About approval of the Instruction about procedure for conducting cash transactions and payments with cash in Belarusian rubles in the territory of the Republic of Belarus

1. Approve the enclosed Instruction about procedure for conducting cash transactions and payments with cash in Belarusian rubles in the territory of the Republic of Belarus.
2. Recognize to invalid:

the resolution of Board of National Bank of the Republic of Belarus of June 28, 2004 No. 99 "About modification and amendments in Rules of conducting cash transactions and payments with cash in the Republic of Belarus" (The national register of legal acts of the Republic of Belarus, 2004, No. 111, 8/11247);
the resolution of Board of National Bank of the Republic of Belarus of June 3, 2005 No. 83 "About modification and amendments in Rules of conducting cash transactions and payments with cash in the Republic of Belarus" (The national register of legal acts of the Republic of Belarus, 2005, No. 104, 8/12750);
the resolution of Board of National Bank of the Republic of Belarus of November 27, 2006 No. 192 "About modification and amendments in the resolution of Board of National Bank of the Republic of Belarus of March 26, 2003 No. 57" (The national register of legal acts of the Republic of Belarus, 2006, No. 206, 8/15476).

1. The instruction about procedure for conducting cash transactions and payments with cash in Belarusian rubles in the territory of the Republic of Belarus (further - the Instruction) is developed based on articles 26 and 30 of the Bank code of the Republic of Belarus and establishes single procedure for carrying out, accounting, registration of cash transactions and payments with cash in the territory of the Republic of Belarus in cash Belarusian rubles (further - cash).
2. For the purposes of this Instruction following terms have the following values:
divisions - all divisions of the legal entity, including separate divisions (branches, representations), their divisions;
revenue - all cash which arrived in cash desk of the legal entity, division, the individual entrepreneur, private notary (except for the cash cashed check in bank and return of the cash which is earlier issued on traveling expenses, the calculations perfromed between legal entities, their separate divisions, individual entrepreneurs, the payments which are part of salary fund);
cash desk - the room or the place of acceptance, issue, storage of cash, cash documents;
cash transactions - transactions of the legal entity, division, the individual entrepreneur, the private notary among themselves, with bank and (or) with physical persons which are connected with acceptance in cash desk and (or) issue from cash desk of cash with reflection of these transactions in the corresponding books of accounting;
cash balance limit - limiting remaining balance, the most admissible cash amount of money which can be in cash desk of the legal entity, divisions (at the individual entrepreneur, the private notary in case of establishment of cash balance limit by it) as of the end of the working day;
shop warehouse - the shopping facility performing wholesale of goods to legal entities, their separate divisions and individual entrepreneurs by self-service method with the minimum trade allowance, including for cash money;
separate divisions - branches, representations, other divisions of legal entities which legal status as separate divisions is determined by the provision approved by the legal entity (its authorized body) and for which for making of transactions by the legal entity the current (settlement) bank account is opened (subcorrespondent account of bank branch, the interfilial account of structural division of National Bank of the Republic of Belarus);
the servicing bank - the bank performing settlement and cash servicing of legal entities, divisions, individual entrepreneurs, private notaries;
compensation - the payments which are part of salary fund according to the Instructions on filling in forms of the state statistical observations of statistics on work approved by the resolution of the Ministry of statistics and the analysis of the Republic of Belarus of July 29, 2008 No. 92 (The national register of legal acts of the Republic of Belarus, 2008, No. 222, 8/19374), payments of the alimony;
the distributor - person authorized by the head of the legal entity, division, the individual entrepreneur on cash disbursement of money;
specialized cooperative - housing, building, country, garage cooperative and gardening partnership;
the account of physical person - the account of physical person opened under the agreement of the current (settlement) bank account, bank deposit agreement (deposit), the agreement of maps accounts;
authorized persons - agents, distributors, inspectors, sellers small retail (pavilions, booths, tents, portable means of delivery and peddling trade) networks and other responsible persons performing activities on behalf of the legal entity, the individual entrepreneur.
The term "nonresident" applied in this Instruction matters, determined in article 1 of the Law of the Republic of Belarus of July 22, 2003 "About currency control and currency exchange control" (The national register of legal acts of the Republic of Belarus, 2003, No. 85, 2/978).
The terms "corporate card", "personal card", "maps accounts", "maps check" applied in this Instruction have the values determined in Item 2 of the Instruction on procedure for making of transactions with bank plastic cards approved by the resolution of Board of National Bank of the Republic of Belarus of April 30, 2004 No. 74 (The national register of legal acts of the Republic of Belarus, 2004, No. 87, 8/10996; 2007, No. 84, 8/16075).
The term "electronic money" applied in this Instruction matters, determined in Item 3 of Rules of implementation of the transactions with electronic money approved by the resolution of Board of National Bank of the Republic of Belarus of November 26, 2003 No. 201 (The national register of legal acts of the Republic of Belarus, 2003, No. 139, 8/10290; 2007, No. 84, 8/16081).
The terms "market", "governing body of the market" applied in this Instruction have the values determined in Item 2 of Rules of trade in the markets of the Republic of Belarus approved by the resolution of Council of Ministers of the Republic of Belarus of December 12, 2003 No. 1623 "About some questions of activities of the markets" (The national register of legal acts of the Republic of Belarus, 2003, No. 142, 5/13529).
3. This Instruction is obligatory for accomplishment by legal entities, divisions, individual entrepreneurs, the private notaries performing the activities in the territory of the Republic of Belarus, except for National Bank of the Republic of Belarus, banks and the non-bank credit and financial organizations of the Republic of Belarus, the organizations of the Ministry of Communications and Informatization of the Republic of Belarus to which only requirements of Items 6, of 10, 35-41, 43, 44 and Chapter 5 of this Instruction extend.
