Based on subitem 3.1 of Item 3 of the resolution of Council of Ministers of the Republic of Belarus of February 10, 2003 "About the state normative requirements of labor protection in the Republic of Belarus" the Ministry of Labour and Social Protection of the Republic of Belarus DECIDES: No. 150

1. Approve the enclosed Cross-industry rules on labor protection in case of production of malt, beer and soft drinks.

2. This resolution becomes effective since January 1, 2008.

Cross-industry rules on labor protection in case of production of malt, beer and soft drinks

Section I. General provisions

Chapter 1. Data on application

1. Cross-industry rules on labor protection in case of production of malt, beer and soft drinks (further - Rules) establish the state normative requirements of labor protection (further requirements of labor protection) in case of production of malt, beer and soft drinks.

2. The requirements of labor protection containing in these rules extend to all employers irrespective of their forms of business and types of activity and are considered during the designing, construction, reconstruction and operation of objects; designing, production, installation and adjustment of the new equipment; operation, maintenance, repair and upgrade of the operative equipment for production of malt, beer and soft drinks.

3. Under the organization and work for production of malt, beer and soft drinks requirements of the these rules, Cross-industry general rules for labor protection approved by the resolution of the Ministry of Labour and Social Protection of the Republic of Belarus of June 3, 2003 No. 70 shall be observed (The national register of legal acts of the Republic of Belarus, 2003, No. 87, 8/9818), other regulatory legal acts, technical regulatory legal acts containing requirements of labor protection.

4. On the basis of these rules, other regulatory legal acts, technical regulatory legal acts containing requirements of labor protection taking into account specific conditions of work by the employer No. 10), other local regulatory legal acts are accepted or brought into accord with them of the instruction for labor protection, developed and approved according to the Procedure for development, approvals and approvals of instructions for labor protection approved by the resolution of the State committee of the Republic of Belarus on work and social protection of the population of July 14, 1994 No. 82 (The bulletin of normative legal information, 1994.

5. For work safety the employer shall exercise control of application by workers of the safe acceptances in work, fulfillment of requirements stated in rules and instructions for labor protection and also the correct application of means of collective and individual protection.

6. In the organizations for production of malt, beer and soft drinks (further - the organization) should observe requirements of technical regulatory legal acts of system of fire-proof regulation and standardization.

7. Persons guilty of violation of requirements of these rules are made responsible according to the legislation.

Chapter 2. Dangerous and harmful production factors in case of production of malt, beer and soft drinks

8. During the designing, construction, reconstruction and operation of productions of malt, beer and soft drinks, development of new engineering procedures and types of the equipment the measures excluding or reducing to admissible limits impact by workers of the following dangerous and harmful production factors shall be provided:

8.1. physical factors:

moving vehicles, machines, mechanisms;

mobile parts of production equipment (mechanical mixers, working bodies of solodovoroshitel, rollers, scrapers);

the moving products, procurements, materials (pouring in bottles);

the increased dust content of air of the working area (grain warehouses, podrabotochny, solodosushilny and crushing departments);

the raised gas contamination of air of the working area (carbon dioxide in workshops of fermentation and end fermentation, ammonia in the refrigerating compressor stations, rooms cooled by direct evaporation of ammonia);

the increased temperature of surfaces of the equipment (suslovarochny, siropovarochny devices, pipelines of vapor, hot water, must, syrups);

the increased air temperature of the working area (cooking, blending workshops);

the lowered air temperature of the working area (workshops of fermentation, end fermentation and finished goods, container warehouses, the open areas);

the increased noise level on workplaces (workshops of pouring, compressor, crushing departments);

the increased level of vibration load of the operator;

the increased humidity of air (the malting workshop, workshops of fermentation and end fermentation, washing departments);

the increased value of tension in electric chain which short circuit can happen through body of the person;

the increased level of static electricity;

absence or lack of natural lighting;

insufficient illumination of the working area;

the increased light brightness (the inspection automatic machine);

workplace arrangement at considerable height concerning the Earth's surface (floor);

8.2. chemical factors:

the toxic and irritating impact of ammonia, washing and disinfectants on respiratory organs, integuments and mucous membranes;

8.3. psychophysiological factors:

physical overworks;

psychological overloads (monotony of work).

9. Hygienic requirements to production of malt, beer and soft drinks shall conform to requirements the SanPiN

2.3.4.15-16-2006 "Hygienic requirements to production of beer and the soft drinks" approved by the resolution of the Chief state health officer of the Republic of Belarus of October 9, 2006 No. 118 (further - the SanPiN 2.3.4.15-16-2006).

10. The hazardous substance content in air of the working area in case of production of malt, beer and soft drinks shall not exceed the threshold limit values regulated the SanPiN 11-19-94 "The list of the hazardous substances regulated in air of the working area", approved as the Chief state health officer of the Republic of Belarus on March 9, 1994 (further - the SanPiN 11-19-94); GN 9-106 RB 98 "The Threshold Limit Values (TLV) of hazardous substances in air of the working area" approved by the resolution of the Chief state health officer of the Republic of Belarus of December 31, 1998 No. 53 "About enforcement of health regulations and regulations, hygienic standard rates" (further - GN 9-106 RB); GN 9-107 RB 98 "The Approximate Safe Levels of Impact (ASLI) of hazardous substances in air of the working area" approved by the resolution of the Chief state health officer of the Republic of Belarus of December 31, 1998 No. 53 (further - GN 9-107 RB).

11. Optimum and admissible regulations of temperature, humidity and speed of movement of air of the working area are given in production premises of the organizations according to appendix 1 to these rules and shall conform the SanPiN 9-80 Republics of Belarus 98 "Hygienic requirements to microclimate of production rooms", the approved resolution of the Chief state health officer of the Republic of Belarus of March 25, 1999 No. 12 (further - the SanPiN 9-80 Republics of Belarus).

12. Levels of the sound pressure (noise) are given in workplaces according to appendix 2 to these rules and shall correspond the SanPiN 2.2.4/2.1.8.10-32-2002 "Noise on workplaces, in rooms of residential, public buildings and in the territory of the housing estate", the approved resolution of the Chief state health officer of the Republic of Belarus of December 31, 2002 to No. 158 (further - the SanPiN 2.2.4/2.1.8.10-32-2002).

13. Regulations of vibration load of the worker shall conform to requirements the SanPiN 2.2.4/2.1.8.10-33-2002 "Production vibration, vibration in rooms of the residential and public buildings" approved by the resolution of the Chief state health officer of the Republic of Belarus of December 31, 2002 No. 159 (further - the SanPiN 2.2.4/2.1.8.10-33).

14. Illumination of production rooms and platforms in case of production of malt, beer and soft drinks shall conform to requirements of SNB 2.04.05-98 "Natural and artificial lighting" approved by the order of the Ministry of Architecture of the Republic of Belarus of April 7, 1998 No. 142 (further - SNB 2.04.05-98).

Chapter 3. Organization of work on labor protection

15. The employer shall provide:

safety in case of operation of the territory, factory buildings, constructions, the equipment, implementation of engineering procedures, application in production of materials, chemical and biological substances, and also effective operation of means of individual and collective protection. If the territory, the factory building (room), construction or the equipment are used by several employers, then obligations on providing requirements for labor protection are carried out by them jointly based on the written agreement between them;

serviceable condition of the machines, machines, tool and devices necessary for performance of work;

the working conditions conforming to requirements of labor protection;

control of observance by workers of requirements of labor protection;

taking measures to prevention of emergencies, preserving life and health of workers in case of such situations; to rendering to the victims in case of accidents on production of first aid, their delivery in the organization of health care;

carrying out certification of workplaces under the terms of work and certification of sanitary condition of conditions and labor protection;

in the procedure established by the legislation training in safe methods and acceptances of work (work), briefing, training, advanced training and examination concerning labor protection of workers;

development and adoption of instructions for labor protection, other necessary local regulatory legal acts containing requirements of labor protection;

informing workers on condition of the conditions and labor protection which occurred or the forthcoming changes of production processes, the existing risk of damage of health and necessary means of collective and individual protection, compensations under the terms of work;

investigation (participation in investigation) and accounting in accordance with the established procedure labor accidents, occupational diseases, development and implementation of measures for their prevention;

compulsory insurance of workers from labor accidents and occupational diseases according to the legislation;

promotion and implementation of the best practices on labor protection;

allocation in necessary amounts of financial resources, the equipment and materials for implementation of actions for labor protection, prevention of industrial traumatism and occupational diseases, to improvement of working conditions, sanitary and household providing, medical and treatment-and-prophylactic attendance of working;

appointment of the official responsible for the organization of labor protection in the organization;

accomplishment of instructions of officials of state supervision bodies and control of compliance with law about labor protection, accomplishment (consideration) of representations of labor unions;

discharge from work (non-admission to work) in the corresponding day (change) of the worker who appeared in alcohol intoxication or in the condition caused by consumption of drugs, psychotropic, toxic substances; not using necessary individual protection equipment in case of performance of works; not undergone in cases and procedure, stipulated by the legislation, training in safe methods and acceptances of work, instructing, training and examination concerning labor protection, medical examination;

the work-rest schedule of workers set by the legislation, the collective agreement (agreement), the employment contract;

sanitary and household and treatment-and-prophylactic servicing of workers according to requirements of labor protection;

issue to the workers occupied at works with harmful and (or) dangerous working conditions, and also at the works connected with pollution or which are carried out in adverse temperature conditions, the necessary individual protection equipment which is washing away and the neutralizing means according to the established regulations;

the organization of carrying out obligatory preliminary (in case of revenues to work), periodic (during labor activity) medical examinations of separate employee categories; accomplishment of actions of medical and improving and sanitary and hygienic nature by results of periodic medical examinations of workers;

provision according to the legislation of compensations under the terms of work to the workers occupied at works with harmful and (or) dangerous working conditions.

16. The employer establishes obligations and powers in the field of labor protection of structural divisions and employees of the organization.

17. Responsibility for creation of healthy and safe working conditions and observance of guarantees of the right of workers to labor protection are assigned to the employer.

18. Control of labor protection in the organization is exercised by the employer, in structural divisions - heads of structural divisions.

19. For the organization of work and control for labor protection the employer creates security service of work (management, department, other structural division, the labor protection specialist and so forth).

20. The structure and structure of security service of work shall conform to requirements of the Standard regulations on security service of the work of the organization approved by the resolution of the Ministry of Labour and Social Protection of the Republic of Belarus of May 24, 2002 No. 82 (The national register of legal acts of the Republic of Belarus, 2002, No. 89, 8/8286).

21. Obligations shall be determined by labor protection of heads and specialists in their job descriptions based on the functions and powers assigned to them.

22. In case of failure to carry out of the job responsibilities on labor protection, violation of requirements of regulatory legal acts, technical regulatory legal acts workers bear responsibility according to the procedure, established by the legislation of the Republic of Belarus.

23. In the organizations it is necessary to plan actions for improvement of working conditions, sanitary and household providing workers, the prevention of occupational diseases and industrial traumatism.

24. Organizational and technical actions shall be developed based on requirements of regulatory legal acts, the analysis of the reasons of industrial traumatism and accident rate, dangerous and harmful production factors, and also taking into account instructions of state supervision bodies and control, offers of structural divisions and employees of the organization.

25. In case of development of actions for labor protection it is necessary to be guided by the Regulations on planning and development of actions for labor protection approved by the resolution of the Ministry of Labour of the Republic of Belarus of October 23, 2000 No. 136 (The national register of legal acts of the Republic of Belarus, 2000, No. 113, 8/4357).

26. Preliminary (in case of revenues to work) and periodic (in the period of labor activity) medical examinations of workers are performed according to requirements of the resolution of the Ministry of Health of the Republic of Belarus of August 8, 2000 No. 33 "About the Procedure for performing obligatory medical examinations of workers" (The national register of legal acts of the Republic of Belarus, 2000, No. 87, 8/3914).

27. Training, instructing and examination of workers concerning labor protection are carried out according to requirements of Rules of training in safe methods and working methods, briefings and examinations concerning labor protection approved by the resolution of the Ministry of Labour and Social Protection of the Republic of Belarus of December 30, 2003 No. 164 (The national register of legal acts of the Republic of Belarus, 2004, No. 22, 8/10510).

28. For the organization of training of workers in safe acceptances of work, promotion and work on labor protection the labor protection office according to the Standard regulations on labor protection office approved by the resolution of the Ministry of Labour of the Republic of Belarus of November 8, 1999 No. 144 is equipped (The national register of legal acts of the Republic of Belarus, 2000, No. 7, 8/1528).

29. The employee of the organization shall report on the direct head on the defects of the equipment, mechanisms, devices and tools, abuses of regulations noticed by him and instructions for labor protection.

30. In the organization the list of works with the increased danger and the list of the works performed on the work permit shall be constituted and approved.

31. Hot work shall be carried out according to requirements of Fire safety regulations and safe engineering in case of production of hot work at the companies of the Republic of Belarus approved by Head department of fire protection of the Ministry of Internal Affairs of the Republic of Belarus on July 31, 1992 and Committee on supervision of safe operation in industrial and nuclear power under the Ministry of Emergencies and Affairs in Protection of Population from the Consequences of the Chernobyl Catastrophe of the Republic of Belarus on July 28, 1992.

32. Works at height shall be carried out according to the Industrial safety rules during the work at height approved by the resolution of the Ministry of Labour of the Republic of Belarus of April 28, 2001 No. 52 (The national register of legal acts of the Republic of Belarus, 2001, No. 58, 8/6199).

33. On each production site there shall be first-aid kit of first aid completed with medicines and products of medical appointment according to the resolution of the Ministry of Health of the Republic of Belarus of January 15, 2007 as No. 4 "About approval of lists of the investments entering first-aid kits of first aid and procedure for their picking" (The national register of legal acts of the Republic of Belarus, 2007, No. 68, 8/15904).

34. Workers shall be trained in methods of first-aid treatment by the victim in case of accidents.

35. Investigation and accounting of labor accidents and occupational diseases shall be made according to the Rules of investigation and accounting of labor accidents and occupational diseases approved by the resolution of Council of Ministers of the Republic of Belarus of January 15, 2004 No. 30 (The national register of legal acts of the Republic of Belarus, 2004, No. 8, 5/13691), and the resolution of the Ministry of Labour and Social Protection of the Republic of Belarus and the Ministry of Health of the Republic of Belarus of January 27, 2004 No. 5/3 "About approval of the document forms necessary for investigation and accounting of labor accidents and occupational diseases" (The national register of legal acts of the Republic of Belarus, 2004, No. 24, 8/10530).

Section II. Requirements to the territory, factory buildings, constructions, rooms

Chapter 4. Device of the territory and production sites

36. The layout of the territory and production sites of the organizations (further - the territory) shall provide favorable conditions for production process and work and to be carried out according to requirements of SNB 2.02.04-03 "Fire protection of settlements and the territory of the company", approved by the order of the Ministry of Architecture of the Republic of Belarus of October 17, 2003 No. 217 (further - SNB 2.02.04-03), other technical legal acts.

37. The territory shall conform to requirements of health regulations and regulations the SanPiN 2.2.1.13-5-2006 "Hygienic requirements to designing, content and operation of the production enterprises" approved by the resolution of the Chief state health officer of the Republic of Belarus of April 3, 2006 No. 40 (далееСанПиН 2.2.1.13-5-2006), the SanPiN No. 10-5 of the Republic of Belarus 2002 "Sanitary protection zones and sanitary classification of the companies, constructions and other objects" approved by the resolution of the Chief state health officer of the Republic of Belarus of September 9, 2002 No. 68 (further - the SanPiN No. 10-5 of the Republic of Belarus), the SanPiN 2.1.6.9-18-2002 "Hygienic requirements to protection of atmospheric air of settlements", No. approved by the resolution of the Chief state health officer of the Republic of Belarus of December 30, 2002 146, SNB 2.02.04-03, the SanPiN of 2.3.4.15-16-2006, General fire safety regulations of the Republic of Belarus for the PPB RB industrial enterprises 1.01-94, approved by the order of the Chief state inspector of the Republic of Belarus on fire supervision of December 30, 1994 No. 29 (further - PPB RB 1.01-94), Cross-industry general rules on labor protection and these rules.

38. Productions in the territory should be placed taking into account exception of their harmful effects on working. Warehouses of flammable and combustible oil products, the liquefied gases, combustible materials, and also toxic agents it is not necessary to have in relation to factory buildings and constructions from the windward side.

39. The territory shall have accurate division into functional zones: prefactory, production and economic and warehouse.

In prefactory zone it is necessary to place buildings of administration and sanitary and household rooms, check-point, the platform for the parking of the individual transport, and also the platform for rest of personnel.
