About approval of the Instruction about operations procedure of officials of customs in case of representation to persons of data on release of the goods imported on customs area of the Russian Federation
For the purpose of ensuring receipt by persons of data on release of the goods imported on customs area of the Russian Federation according to Articles 10, 15, item 4 of Article 320 and Item 5 of Article 425 of the Customs code of the Russian Federation (The Russian Federation Code, 2003, N 22, the Art. 2066, N 52 (p. I), Art. 5038; 2004, N 27, Art. 2711, N 34, Art. 3533, N 46 (p. I), Art. 4494; 2005, N 30 (p. I), Art. 3101; 2006, N 1, Art. 15, N 3, Art. 280, N 8, Art. 854, N 52 (p. II), Art. 5504; 2007, N 1 (p. I), Art. 29, N 24, Art. 2831, N 27, Art. 3213, N 31, Art. 3995, Art. 4011, N 45, Art. 5417), Item 3 and subitem 14 of Item 5 of article 169 of the Tax Code of the Russian Federation (Russian Federation Code, 2000, N 1 (p. II) of Art. 18; 2002, N 22, Art. 2026; 2005, N 30 (p. II) of the Art. 3130) and for the purpose of implementation of the order of FCS of Russia of October 31, 2007 N 1347 "About procedure for receipt by persons of data on release of the goods imported on customs area of the Russian Federation" (it is registered by the Ministry of Justice of the Russian Federation 21.01. 2008, reg. I order to N 10928):
1. Approve the enclosed Instruction about operations procedure of officials of customs in case of representation to persons of data on release of the goods imported on customs area of the Russian Federation.
2. To provide to chiefs of customs application of the Instruction about operations procedure of officials of customs in case of representation to persons of data on release of the goods imported on customs area of the Russian Federation.
3. To impose control of execution of this order on the deputy manager of FCS of Russia I. A. Zavrazhnov.

Appendix
to the order of the Federal Customs Service of March 11, 2008 No. 231
1. The instruction about operations procedure of officials of customs in case of representation to persons of data on release of the goods imported on customs area of the Russian Federation (further - the Instruction), is developed for the purpose of ensuring receipt by persons of data on release of the goods imported on customs area of the Russian Federation.
Data on release of the goods imported on customs area of the Russian Federation (further - Data), are represented by customs by the written requests of persons enabling the wholesale and retail realization of goods of foreign production (further - the Applicant), constituted in form according to the appendix N 1 to the order of FCS of Russia of October 31, 2007 N 1347 "About procedure for receipt by persons of data on release of the goods imported on customs area of the Russian Federation" (it is registered by the Ministry of Justice of the Russian Federation 21.01. 2008, reg. N 10928) (further Request).
2. Data are represented by results of check with use of information resources of customs authorities of information on customs clearance of goods containing in request.
H. In case of receipt of the Request in FCS of Russia, to regional customs authorities, operational customs, rear customs, the Central basic customs, the Central customs (the Film logical center FCS of Russia) the Inquiry is sent by means of fax connection or by e-mail to customs in which region of activities the Applicant is registered what the applicant within 3 working days is informed on.
4. The customs accepts and registers the Request according to requirements of the existing instruction on clerical work.
5. Preparation of Data is performed by the officials of customs designated according to Item 3 of the order of FCS of Russia of October 31, 2007 N 1347 "About procedure for receipt by persons of data on release of the goods imported on customs area of the Russian Federation" (it is registered imported on customs area of the Russian Federation" (it is registered by the Ministry of Justice of the Russian Federation 21.01. 2008, reg. N 10928) responsible for preparation of transfer of data on release of the goods imported on customs area of the Russian Federation (further - authorized officers).
6. No later than the working day following behind day of receipt of the Request in customs authority authorized officers the Request is registered in register of Requests about representation to persons of data on release of the goods imported on customs area of the Russian Federation. Filling of the specified magazine is performed in form according to the appendix N 1 to this Instruction.
7. Within three working days authorized officers carry out the verification of information about release of goods by comparative analysis of the data containing in request with information containing in the database of electronic copies of the drawn-up customs declarations, available customs.
8. By results of check the letter in form according to the appendix N 2 to the order of FCS of Russia of October 31, 2007 N 1347 "About procedure for receipt by persons of data on release of the goods imported on customs area of the Russian Federation" is constituted.
9. In case of creation of the letter 3 options of filling of the column "Data on Customs Clearance of Goods" are possible:
"The customs clearance of goods is complete, the goods are issued for free circulation" if compliance of the data on goods of information containing in information resources of customs authorities specified in the Request is established and release of goods for free circulation is performed;
"The goods are issued conditionally with restrictions on use and/or the order in accordance with the terms of separate customs regimes" if compliance of the data on goods of information containing in information resources of customs authorities specified in the Request is established and conditional release of goods according to Article 151 of the Customs code of the Russian Federation is performed;
"The customs clearance of goods according to established procedure is not made" if discrepancy of the data on goods of information containing in information resources of customs authorities specified in the Request is established, or release of goods is not made.
10. The prepared letter is signed by the chief of customs, registered and sent to the address specified in the Request.
11. In case of putting down of the record "The Goods Are Issued Conditionally with Restrictions on Use and (Or) the Order in Accordance with the Terms of Separate Customs Regimes" or "Customs Clearance of Goods according to Established Procedure Is Not Made" at least for one goods, the copy of all available materials are transferred to division of customs inspection for the analysis and decision making about feasibility of carrying out customs control after release of goods and (or) vehicles.
12. If the customs clearance of goods is performed in the region of activities of other customs, the authorized officer constitutes request in this customs in form according to the appendix N 2 to this Instruction.
13. The request in customs authority is prepared and goes by means of fax connection or by e-mail within one working day from the moment of receipt to customs of the Request.
14. Registration of request and carrying out information analysis, the drawn-up customs declarations, the available customs containing in the database of electronic copies, is performed by authorized officers of customs in which the Request, by rules and in the terms determined in Items 5-7 of this Instruction arrived. On analysis results the report on form according to the appendix N 3 to this Instruction is constituted and within one working day goes by means of fax connection or by e-mail to the customs initiating request.
15. Check is performed by authorized officers of the customs which sent inquiry by comparison of the data containing in the Request to information provided in the report.
16. Further actions are performed by the customs which sent inquiry according to Items 9-11 of this Instruction.
