Regulations on procedure for inclusion in names of legal entities of specifying on the official complete or reduced name of the Kyrgyz Republic

1. This Provision is developed in pursuance of Article 89 of the Civil code of the Kyrgyz Republic and the order of the Government of the Kyrgyz Republic of August 29, 1998 No. 574 "About the questions connected with procedure for inclusion in names of legal entities in case of their state registration of the name of the Kyrgyz Republic".

2. This Provision determines procedure for inclusion in the name of legal entities in case of their state registration of specifying on the official complete or reduced name of the republic" Kyrgyz Republic" (Kyrgyzstan).

3. The state registering bodies (The Ministry of Justice of the Kyrgyz Republic, its territorial authorities, Directorates of free economic zones of the republic) in case of state registration of legal entities are guided by this Provision.

4. The name "Kyrgyz Republic" is the complete official name of the republic.

The name "Kyrgyzstan" is the reduced official name of the republic.

5. The names "Kyrgyz Republic", Kyrgyzstan are used in names of public authorities, National Bank according to regulatory legal acts of the Kyrgyz Republic about their creation. The names "Kyrgyz Republic", Kyrgyzstan are not used in names of the organizations formed by the bodies having the above-stated names in the name.

6. Inclusion of the official complete or reduced name of the Kyrgyz Republic in names of commercial and non-profit organizations is made according to the procedure, established by this Provision.

Use in the name of legal entities of the official complete or reduced name of the republic taking into account features of national languages is not allowed.

7. Non-profit organizations, except for the religious organizations, can include in the name the official complete or reduced name of the republic in cases if the organization combines or is created by the citizens and (or) legal entities living (located) in the territory of more than a half of areas of the republic.

8. Use of the official complete or reduced name of the republic is allowed in names of the commercial organizations in cases if:

- the state company is created by the order of the Government of the Kyrgyz Republic;

- the share of the state participation in the authorized capital of economic partnership or society constitutes more than 50%;

- the size of contribution of the foreign investor to the authorized capital of economic partnership or society constitutes at least five million som.

9. The legal entities created in the territory of the Kyrgyz Republic by foreign physical and (or) legal entities and also branches and representations of foreign legal entities, can use in the name the complete or reduced name of the Kyrgyz Republic for designation of the place of their arrangement.

10. Legal entities whose name contains specifying on the complete or reduced name of the Kyrgyz Republic reserve right to use of such name in case of re-registration.
