1. Approve Rules about internetwork connection.

2. To send to management of technical, tariff and anti-monopoly regulation the above-stated regulatory legal act to the Ministry of Justice of the Kyrgyz Republic on state registration.

3. To the head of department of technical, tariff and anti-monopoly regulation (Saadakbayeva A. K.) after state registration and the subsequent official publication of this order to bring this order to contractors.

4. This order becomes effective after registration in the Ministry of Justice of the Kyrgyz Republic and the subsequent official publication.

5. With introduction of this order to declare invalid the order of the State communication agency under the Government of the Kyrgyz Republic of February 8, 2003 No. 20-pr "About approval of Rules of interface of networks of telecommunication public of the Kyrgyz Republic".

6. To impose control of execution of this Order on Management of technical, tariff and anti-monopoly regulation (Saadakbayeva A. K.).

Rules about internetwork connection

Chapter I Introduction

1.1. Preface

These rules are developed according to the Law of the Kyrgyz Republic "About electric and mail service" (further in the text "Law").

1.2. Purpose

The purpose of these rules is establishment of the determinations used in case of internetwork connection and also rules and procedures of interaction of networks of telecommunication and rendering services of telecommunication.

1.3. Scope of application

Provisions of these rules are obligatory for all operators of telecommunication providing or requesting services of internetwork connection.

1.4. Terms and determinations

Data on traffic - any data processed for the purpose of transfer of traffic on any networks of telecommunication between which internetwork connection with the subsequent drawing of accounts is performed;

access - provision of means and/or services of telecommunication by one operator to another on contractual basis for the purposes of provision of services of telecommunication through internetwork connection, including:

- access to elements of network and the related means necessary for connection of the equipment (including access to local communication lines);

- access to physical infrastructure, including buildings, canals and support;

- access to systems of the software, including systems of first-line support;

requesting internetwork connection - the operator of telecommunication having the license of regulating authority and performing the activities according to it, and who addressed the supplier of internetwork connection with request to provide services of internetwork connection;

considerable influence in the market - the possession of economic force allowing the service provider to act to some extent irrespective of clients or competitors, in particular in case of decision making concerning service prices, or otherwise possession of dominant position on one or more certain markets of services of telecommunication;

the identification of the line of challenge (ILC) - the information created and processed by network of telecommunication determining number of the defiant party;

initiation of challenge - the service of internetwork connection providing outgoing communication from the terminal equipment of the subscriber to point of internetwork connection;

internetwork connection - physical and logical connection of networks of telecommunication for provision of opportunity to subscribers of one service provider to contact subscribers of other service provider or receipt of access to the services provided by other service provider;

the local communication line - set of the means of telecommunication connecting terminal points of connection of network of the subscriber with the main distribution network or equivalent means in network of the fixed lines of telecommunication public;

necessary means - any means of telecommunication belonging or used by the supplier of internetwork connection, access to which the operator requesting internetwork connection for rendering service of telecommunication according to these rules and other regulatory legal acts asks to provide;

the terminal equipment (the subscriber device) - directly or not directly the technical means or devices connected through subscriber lines or with use of wire, fiber-optic and electromagnetic devices to network of telecommunication by means of which the user can transfer, transform or accept messages;

regulating authority - authorized body of regulation of the Kyrgyz Republic in the field of communication according to the Law;

portability of number - capability of clients to change suppliers of the services in certain range of numbers with preserving phone numbers;

payment for internetwork connection - any payments and the amounts levied by the service provider of internetwork connection from the operator of telecommunication requesting internetwork connection in exchange for provision of services of internetwork connection or according to the agreement on internetwork connection;

the supplier of internetwork connection is the operator of telecommunication having the license of regulating authority, providing or undertaking to provide services of internetwork connection to the operator who requested internetwork connection;

the service provider holding dominant position - the service provider having considerable influence in one or more markets of telecommunication relating to internetwork connection according to Item 4.1.2. these rules;
