About some questions of registration of the objects for use of waste, objects of storage, burial and neutralization of waste put into operation
Based on Item 3 of Article 28 and Item 1 of article 31 of the Law of the Republic of Belarus of July 20, 2007 "About the address with waste" the Ministry of Natural Resources and Environmental Protection of the Republic of Belarus DECIDES:
1. Approve the enclosed Instruction about order of registration of the objects for use of waste and objects of storage, burial and neutralization of waste put into operation.
2. Authorize on maintaining the register of objects for use of waste, the register of objects of storage, burial and neutralization of waste the republican research unitary enterprise "BelNITs "Ecology", Minsk.
3. The legal entities and individual entrepreneurs having the property right to the objects for use of waste put into operation shall direct documents for registration of these objects in the register of objects for use of waste within three months from the date of entry into force of this resolution.
4. The legal entities and individual entrepreneurs having the property right to the objects of storage, burial and neutralization of waste put into operation shall direct documents for registration of these objects in the register of objects of storage, burial and neutralization of waste within three months from the date of entry into force of this resolution.
5. Declare invalid the resolution of the Ministry of Natural Resources and Environmental Protection of the Republic of Belarus of March 28, 2002 No. 4 "About the state register of technologies for use of waste and the state register of subjects to neutralization and placement of waste" (The national register of legal acts of the Republic of Belarus, 2002, No. 96, 8/8435).
6. This resolution becomes effective from the date of its official publication.

1. This Instruction is developed according to articles 28 and 31 of the Law of the Republic of Belarus of July 20, 2007 "About the address with waste" (The national register of legal acts of the Republic of Belarus, 2007, No. 183, 2/1368) (further - the Law) and determines order of registration of the objects for use of waste put into operation in the register of objects for use of waste, objects of storage, burial and neutralization of waste in the register of objects of storage, burial and neutralization of waste, and also maintaining the register of objects for use of waste, the register of objects of storage, burial and neutralization of waste (further - registers if in this Instruction other is not used).
2. For the purposes of this Instruction the following terms and their determinations are used:
objects for use of waste - constructions (complex of constructions) intended for production, energy, performance of works, rendering services using waste;
subjects to neutralization of waste - constructions (complex of constructions) intended for processing, burning of waste or destruction of waste by the different way including leading to reduction of amount of waste and (or) liquidation of their dangerous properties (except for activities for burial);
objects of storage of waste - constructions (complex of constructions) intended for storage of the waste which is not intended for export on use, neutralization, burial;
subjects to waste disposal - the polygons and other constructions intended for isolation of waste for the purpose of prevention of harmful effects of waste, products of their interaction and (or) decomposition on the environment, health of citizens, the property which is in the property of the state, property of legal entities and physical persons which is not providing possibility of their further use;
mini-polygons - subjects to waste disposal with annual capacity to 5 thousand m3 or to 1 thousand tons per year.
3. Registration of the objects for use of waste and objects of storage, burial and neutralization of waste put into operation (further - objects if in this Instruction other is not used) is assigned to the legal entity or the individual entrepreneur having the property right to the objects put into operation, or to the legal entity authorized by them or the individual entrepreneur performing operation of objects (daleezayavitel).
4. For registration of object the applicant sends to the republican research company "to BelNITs "Ecology" of the Ministry of Natural Resources and Environmental Protection of the Republic of Belarus (further - body of maintaining registers) the documents specified in the list of the ministerial procedures performed by the Ministry of Natural Resources and Environmental Protection and its territorial authorities concerning legal entities and individual entrepreneurs, No. 1379 approved by the resolution of Council of Ministers of the Republic of Belarus of October 22, 2007 (The national register of legal acts of the Republic of Belarus, 2007, No. 261, 5/26021; 2009, No. 118, 5/29744) (further list).
5. Forms of statements for registration of objects are established:
for the objects for use put into operation otkhodovsoglasno to appendix 1;
for the objects of storage put into operation and zakhoroneniyasoglasno to appendix 2;
for the subjects to neutralization put into operation otkhodovsoglasno to appendix 3.

7. Registration of object or decision making about refusal in registration of object is made in time, specified in the list.

9. The refusal in registration of object is drawn up by body of maintaining registers in writing with indication of cause of failure and the reference to the regulations of the legislation of the Republic of Belarus which are the basis for refusal and goes to the applicant.
10. Registration of object in the corresponding register is made by means of entering of the data on object into the magazine of registration put into operation of objects for use of the waste, in the magazine of registration put into operation of objects of storage, the waste disposal, in the magazine of registration put into operation of subjects to neutralization of waste and entering of register number into the statement for registration of the object for use of waste put into operation the statement for registration of the object of storage, waste disposal put into operation, the statement for registration of the subject to neutralization of waste put into operation.
The magazine of registration of the objects for use of waste put into operation, the magazine of registration of the objects of storage, waste disposal put into operation, the magazine of the subjects to neutralization of waste put into operation are recorded in form according to appendix 7.
11. Registration of object is confirmed by the registration certificate of the object put into operation issued to the applicant.
The registration certificate of the object for use of waste put into operation, the registration certificate of the object of storage, waste disposal put into operation, the registration certificate of the subject to neutralization of waste put into operation is granted in form according to appendix 8.
12. The object for use of waste put into operation, storages, burials or neutralizations of waste is considered registered in the register from the date specified in the registration certificate of the object put into operation.
13. Body of maintaining registers:
considers, stores statements for registration of the objects for use of waste put into operation, statements for registration of the objects of storage, waste disposal, the statement for registration of the subjects to neutralization of waste put into operation put into operation;
creates electronic databases of objects;
carries out updating of databases of the objects for use of waste put into operation, storages, burials and neutralizations of waste;
posts information on objects on the official site of the Ministry of Natural Resources and Environmental Protection of the Republic of Belarus on the Internet;
provides information from registers monthly and (or) as required to territorial authorities of the Ministry of Natural Resources and Environmental Protection of the Republic of Belarus.
14. Provision of information from registers is performed within 7 days from the date of receipt of the written appeal of the interested state bodies, legal entities and physical persons, including individual entrepreneurs.
15. Provision to state bodies of the Republic of Belarus of information from registers, necessary for accomplishment of the obligations by them, is performed on a grant basis.
16. By provision of information from registers to legal entities and physical persons, including individual entrepreneurs, the payment only for the services connected with matching, copying, replication, transfer and (or) transfer on communication channels of such information is levied.
17. Data of registers of objects are used in case of:
conducting the state environmental assessment of the project documentation on construction of facilities of economic and other activity;
to issue of permissions to storage of production wastes and on production waste disposal;
registration of transactions about transfer of dangerous wastes for certain term (except the transportation agreement), and also about alienation of dangerous wastes to other legal entity or physical person, including the individual entrepreneur performing the address with waste;
development, approval and establishment of limits of storage and limits of waste disposal of production;
to issue of permissions to cross-border movement of waste;
to development of territorial programs in the field of the address with waste;
decision making about issue of special permissions (licenses) for implementation of the activities connected with use of natural resources and impact on the environment.
18. The objects for use of waste put into operation are subject to obligatory registration in the register of objects for use of waste.
The objects of storage put into operation, burials and neutralizations of waste are subject to obligatory registration in the register of objects of storage, burial and neutralization of waste.
Operation of objects for use of the waste which is not included in the register of objects for use of waste, objects of storage, burial and neutralization of the waste which is not included in the register of objects of storage, burial and neutralization of waste is not allowed.
19. Activities for burial and neutralization of waste on subjects to burial and neutralization of the waste which is not registered in the register of objects of storage, burial and neutralization of waste, and also activities for use of waste of 1-3rd of classes of danger on objects for use of the waste which is not registered in the register of objects for use of waste are illegal business activity.
20. In case of numerous violation of requirements of the nature protection legislation the officials of the Ministry of Natural Resources and Environmental Protection of the Republic of Belarus and its territorial authorities exercising the state control in the field of environmental protection within the competence have the right to limit or suspend work of object for use of waste, storages, burials and neutralizations of waste.
21. The resolution on restriction or suspension of work of object (further - the resolution) is handed on receipt to management of the stopped object or goes the registered mail with the notification. The copy of the resolution goes to superior organization on subordination of object, the Ministry of Natural Resources and Environmental Protection, regional authorities and to tax authority in the place of registration of the payer.
22. Suspension of productive activity of object is made directly by the head of object or the official authorized by it. The head of object bears complete responsibility for suspension of its productive activity.
23. In case of failure to carry out by the head of subject of the resolution suspension of activities of object can be performed by sealing of the constructions or main nodes, aggregates and the equipment influencing implementation of activities for use, storage, burial or neutralization of waste. In the course of sealing the statement signed by persons participating in sealing is drawn up. The management of object bears responsibility for safety of the filled tooth.
24. Commissioning of the suspended object is made after fulfillment of requirements, the bodies of the Ministry of Natural Resources and Environmental Protection established by instructions.
