About procedure for export licensing of goods in 2008

According to article 16 of the Law of Ukraine "About foreign economic activity" and in pursuance of the resolution of the Cabinet of Ministers of Ukraine of 29.12.2007 No. 1411 "About approval of inventories which export and import is subject to licensing and amounts of quotas in 2008" I ORDER:

1. Approve applied:

Regulations on procedure for export licensing of goods in 2008;

Form of the export license of goods and Instruction of its filling;

The commitment form on receipt of the export license of goods and the Instruction about its filling;

The instruction about filling of the export license in the USA of some products from flat-rolled cut carbonaceous products in 2008;

The instruction about filling of the export license of separate types of metal products to member countries of the European Commonwealth in 2008.

2. Delegate to the regional, Kiev and Sevastopol city public administrations and authorized body of the Autonomous Republic of Crimea (in their consent) the right of issue of export licenses of products to the subjects of business activity registered in the respective regions and book value of goods under agreements (contracts) of which does not exceed 300 thousand dollars of the USA, according to appendices 3, 5 and 6 to the resolution of the Cabinet of Ministers of Ukraine of 29.12.2007 No. 1411 "About approval of inventories which export and import is subject to licensing, and amounts of quotas in 2008".

The list of authorized structural divisions of the regional, Kiev and Sevastopol city public administrations and authorized body of the Autonomous Republic of Crimea, and also the list of officials which are granted right to sign of export licenses of products are determined by the separate order of the Ministry of Economics of Ukraine.

To submit to the regional, Kiev and Sevastopol city public administrations and authorized body of the Autonomous Republic of Crimea to the 5th coming behind reporting to the Ministry of Economics of Ukraine information on the granted licenses for goods which export is subject to licensing according to above-mentioned appendices, in electronic and paper type.

3. The department of non-tariff regulation of department of the external economic policy is responsible for registration and issue of export licenses of the goods which are subject to quoting and licensing in 2008.

4. To department of non-tariff regulation of department of the external economic policy:

to the 10th coming behind reporting to submit to the State Customs Service of Ukraine information on the drawn-up licenses for goods which export is subject to quoting and licensing;

together with legal department to provide provision on state registration of this order in the Ministry of Justice of Ukraine in the time established by the legislation;

together with financial and administrative department to bring this order to permission of the State Customs Service of Ukraine, authorized body of the Autonomous Republic of Crimea, the regional, Kiev and Sevastopol city public administrations.

Regulations on procedure for export licensing of goods in 2008

I. General provisions

1. This Provision determines single procedure for registration and issue of export licenses of goods according to appendices 1, of 3, of 4, of 5, of 6, of 8, of 9, 11 and 12 to the resolution of the Cabinet of Ministers of Ukraine of 29.12.2007 No. 1411 "About approval of inventories which export and import is subject to licensing, and amounts of quotas in 2008" (further - the resolution of the Cabinet of Ministers of Ukraine of 29.12.2007 No. 1411).

2. Action of this Provision extends to all subjects of foreign economic activity irrespective of pattern of ownership.

II. Procedure for registration and licensing for commodity export

1. The export license of goods (further - the license) is granted according to the procedure, provided by the Law of Ukraine "About foreign economic activity" and this Provision.

The license is granted in one copy in the form approved by the order of the Ministry of Economics of Ukraine of 12.01.2008 No. 6.

Licensing to the subject of foreign economic activity is performed by department of non-tariff regulation of the Ministry of Economics of Ukraine or, within the conferred powers, authorized body of the Autonomous Republic of Crimea, the relevant divisions of the regional, Kiev and Sevastopol city public administrations.
