1. Approve the enclosed Instruction about procedure for conducting checks of observance of requirements of technical regulations.

Declare invalid the resolution of Committee on standardization, metrology and certification under Council of Ministers of the Republic of Belarus of April 17, 2003 No. 19 "About approval of the Instruction about procedure for conducting checks behind observance of requirements of standards" (The national register of legal acts of the Republic of Belarus, 2003, No. 52, 8/9468).

The instruction about procedure for conducting checks of observance of requirements of technical regulations (further - the Instruction) establishes procedure for preparation, carrying out, registration and realization of results of checks when implementing the state supervision of observance of the requirements established in regulatory legal acts, requirements of technical regulations, interconnected with them state standards and other technical regulatory legal acts in the field of the technical regulation and standardization, indicators declared by the manufacturer (seller) of products (service) in delivery agreements (sale) of products (rendering service) in its marking or the accompanying documentation (further - requirements of technical regulations), and also when implementing the state supervision of accomplishment by legal entities and individual entrepreneurs of requirements of the legislation of the Republic of Belarus on assessment of conformity, concerning obligatory confirmation of conformity.

Requirements of this Instruction are obligatory for all organizations and officials of the State committee on standardization of the Republic of Belarus (further - Gosstandart) exercising the state supervision of observance of technical regulations within the competence, and also the checked legal entities and individual entrepreneurs irrespective of patterns of ownership and subordination.
3. The instruction is developed according to the Law of the Republic of Belarus of January 5, 2004 "About technical regulation and standardization" (The national register of legal acts of the Republic of Belarus, 2004, No. 4, 2/1011), the Law of the Republic of Belarus of September 5, 1995 "About ensuring unity of measurements" in edition of the Law of the Republic of Belarus of July 20, 2006 (Vyarkho¸naga Savet's Vedamastsi of Respubliki Belarus, 1995, No. 32, Art. 420; The national register of legal acts of the Republic of Belarus, 2006, No. 122, 2/1260), the Law of the Republic of Belarus of January 5, 2004 "About assessment of conformity to requirements of technical regulatory legal acts in the field of technical regulation and standardization" (The national register of legal acts of the Republic of Belarus, 2004, No. 5, 2/1018), the Regulations on the State committee on standardization of the Republic of Belarus approved by the resolution of Council of Ministers of the Republic of Belarus of July 31, 2006 No. 981 "Questions of the State committee on standardization of the Republic of Belarus" (The national register of legal acts of the Republic of Belarus, 2006, No. 144, 5/22789), Regulations on procedure of the state supervision of the observance of requirements of technical regulations approved by the resolution of Council of Ministers of the Republic of Belarus of May 30, 2007 No. 715 (The national register of legal acts of the Republic of Belarus, 2007, No. 134, 5/25309), and other regulatory legal acts of the Republic of Belarus.

the inspection statement - the document constituted by the state inspector on supervision of observance of technical regulations by results of check when implementing the state supervision of observance of requirements of technical regulations in the form established by Gosstandart, and which is the basis for decision making about application to legal entities and individual entrepreneurs of the measures of responsibility for offenses provided by regulatory legal acts in the field of technical regulation, standardization, assessment of conformity and also for control and accounting of activities of state supervision body behind observance of requirements of technical regulations;
the state inspector - the official of state supervision body behind observance of requirements of technical regulations exercising the state supervision of observance of technical regulations (further - the state inspector);
