About approval of the Technical regulation "Requirements to Safety of Vehicles"

For the purpose of implementation of the Law of the Republic of Kazakhstan of November 9, 2004 "About technical regulation" the Government of the Republic of Kazakhstan DECIDES:

1. Approve the enclosed Technical regulation "Requirements to Safety of Vehicles".

2. This resolution becomes effective after one year from the date of the first official publication.

Technical regulation "Requirements to Safety of Vehicles"

1. General provisions

1. Scope

Objects of technical regulation of this Technical regulation are motorized vehicles of categories M1, M2, M3, N 1, of N2 and N3 with engine capacity more than 50 cm3 and with a maximum constructive speed more than 50 km/h and trail cars of categories O1, O to them 2, O3 and O4 (vehicles) classified according to appendix 1 to this Technical regulation, released and operated in the territory of the Republic of Kazakhstan and also in case of modification of their design (re-equipment), and during the termination of term of their operation (utilization).

Action of this Technical regulation does not extend to the following motorized vehicles and their components:

- low-speed, having the maximum constructive speed no more than 25 km/h;

- imported on the territory of the Republic of Kazakhstan for the term of no more than six months or placed under customs regimes which do not provide possibility of alienation;

- not intended for operation on highways public of the Republic of Kazakhstan;

- intended only for sports competitions;

2. In the Technical regulation the concepts established  by the Law of the Republic of Kazakhstan of November 9, 2004 "About technical regulation" and also the following concepts are used:

- the vehicle - the device with the engine or trail car (semitrailer truck) to such device entering the list given in appendix 1 to this Technical regulation;

- the analysis of condition of production - set of the procedures performed by body for confirmation of conformity according to its competence which area of accreditation the vehicles and their components including the analysis of documentation concerning production organization of products and check of conditions of production enter (assessment on site availability of the adequate measures and procedures necessary for production according to the declared types and safety requirements);

- the anti-blocking brake system - the additional system of the working brake system preventing blocking of the slowed-down wheels of vehicles in case of emergency brake application;

- the auxiliary brake system - the brake system intended for reduction of power-loading of brake mechanisms of the working brake system of vehicles;

- the released vehicles - the vehicles manufactured in the Republic of Kazakhstan and not being earlier in operation, and also vehicles imported for term more than six months on the territory of the Republic of Kazakhstan for proper use or placement in the market for the purpose of realization;

- the hygienic standard rate - the admissible maximum or minimum quantitative and (or) high-quality measure value established by researches, characterizing this or that factor of the habitat from line item of its safety and (or) harmlessness for the person;

- the state technical inspection (further - technical inspection) - technological assessment procedure of compliance of the vehicles which are in operation, to safety requirements on the basis of which the decision on their admission to participation in traffic is made;

- the holder of originals of technical documentation - the organization or the company having originals of technical documentation and having the right to modification of it;

- evidentiary materials - the documents containing information allowing to establish compliance of object of technical regulation to requirements of this Technical regulation;

- the single vehicle - the vehicle manufactured or imported into the Republic of Kazakhstan in one copy, individually declared for assessment of conformity to requirements of this Technical regulation;

- the complete vehicle - the vehicle capable to carry out the motor transportation or transport and technological functions corresponding to its constructive appointment;

- the reserve brake system - the brake system intended for reduction of speed and stop of vehicles in case of failure of the working brake system;

- the identification code of global manufacturer (WMI) - the first Section of identification number of transport number of the vehicle (VIN) designates the producer of the vehicle. The WMI code is assigned for the producer of the vehicle for the purposes of identification of this producer. The WMI code when using together with other Sections of the VM code provides not repeatability of the last for all the vehicles made within 30 years in all states of the world;

- vehicle identification number (VIN) the structured combination of signs which is appropriated by the producer of the vehicle;

- manufacturer - the legal entity or physical person performing production of the vehicle or its components with intention of their release in the address or for own use, bearing responsibility for fulfillment of requirements of the Technical regulation in the limits established by it;

- changes in designs (re-equipment) of the vehicle - exception provided or installation of the components which are not provided by the manufacturer and pieces of the equipment as a result of which properties, parameters and technical characteristics of vehicles set by the manufacturer change;

- category of the vehicle - division of vehicles according to the classification accepted in the Summary resolution on design of vehicles (Cf. 3), the Economic Commission for Europe of the UN accepted by Committee on inland transport (the document TRANS/WP29/78/Rev. 1 of 11:08. 97, appendix 7), see appendix of 1 present of the Technical regulation;

- components - the vehicle design components delivered on assembly production of vehicles (part of original picking) and (or) as replaceable (reserve) parts for after-sale service of the vehicles which are in operation;

- constructive safety of the vehicle - the condition characterized by set of the parameters of design of the vehicle to which it shall correspond upon completion of its production established for the purpose of prevention of unacceptable risk of damnification of life or to health of citizens, property of physical persons and legal entities, the state-owned and utility property, the environment;

- the motorized vehicle - any self-propelled road vehicle, except for mopeds and rail vehicles;

- the incomplete vehicle - the vehicle which is not completed by production released for the purpose of further completion;

- safety - complex of the actions directed to reduction of object of technical regulation in condition in case of which there is no unacceptable risk of damnification of life or to health of citizens, property of physical persons and legal entities, the state-owned and utility property, the environment;

- approval of type - the assessment procedure of compliance corresponding to the international practice like the vehicle (chassis) to all requirements established concerning it harmonized with the Agreement on adoption of uniform technical instructions for wheel vehicles, pieces of the equipment and parts which can be established and/or used on wheel vehicles and about conditions of mutual recognition of the official approvals issued on the basis of these instructions (The Geneva accord of 1958), applied concerning types of vehicles (chassis) released in the territory of the countries ratifying the Geneva accord;

- approval like the vehicle - the document confirming compliance of the released vehicles carried to one type, everything established concerning them in the country ratifying the Agreement on adoption of uniform technical instructions for wheel vehicles, pieces of the equipment and parts which can be established and/or used on wheel vehicles, and about conditions of mutual recognition of the official approvals issued on the basis of these instructions (The Geneva accord of 1958), to the requirements harmonized with the Geneva accord;

- approval like the chassis - the document confirming compliance of the released incomplete vehicles carried to the conforming type, safety requirements. Set of requirements is determined by degree of completeness of design;

- after-sale service - package of measures, the vehicles performed for the purpose of ensuring convenience of operation, their reliability and safety within the set service life. Includes: routine maintenance, repair of vehicles, the edition of reference books, providing with replaceable (reserve) parts, training of staff of the centers of maintenance, and also other actions aimed at providing operational safety of vehicles;

- Rules of the United Nations Economic Commission for Europe (UNECE Regulation) - the technical instructions accepted according to the Geneva accord of 1958 and which are appendices to the Geneva accord of 1958, the list of the UNECE Regulations applied to the purposes of this Technical regulation it is given in appendix 2;

- production process in case of realization of vehicles - the process including the obligatory technical impacts ordered by producers for vehicles and performed by sellers of vehicles or producers of vehicles;
