1.3.1. In Tajikistan right-hand traffic of vehicles is established.

2. General obligations of drivers

2.1. The driver of the motorized vehicle shall:

2.1.1. Have in case of itself and upon the demand of police officers to transfer to them, and also combatants and freelance employees of militia for check:

- the car driver license on the right of vehicle control and the coupon of accounting of violations to it, and in case of withdrawal in accordance with the established procedure the car driver license "the coupon of accounting of violations to the car driver license;

- registration documents on the vehicle;

- the document confirming right of possession, either uses, or the order of this vehicle in absence of its owner;

- the route sheet and documents on the transported load.

2.1.2. In case of movement on the vehicle equipped with seat belts to be fastened and not to transport the passengers who are not fastened by belts (it is allowed not to be fastened by belts to children up to 12 years according to Item 22.10 of Rules, to the training driving when the vehicle the trainee, and in settlements, besides, to drivers and passengers of cars of field services manages (4)). 2.2. The driver of the motorized vehicle participating in the international traffic shall:

- have in case of itself registration documents on the vehicle and the car driver license, the relevant Conventions on traffic;

2.3. The transport driver shall:

- before departure to check and in transit to provide serviceable technical condition of the vehicle according to Basic provisions according to the admission of vehicles to operation and obligations of officials on traffic safety (5).
