According to Articles 18, "About telecommunications" the National commission on questions of regulation of communication of Ukraine SOLVED 44 Laws of Ukraine:

1. Approve Licensed conditions of implementation of activities in the field of telecommunications for provision of services on provision in use of channels of telecommunication (are applied).

2. Charge to Management of registration and licensing (Martinenko A. G.) together with Legal management (Datsyuk T. L.) provide the decision on state registration to the Ministry of Justice of Ukraine.

3. To provide to managerial control (Pokutny P. G.) promulgation of the decision on the NKRS website and in the statement NKRS after state registration.

Litsenziozny conditions of implementation of activities in the field of telecommunications for provision of services on provision in use of channels of telecommunication

I. General provisions

1.1. These Licensed conditions are developed according to the Laws of Ukraine "About telecommunications", "About radio-frequency resource of Ukraine" and other regulatory legal acts regulating implementation of activities in the field of telecommunications.

1.2. Licensed conditions are the regulatory legal act containing exhaustive list of the organizational, qualification, production and other special requirements obligatory for accomplishment when implementing activities in the field of telecommunications which are subject to licensing.

1.3. Licensed conditions extend to all subjects of managing who perform or filed petition for licensing for implementation of activities for provision in use of channels of telecommunication.

1.4. The subject of managing (licensee) shall observe requirements of regulatory legal acts, standards, other regulating documents in spheres of telecommunications and uses of radio-frequency resource of Ukraine.

1.5. Subjects of managing perform activities for provision in use of channels of telecommunication only in the presence of licenses.

1.6. Subjects of managing can obtain licenses for provision in use of channels of telecommunication (further - the License):

local;

long-distance;

international.

1.7. The license grants the right to the subject of managing to perform activities for provision in use of channels of telecommunication in the territory determined by the license.

1.8. Licensing of provision in use of channels of telecommunication cannot be used for restriction of the competition in implementation of these activities.

1.9. The national commission on questions of regulation of communication (further - NKRS) can include in licenses for activities in the field of telecommunications for certain subjects of managing special conditions.

1.10. Documents acceptance, represented for receipt of the license, issue, the bases for refusal in licensing, renewal, recognition invalid and cancellation of the license, issue of the duplicate of the license, copy of the license, prolongation of effective period of the license are performed by NKRS according to the procedure and the terms determined by the Law of Ukraine "About telecommunications".

1.11. The subject of managing intending to perform provision in use of channels of telecommunication, personally or through the body authorized by it or person, or in the letter with the announced value with the inventory of investment files in NKRS petition for licensing (appendix 1).

In case of availability at the applicant of branches, other separate divisions which will perform economic activity in the field of telecommunications based on the license obtained by the subject of managing, their list and the location is specified in the statement.

1.12. To the statement for licensing (appendix 1) documents according to article 45 of the Law of Ukraine "About telecommunications" are attached.

The list of the documents confirming financial opportunities of implementation of provision in use of channels of telecommunication is given in appendix 2.

The applicant can submit other documents confirming him financial opportunities to perform activities in the field of telecommunications for provision in use of channels of telecommunication.

The form of the reference confirming staffing of implementation of provision in use of channels of telecommunication is given in appendix 3.

Requirements to contents of plans of education and use of telecommunication network are determined in appendix 4.
