Based on the paragraph of third of article 11 of the Law of the Republic of Belarus of June 21, 2002 No. 110-Z "About precious metals and gemstones" and Item 10 of the Regulations on the Ministry of Finance of the Republic of Belarus approved by the resolution of Council of Ministers of the Republic of Belarus of October 31, 2001 No. 1585, the Ministry of Finance of the Republic of Belarus DECIDES:

Approve the Instruction about procedure for use, accounting and storage of precious metals and gemstones it (is applied).

The instruction about procedure for use, accounting and storage of precious metals and gemstones

Chapter 1. General provisions

1. This Instruction establishes procedure for use, accounting and storage of precious metals and gemstones when implementing activities with precious metals and gemstones.

2. For the purposes of this Instruction the following terms and their determinations are applied:

consumption rate of precious metals (gemstones) – assigned amount of precious metals (gemstones) which is necessary for production of unit of production or accomplishment of certain work;

operational accounting – system of collection, processing and information analysis in natural, value and labor term for management of the current economic activity and processes of legal entities and individual entrepreneurs;

processors – the legal entities having the license for the activities connected with the precious metals and gemstones constituting work and (or) service of which collection and conversion of scrap and waste of precious metals and (or) waste of the gemstones arriving from legal entities and physical persons is;

complete completeness – availability of all nodes, details, parts and other elements including containing precious metals, providing functioning of the written off electric and electronic equipment;

estimated price – the price of the precious metals (except the precious metals used in case of banking operations) accepted in the State fund of precious metals and gemstones of the Republic of Belarus (further – State fund);

technical documentation – documentation containing the information about structure and product structure (products), its characteristics, appointment, the principles of functioning (passports, forms, labels, the operation manual, other design documentation);

the storage of values – construction construction, including modular, intended for storage of precious metals and gemstones, protected from breaking, steady against impact of dangerous factors of the fire and corresponding to the V-XIII classes of resistance to breaking, the safe room, and also the separate safe is not lower than V classes of resistance to breaking;

the electric and electronic equipment – the equipment containing precious metals and entering into group 7 of the inventory and packaging in case of production and (or) import of which on legal entities and individual entrepreneurs extends obligation on ensuring collection, neutralization and (or) use of waste of goods and packagings, and the amount of payment for the organization of collection, neutralization and (or) use of waste of the goods and packaging established in appendix 4 to the resolution of Council of Ministers of the Republic of Belarus of June 30, 2020 No. 388 "About the address with waste of goods and packagings".

The terms "activities with precious metals and gemstones", "gemstones", "precious metals", "use of precious metals and gemstones", "scrap and waste of precious metals", "processing of gemstones", "processing (conversion) of scrap and waste of precious metals", "waste of gemstones", "test", "jewelry and other products" are applied in the values established respectively by paragraphs the sixth, the eighth, the ninth, the eleventh, the thirteenth, the fifteenth, the sixteenth, the nineteenth, twenty first and twenty sixth article 1 of the Law of the Republic of Belarus "About precious metals and gemstones".

The term "financial accounting" is applied in the value established by the paragraph the fourth article 1 of the Law of the Republic of Belarus of July 12, 2013 No. 57-Z "About financial accounting and the reporting".

3. This Instruction extends to the legal entities and individual entrepreneurs (further – the organizations) performing the activities connected with precious metals and gemstones if other procedure is not established by acts of the legislation in the field of activities with precious metals and gemstones.
