1. Approve the Provision, Structure of the Central management, the Scheme of management and the List of the companies of Public service for supervision and regulation in the field of transport (appendices 1, 2, 3 and 4).

2. Establish the extreme number of employees of Public service on supervision and regulation in the field of transport in number of 330 units (without service personnel), including central office in number of 36 units from which financing of 262 units is performed at the expense of the republican budget, including 39 units of central office and 68 units at the expense of special means of service.

3. Set limit of office cars for Public service on supervision and regulation in the field of transport in number of 11 units, including for Central office 4 units.

4. Financing of Public service on supervision and regulation in the field of transport is performed at the expense of the republican budget and other means according to the procedure, approved with the Ministry of Finance of the Republic of Tajikistan.

Provision of Public service on supervision and regulation in the field of transport

I. General provisions

1. Public service on supervision and regulation in the field of transport (further - Service) is the state supervision body in transport complex exercising control over observance of regulatory legal acts in the field of road, water, rail, electric, industrial transport and road economy regulates their activities.

2. The service is in the Scheme of management of the Ministry of Transport and Communications the Republic of Tajikistan.

3. The service in the activities is guided by this Provision.

4. The service performs the activities in interaction with bodies of protection of Frontier, customs authorities, the state automobile inspection, local authorities of the executive government and other monitoring bodies.

II. Functions

5. The service performs the following functions:

- control of observance by legal entities and physical persons, irrespective of patterns of ownership, regulatory legal acts and international treaties in transport complex determining procedure for functioning of automobile, water, railway and road economy, and also activities, connected with implementation of transport complex;

- state regulation of activities in the field of transport and road economy, and also the activities connected with transport complex;

- issue, renewal and prolongation of effective period of licenses for implementation of activities for design and exploration work, construction, repair and reconstruction automobile, the railroads and road constructions, on transportation of passengers and loads automobile, railway on maintenance and repair on road and rail transport, activities of passenger and freight terminals and other types of activity according to the legislation of the Republic of Tajikistan;

- issue of special permissions to transportations of heavy and bulky cargoes;

- issue of the certificate of weighing of vehicles;

- carry out certification on rail transport;

- creation of the register of the granted licenses;

- provisions of information to legal entities and physical persons from the register of the granted licenses;

- the organization of the omission highways of vehicles with the loadings and dimensions exceeding the established regulations;

- creation of conditions for normal functioning of the market of the transport and other services connected with transport complex;

- accounting of the vehicles performing the international motor transportations of passengers and loads;

- accounting of use of permissions to implementation of the international motor transportations at check points through frontier of the Republic of Tajikistan;

- verification of transport and allowing documents on implementation of the international motor transportations of passengers and (or) loads;

- control of observance of operating mode and rest of drivers of the motorized vehicles equipped with the tachograph;

- issue in accordance with the established procedure to physical persons and legal entities of the certificate on rendering services in the field of transport and supervision and regulation of their activities.

6. The service has the right:

- check activities of the physical persons and legal entities performing transportation, forwarding, road and other activities on transport and road economy and also rail road construction, the organization of repair and maintenance of vehicles, activities of terminals (except for the companies, organizations and the organizations of bodies of law enforcement agencies, defense, customs and tax authorities, except cases of implementation of commercial business activity by them) regarding observance by them of regulatory legal acts and international treaties in transport complex, and also to demand from them submission of necessary data for accomplishment of the tasks assigned to Service;

- organize Items of control of vehicles at check points through Frontier of the Republic of Tajikistan, and also in approval of the Ministry of Internal Affairs of the Republic of Tajikistan in highways to organize stationary checkpoints and equip them with the equipment and tools necessary for conducting check of vehicles and to carry out to them the state control over observance by the citizens and the organizations performing international carriages of passengers and loads, legislations of the Republic of Tajikistan and the international legal acts in the field of transport recognized as the Republic of Tajikistan;

- perform checks of vehicles on lines, in the specified places on highways, terminals, control Items regarding observance of the transport legislation and licensed requirements and conditions;

- stop, renew license effective period, and also take a legal action for cancellation of action issued to the license;

- stop, resume actions of certificates (certificates) and their cancellation in transport complex;

- consider cases on administrative offenses;

- control observance of regulations and rules in construction of highways, bridges, tunnels, transitions, galleries of streets, railway crossings, and also in improvement and construction of commercial nonindustrial constructions, points on trade in fuels and lubricants and other servicing constructions on strips of withdrawal of highways;

- bring in executive bodies of the government and in law enforcement agencies of the offer on involvement of guilty persons to responsibility, and also about measures for the prevention of the road accidents, abuses of regulations of operation of transport and ecological requirements, for increase in the service level in transport complex;

- use of staff for stop of vehicles in certain places;

- prohibit further movement cargo and passenger vehicles in case of absence at them supporting documents or the state registration plate and to take measures within powers.

III. Organization of activities

7. The service is headed by the Chief appointed to position and dismissed by the Government of the Republic of Tajikistan on representation of the Ministry of Transport and Communications of the Republic of Tajikistan.

The chief of Service has the deputy appointed to position and dismissed by the Ministry of Transport and Communications of the Republic of Tajikistan on representation of the Chief of Service.

8. The chief of Service has the right:

- perform operational management of activities of Service;

- in accordance with the established procedure to appoint and dismiss workers;

- approve the charter of structural divisions, expense budget, the staff list, schedules of watch, job descriptions of employees of central office, structural divisions and the charter of the State unitary enterprise "Center of Certification of Works and Services of Transport Industry";

- approve work plans and forecast indicators of activities of structural divisions of Service;

- represent in accordance with the established procedure employees of Service to rewarding with the state and industry awards of the Republic of Tajikistan.

9. Employees of service have the right to have the certificate and to use uniform, samples, procedure and terms of issue which affirm the Ministry of Transport and Communications of the Republic of Tajikistan.

10. The service on supervision and regulation in the field of transport is legal entity, has the single treasurer account in the Ministry of Finance of the Republic of Tajikistan and account in banks, seal with the image of the State Emblem of the Republic of Tajikistan and with the name, and also the corresponding seals and stamps. The property of Service is created at the expense of the property transferred to it by the state and also other property which cost is reflected in balance of Service.
