According to the laws of the Republic of Kazakhstan of January 19, 2001 "About grain", of November 9, 2004 "About technical regulation" the Government of the Republic of Kazakhstan DECIDES:

1. Approve the enclosed Technical regulation "Requirements to Safety of Grain".

2. This resolution becomes effective after one year after official publication.

Technical regulation "Requirements to Safety of Grain"

1. Scope

2. Requirements of this Technical regulation extend to the food and seed grain which is object of technical regulation, classified according to classification of goods in the Commodity nomenclature of foreign economic activity of the Republic of Kazakhstan (the Commodity Nomenclature of Foreign Economic Activity of RK) according to appendix 1 to this Technical regulation.

3. Requirements of this Technical regulation do not extend to the grain intended for the fodder and technical purposes and grain conversion products.

3-1. Dangerous factors for life and health of the person are availability in foodgrain:

1) maximum-permissible levels of potentially dangerous chemical compounds and residual amount of pesticides;

2) maximum-permissible levels of impurity, including harmful impurity;

3) infectiousnesses wreckers;

4) foreign smells;

5) the increased humidity creating favorable conditions for self-warming, development of microorganisms and formation of mycotoxins.

3-2. Dangerous factors of seed grain are availability:

1) maximum-permissible levels of impurity, including harmful impurity;

2) the increased humidity;

3) quarantine weeds, wreckers and diseases;

4) seeds of poisonous weeds;

5) infectiousnesses wreckers.

3-3. Identification of grain is performed based on the accompanying documentation containing information on grain batch on visual survey of the botanical signs of grain characteristic of this type of culture.

2. Terms and determinations

4. In this Technical regulation the following terms and determinations are used:

agrotechnical actions - set of evidence-based acceptances on cultivation of crops;

agrochemical actions - set of evidence-based acceptances of use of agrochemicals and pesticides for the purpose of preserving and reproduction of fertility of lands of agricultural purpose and protection of the surrounding environment;

the address of grain - implementation processes (sales or deliveries) grains, including its import (import) and export (export);

safety of grain - lack of unacceptable risk at all stages of lifecycle of the grain connected with damnification of life, to health of the person and violation of consumer interests taking into account combination of probability of realization of dangerous factor and severity of its effects;

grain production - complex of the agrotechnological actions directed to grain cultivation;

grain batch - amount of grain, homogeneous on quality, intended to simultaneous acceptance, shipment or storage, drawn up by one quality certificate and safety;

grain test - the certain amount of grain which is selected from batch for determination of its quality and safety;

active aeration of grain - forced blowing off of grain atmospheric air for repeated change of air of intergrain space for the purpose of chilling or dehumidification;

grain destruction - impact on the grain unsuitable to the use and (or) further conversion excluding it use for the food purposes and access to it for the person and animals;

grain disinfecting - chemical, radiative or physical impact on grain for extermination of wreckers, microorganisms, including quarantine objects;

grain utilization - use of low-quality and dangerous grain not to destination;

grain drying - decrease in humidity of grain by processing by the warmed-up or not warmed up air (the drying agent);
