Based on the Law of the Republic of Belarus of July 21, 2008 "About Frontier of the Republic of Belarus", the Law of the Republic of Belarus of November 11, 2008 "About bodies of the border service of the Republic of Belarus", the Regulations on the State Customs Committee of the Republic of Belarus approved by the Presidential decree of the Republic of Belarus of April 21, 2008 No. 228 "About some questions of customs authorities, the Regulations on the State boundary committee of the Republic of Belarus approved by the Presidential decree of the Republic of Belarus of September 25, 2007 No. 448 "About some questions of bodies of the border service", the Regulations on the Ministry of Internal Affairs of the Republic of Belarus approved by the Presidential decree of the Republic of Belarus of December 4, 2007 No. 611, and according to Item 57 of the Regulations on preferential procedure for movement through customs border of goods for private use and the simplified procedure for their customs clearance No. 503 approved by the Presidential decree of the Republic of Belarus of October 15, 2007 "About preferential movement through customs border of goods for private use", the State Customs Committee of the Republic of Belarus, the State boundary committee of the Republic of Belarus and the Ministry of Internal Affairs of the Republic of Belarus DECIDE:
1. Approve the enclosed Instruction about procedure for registration and transfer to customs authorities of the goods and vehicles which are objects, tools or means of making of administrative customs offense or smuggling, and documents on them.
2. This resolution becomes effective from the date of its official publication.

1. The instruction about procedure for registration and transfer to customs authorities of the goods and vehicles which are objects, tools or means of making of administrative customs offense or smuggling, and documents on them (further - the Instruction) establishes single procedure for registration and transfer by the military personnel of bodies of the border service of the Republic of Belarus and (or) the staff of law-enforcement bodies to officials of customs authorities of the goods and vehicles which are objects, tools or means of making of administrative customs offense or smuggling, and documents on them.
2. For the purposes of this Instruction the basic concepts in the following values are used:
2.1. goods, vehicles - in the values determined in the Customs code of the Republic of Belarus;
2.2. documents:
transport (transportation) documents and commercial документыв the values determined in the Customs code of the Republic of Belarus;
customs papers - the documents constituted only for the customs purposes (the cargo customs declaration, the customs declaration on goods for private use, the certificate of import of the vehicle, the book of MDP, etc.);
documents on the vehicle - the registration certificate of the vehicle (technical data sheet, the technical coupon) issued in accordance with the established procedure;
other documents concerning administrative customs offense or smuggling.
3. The military personnel of bodies of the border service of the Republic of Belarus and (or) the staff of law-enforcement bodies who found the goods and (or) vehicles which are objects, tools or means of making of administrative customs offense or smuggling (further - the objects which are subject to withdrawal), and documents on them, ensure their safety before transfer to officials of customs authority.
4. Need of arrival and terms of arrival of officials of customs authorities to the place of making of administrative customs offense in the presence of signs of other administrative offense are coordinated by the chief of territorial authority of the border service of the Republic of Belarus or person replacing it or the chief of law-enforcement body (his deputy) with the chief of customs authority (his deputy).
In case of detection of signs of smuggling, and also administrative customs offense in the absence of signs of other offenses arrival of officials of customs authorities on the scene or the place of making of administrative customs offense is obligatory.
5. In cases of delivery of the objects which are subject to withdrawal to the office of body of the border service of the Republic of Belarus or law-enforcement body authorized officers of customs authority arrive to the location of the objects which are subject to withdrawal to the terms coordinated by the chief of territorial authority of the border service of the Republic of Belarus or person replacing it or the chief of law-enforcement body (his deputy) with the chief of customs authority (his deputy).
6. Officials of customs authorities constitute protocols of withdrawal (the inventory of distrained property), determine storage locations of the objects which are subject to withdrawal (including live animals) and take measures for their transportation.
7. If the officials of bodies of the border service of the Republic of Belarus and (or) the staff of law-enforcement bodies performing administrative process except signs of administrative offenses, conducting administrative process on which is referred to competence of bodies of the border service of the Republic of Belarus and (or) law-enforcement bodies, find signs of administrative customs offense, the decision on the sequence or simultaneity of preparation of case on administrative offense is taken cognizance by the official of body of the border service of the Republic of Belarus or the official of law-enforcement bodies having the right to consider cases on administrative offenses, together with the chief of customs authority (his deputy).
8. Military personnel of bodies of the border service of the Republic of Belarus and (or) the staff of law-enforcement bodies in case of detection of the objects which are subject to withdrawal within the competence shall:
inform through service operational and on duty the nearest customs authority (except for the case specified in Item 24 of this Instruction);
draw up the fact of detection and transfer of the objects which are subject to withdrawal according to this Instruction;
transfer the objects which are subject to withdrawal to customs authority according to the procedure, established by this Instruction;
in case of detection of signs of smuggling to take measures for protection of the scene, establishment of witnesses of crime.
9. In case of detection by the military personnel of bodies of the border service of the Republic of Belarus or the staff of law-enforcement bodies of the objects which are subject to withdrawal out of the check point through Frontier of the Republic of Belarus (further - the check point) at person concerning whom guilt in making of administrative offense, conducting administrative process on which is referred to competence of bodies of the border service of the Republic of Belarus or law-enforcement bodies, is established the objects which are subject to withdrawal can be delivered to the closest office of customs authority or to the office of body of the border service of the Republic of Belarus or law-enforcement body.
10. Each fact of detection and transfer of the objects which are subject to withdrawal shall be drawn properly up and reflected in case papers about administrative customs offense or criminal case about smuggling.
11. Registration of the fact of detection and transfer of the objects which are subject to withdrawal consists in:
representation by the military personnel of bodies of the border service of the Republic of Belarus and (or) the staff of law-enforcement bodies to the heads of official reports about the fact of detection and transfer to officials of customs authorities of the objects which are subject to withdrawal according to regulatory legal acts of the State boundary committee of the Republic of Belarus, the Ministry of Internal Affairs of the Republic of Belarus;
representation by the military personnel of bodies of the border service of the Republic of Belarus and (or) the staff of law-enforcement bodies to the officials of customs authorities accepting the objects which are subject to withdrawal, explanatory notes in form according to appendix 1 to this Instruction and others necessary for familiarizing with case on administrative offense or criminal case of materials (in case of their availability);
creation of the report by the official of customs authority about acceptance of the objects of form which are subject to withdrawal according to appendix 2 to this Instruction;
creation by the official of customs authority together with military personnel of bodies of the border service of the Republic of Belarus and (or) the staff of law-enforcement bodies of the delivery-acceptance certificate of the goods and vehicles which are objects, tools or means of making of administrative customs offense or smuggling, and documents on them in form according to appendix 3 to this Instruction (further - the delivery-acceptance certificate);
creation by the official of customs authority together with military personnel of bodies of the border service of the Republic of Belarus and (or) the staff of law-enforcement bodies of the inspection report of the motorized vehicle in the form approved by the resolution of Council of Ministers of the Republic of Belarus, the State Control Committee of the Republic of Belarus and Administration of the President of the Republic of Belarus of October 31, 2006 No. 1443/3/11 "About the document forms used in work with the property withdrawn, arrested or turned into the income of the state".
12. Explanatory notes of the military personnel of bodies of the border service of the Republic of Belarus or the staff of law-enforcement bodies, delivery-acceptance certificates, and also inspection reports of the motorized vehicle, others materials, necessary for familiarizing with case on administrative offense or criminal case (join the reports constituted by officials of customs authority in case of their availability).
13. Copies of official reports of the military personnel of bodies of the border service of the Republic of Belarus and (or) the staff of law-enforcement bodies about detection and transfer to customs authorities of the objects which are subject to withdrawal can be requested at the request of the chief of customs authority (his deputy) and are attached to the criminal case file about smuggling or to case on administrative customs offense.
14. Delivery-acceptance certificates are subject to logging of accounting of delivery-acceptance certificates of the goods and vehicles which are objects, tools or means of making of administrative customs offense or smuggling, and documents on them (further - the magazine) in form according to appendix 4 to this Instruction.
Magazines are stored in departments of customs authorities operational and on duty.
15. Registration of the delivery-acceptance certificate in the magazine is performed by the official of customs authority who accepted the objects which are subject to withdrawal.
In case of registration of the delivery-acceptance certificate in the magazine the registration number having the following structure is assigned to it: code of customs, through hyphen - sequence number of registration of the delivery-acceptance certificate in the magazine and through fraction - year of creation of the act.
For example:
06-17/06, where 06 - code of the Minsk regional customs, the 17th sequence number of registration of the delivery-acceptance certificate in the magazine and 06 last two figure of year of creation of the delivery-acceptance certificate.
The completed magazine is stored in customs authority within three years.
16. The objects which are subject to withdrawal found by military personnel of bodies of the border service of the Republic of Belarus or the staff of law-enforcement bodies out of the check point are accepted by officials of customs authorities which are in accordance with the established procedure authorized on creation of protocols on administrative customs offenses or on production of inquiry on criminal cases about smuggling. In case of their absence - the officials of customs authorities who are seniors on position from among being in the place of transfer of the objects which are subject to withdrawal or arrived for acceptance of the objects which are subject to withdrawal.
17. In cases, stipulated in Item the 7th this Instruction, the objects which are subject to withdrawal are transferred to customs authority after carrying out the border service of the Republic of Belarus by the military personnel of bodies or the staff of law-enforcement bodies of the necessary legal proceedings which are within their competence.
18. The officials of customs authorities accepting subjects to withdrawal objects shall check sufficiency the provided materials necessary for familiarizing with case on administrative offense or criminal case containing in this for acceptance at the scheduled time of decisions stipulated by the legislation.
If the circumstances having essential value for adoption of such decision were not reflected in the provided materials necessary for familiarizing with case on administrative offense or criminal case, then the officials of customs authorities accepting subjects to withdrawal objects have the right to demand, and the military personnel of bodies of the border service of the Republic of Belarus or the staff of law-enforcement bodies who found signs of administrative customs offense or smuggling shall provide additional explanatory notes on these circumstances.
19. Delivery-acceptance certificates and survey of the motorized vehicle are constituted in triplicate, as a rule, in the presence of person in whom the objects which are subject to withdrawal were found, and if necessary - with participation of specialists.
The first copies of delivery-acceptance certificates and survey of the motorized vehicle are transferred to customs authority for attaching to the criminal case file about smuggling or to case on administrative customs offense, the second - remain with the officials who found offense, third - are handed to person in whom the objects which are subject to withdrawal were found (if it was present at reception-transmission).
20. If military personnel of bodies of the border service of the Republic of Belarus or the staff of law-enforcement bodies concerning person in whom the objects which are subject to withdrawal were found constituted protocols of personal search and other procedural documents, then copies of these materials are reported to customs authorities.
21. If person in whom the objects which are subject to withdrawal were found was brought to the office of body of the border service of the Republic of Belarus or law-enforcement body by military personnel of bodies of the border service of the Republic of Belarus or the staff of law-enforcement bodies for the administrative offenses which are not relating to customs, but afterwards in its acts signs of smuggling or administrative customs offense were established, then copies of documents on the made decisions concerning person in whom the objects which are subject to withdrawal, and these objects were found are without fail transferred to customs authority except explanatory notes.
22. If by transfer to customs authorities by the military personnel of bodies of the border service of the Republic of Belarus or the staff of law-enforcement bodies of the objects which are subject to withdrawal there are disagreements on the questions connected with reception-transmission, then heads of the transferring and accepting parties in perhaps short time shall resolve them.
23. In case of identification of the objects which are subject to withdrawal in borderland in case of lack of the faces which moved them, registration and transfer of the objects which are subject to withdrawal are performed according to the procedure, established by Items 9-22 of this Instruction.
24. In case of detection of the objects which are subject to withdrawal at the check point the shift supervisor of border duties without delay informs on it the chief of Item of customs clearance (person, it replacing).
25. Registration of the fact of acceptance of the objects which are subject to withdrawal consists in creation of the report by the official of customs authority in form according to appendix 2 to this Instruction.
The copy of this report is transferred to the shift supervisor of border duties.
26. In case of detection of signs of administrative customs offense or smuggling at the check point the delivery-acceptance certificate is not drawn up.
27. In case of identification by the military personnel of bodies of the border service of the Republic of Belarus of signs of administrative customs offense at check points at which there is no customs control the objects which are subject to withdrawal are drawn up and transferred to customs authority according to the procedure, established by Chapters 2 and 3 of this Instruction.
28. At check points at which customs control is not exercised loading, unloading, overload of the objects which are subject to withdrawal are performed by the military personnel of bodies of the border service of the Republic of Belarus in case of failure of face in which the objects which are subject to withdrawal were found, to make the specified actions.
29. In case of detection of the objects which are subject to withdrawal onboard the aircraft performing the international flight, placed at the check point at the airport (in airfield) and if the face which moved them is not established, the serviceman of bodies of the border service of the Republic of Belarus or the official of customs authority who found the objects which are subject to withdrawal inform employees of aviation safety for the purpose of holding special events for assessment of danger of the revealed subjects by them to withdrawal of objects (if necessary specialists or experts are attracted).
30. The customs authority monthly in written and electronic form informs relevant organ of the border service of the Republic of Belarus and (or) law-enforcement body on the decisions made by customs authority, concerning the objects reported to customs authorities according to the procedure, established by this Instruction.
