ORDER OF THE GOVERNMENT OF THE KYRGYZ REPUBLIC

of December 31, 2002 No. 915

About medico-social examination in the Kyrgyz Republic

(as amended on on July 11, 2008)

For the purpose of enhancement of the legislation in the field of medico-social examination, implementation of multi-profile rehabilitation of disabled people, the Government of the Kyrgyz Republic decides:

1. Transform medical labor commissions of experts to medico-social commissions of experts (MSEK).

2. Approve enclosed:

- Structure of medico-social commissions of experts in the Kyrgyz Republic;

- Regulations on organizations of medico-social examination in the Kyrgyz Republic;

- The medical indications granting the right to monthly allowance on handicapped children before achievement of age by them eighteen years;

- The classification and criteria used when implementing medico-social examination;

- Regulations on recognition of person by the disabled person;

- Regulations on procedure for establishment by medico-social commissions of experts of extent of loss of professional working capacity and needs in additional types of the help to persons, victims of the labor accidents, occupational diseases or other damages of health connected with execution of labor obligations by them;

- Procedure for survey of MSEK of the military personnel, participants of war and other fighting, and also establishments of causal relationship of disability with wound, contusion, injury, mutilation, the disease got at the front or during other fighting during passing of military service;

- Medical indications for providing disabled people chair - and cycle carriages, supportive household applications;

- The list of medical indications on receipt of special vehicles by persons who sustained labor injuries.

3. To transfer to the Ministry of Health of the Kyrgyz Republic since January, 2003 survey of children and teenagers to 16 years to maintaining the Ministry of Labour and Social Protection of the Kyrgyz Republic.

4. To the Ministry of Labour and Social Protection of the Kyrgyz Republic to bring the regulatory legal acts into accord with this resolution.

5. Ceased to be valid the Order of the Government KR of July 11, 2008 No. 372.

6. Recognize invalid the orders of the Government of the Kyrgyz Republic:

- of December 19, 1998 No. 838 "About medical labor commissions of experts";

- of April 21, 2000 No. 226 "About change of structure of medical labor commissions of experts", the Kyrgyz Republic approved by the order of the Government of December 19, 1998 No. 838 "About medical labor commissions of experts".

Regulations on organizations of medico-social examination in the Kyrgyz Republic

I. General provisions

1. This Provision regulates activities of the organizations of medico-social examination created according to the Law of the Kyrgyz Republic "About social protection of disabled people in the Kyrgyz Republic" and determines the purposes and tasks, organizational structure and operating procedure.

2. Medico-social examination is performed by medico-social commissions of experts (further - MSEK). MSEK carry out the work on the territorial principle and in the activities are guided by the Laws of the Kyrgyz Republic, decrees and orders of the President of the Kyrgyz Republic, resolutions and orders of the Government of the Kyrgyz Republic, resolutions and orders of the Ministry of Labour and Social Protection of the Kyrgyz Republic, this Provision and other regulatory legal acts.

3. The service of medico-social examination is independent structural division of the Ministry of Labour and Social Protection of the Kyrgyz Republic and has the single centralized control system.

4. MSEK is legal entity with form of business "public institution" as operational management. MSEK of all levels have stamp and seal. The center of medico-social examination and rehabilitation of disabled people has seal with the image of the State Emblem of the Kyrgyz Republic with the name in the state and Russian languages. The center of medico-social examination and rehabilitation of disabled people of the Ministry of Labour and Social Protection of the Kyrgyz Republic has separate balance, settlement (including currency) the account in organizations of banks.

II. Tasks and functions of medico-social commissions of experts

5. Main objectives and functions of medico-social commission of experts (primary, average link):

- conducting examination of temporary and permanent disability, factual determination of availability of disability, determination of group of disability, reasons (circumstances and conditions of origin), terms and time of approach of disability, need of the disabled person for different types of social protection;

- determination of needs of disabled people in additional types of the help (victim of labor mutilation), technical means of rehabilitation, medical and employment rehabilitation;

- determination for disabled people of the conditions and types of work, work and professions available to condition of their health, and also conditions and methods by means of which the broken working capacity can be recovered or increased;

- establishment of extent of loss of professional working capacity (as a percentage) to persons who sustained the injuries or other damage of health connected with execution of labor obligations by them and need of implementation of additional measures of social protection;

- determination of need of disabled people for supportive applications of movement (wheelchair, cycle carriage);

- in the direction of social security authorities:

 conducting posthumous examination;

 establishment of disability for last time;

- check of correctness of use of work of disabled people at work according to recommendations of MSEK;

- rendering assistance to disabled people in receipt of equal opportunities of life, study and labor activity within functional obligations;

- rendering the advisory help to doctors of treatment and prevention facilities concerning MSE, including advisory survey of disabled people and patients;

- participation in development of individual programs of rehabilitation of disabled people and control of their realization;

- studying of condition and the reasons of disability in zone of servicing and submission of reports in higher MSEK, healthcare institutions of the republic on condition and the reasons of disability;

- participation in development of comprehensive programs of prevention of disability together with bodies of health care and employers.

6. The main objectives and functions of the Center of medico-social examination and rehabilitation of disabled people are:

- methodical and organizational management of subordinated MSEK;

- implementation of actions for advanced training of medical experts of MSEK of the republic (training on workplace, seminars, scientific and practical conferences, etc.);

- completion of MSEK by qualified personnel;

- quality assurance, legality, scientific justification of medico-social examination in the republic, implementation of achievements of science in activities of MSEK;

- control of activities and quality of examination of subordinated MSEK, check of correctness and justification of expert decisions (by internal re-examination, studying of clerical work), carrying out work on the revealed cases of expert mistakes, development of measures for the prevention and elimination of mistakes;

- conducting medico-social examination of citizens in the directions of subordinated MSEK;

- conducting medico-social examination of persons appealing the solution of subordinated MSEK;

- consideration of letters, claims and statements concerning MSEK, studying of their reasons;

- survey and re-examination of the separate contingents of the population: participants of liquidation of accident on the CNPP, persons who sustained labor injuries, occupational disease and others;

- in cases of groundlessness of solutions of subordinated MSEK modification of these decisions or their cancellation;

- in the direction of social security authorities:

 conducting posthumous examination;

 establishment of disability for last time;

- determination of need for special vehicles to disabled people of the Great Patriotic War;

- rendering the advisory help to subordinated MSEK, and in complex cases - conducting examination with departure into place;

- providing subordinated MSEK with the forms of documents necessary for their activities;

- rendering assistance to subordinated MSEK in their placement and equipment;

- participation in studying of the factors resulting in disability and in development of comprehensive programs in the field of prevention of disability, medico-social examination, rehabilitation and social protection of disabled people;

- generalization of work experience on examination of working capacity of subordinated MSEK;

- implementation of monitoring of condition, dynamics of disability and factors, to it bringing;

- forming of databank about the citizens who passed the medico-social examination, implementation of the state statistical observation of the demographic list of disabled people;

- regular submission of information to the Ministry of Labour and Social Protection, and through it in other ministries and departments;

- creation, generalization of annual statistic reports, annual collections of the main indicators of disability and activities of MSEK for the republic, the edition of information and methodical reviews, methodical letters on different questions MSE, job analysis of MSEK, if necessary introduction of materials for consideration of board of the Ministry of Labour and Social Protection of the Kyrgyz Republic.

III. Rights of medico-social commissions of experts

7. The medico-social commission of experts (primary, average link) has the right:

- perform activities in the field of medico-social examination and rehabilitation of disabled people;

- send persons undergoing survey to treatment and prevention facilities of health care for the purpose of refining of their kliniko-functional diagnosis and for performing recovery treatment;

- request and receive from state bodies of management, treatment and prevention facilities of health care, employers, irrespective of patterns of ownership, their economic activity and departmental accessory, the data, necessary for conducting examination, including data on nature and working conditions of persons undergoing survey;

- visit employers, irrespective of pattern of ownership, their economic activity and departmental accessory, get acquainted with production processes and workplaces, to study correctness of employment of disabled people and accomplishment of recommendations about employment and employment opportunity of disabled people, to get acquainted with reports, statistical and other materials on the questions concerning rehabilitation of disabled people;

- demand from treatment and prevention facilities of health care of high-quality execution of the medical documents sent to MSEK, control their objectivity;
