1. This provision is developed according to Article 43 of the Land code of the Republic of Tajikistan establishes procedure for indemnification to land users and the losses of agricultural production connected with withdrawal of lands from agricultural turnover

Determination of losses of the land users and losses of agricultural production connected with seizure of land for the state and social needs and also for individual activities of citizens, is made at stage of preliminary approval of location of object and specified in case of registration of withdrawal of the parcel of land.

4. In case of withdrawal of the agricultural holdings for their use for the purpose of which are not connected with conducting agricultural production the amount of its losses are established by the land management project (land management case) on the basis of which local Hukumata (except Hukumatov of areas in the cities) make the decision on provision of the appropriate right of use to the parcel of land.

2. Indemnification to land users

5. The losses caused to land users are subject to compensation in full in cases:

- the withdrawals of lands for the state needs connected with the termination of the right of land use;

- restrictions of the rights of land users in connection with establishment of specific mode of land use;

- quality degradations of lands as a result of construction and the operation of the objects allocating harmful to crops and plantings of substance, and leading to decrease in level of fertility of soils.

6. Damages to land users are paid at the expense of means of legal entities and physical persons to which the earth is provided in use.
