About approval of Rules of transportations of passengers and baggage by railway transport public in the Republic of Belarus

In pursuance of Item 6 of the Charter of rail transport of the general use approved by the resolution of Council of Ministers of the Republic of Belarus of August 2, 1999 No. 1196, in edition of the resolution of Council of Ministers of the Republic of Belarus of September 3, 2007 No. 1134 and according to the Regulations on the Ministry of Transport and Communications of the Republic of Belarus approved by the resolution of Council of Ministers of the Republic of Belarus of July 31, 2006 No. 985 "Questions of the Ministry of Transport and Communications of the Republic of Belarus", the Ministry of Transport and Communications of the Republic of Belarus DECIDES:

1. Approve the enclosed Rules of transportations of passengers and baggage by railway transport public in the Republic of Belarus.

2. This resolution becomes effective in 30 days after its official publication.

Rules of transportations of passengers and baggage by railway transport public in the Republic of Belarus

Chapter 1. General provisions. Area and procedure for application

1. Rules of transportations of passengers and baggage by railway transport public in the Republic of Belarus (further - Rules) are developed according to requirements of the Charter of rail transport of the general use approved by the resolution of Council of Ministers of the Republic of Belarus of August 2, 1999 No. 1196, in edition of the resolution of Council of Ministers of the Republic of Belarus of September 3, 2007 No. 1134 (The national register of legal acts of the Republic of Belarus, 1999, No. 67, 5/1506; 2007, No. 235, 5/25818) (further - the Charter). Rules are obligatory for national association "Belarusian railroad" (further - the Belarusian railroad), its organizations, passengers, senders and receivers of baggage, cargo baggage.

2. Rules extend to transportations of passengers and baggage by railway transport public on the territory of the Republic of Belarus in the cars assigned to the Belarusian railroad on the right of economic maintaining, leased from it and also in the cars which are under authority of state bodies and other organizations.

When transporting passengers on the territory of the Republic of Belarus in the cars belonging to railway administrations of other states regulations of the corresponding international agreements and agreements are effective.

3. The Belarusian railroad, its organizations shall satisfy the need of the population for passenger traffic, safety of passengers when using of railway transport, conveniences, necessary for them, their cultural servicing at stations and in trains, timely transportation and safety of baggage. The Belarusian railroad, its organizations shall provide movement of passenger trains strictly according to the schedule, except as specified, not depending on the organizations of the Belarusian railroad.

Workers of the Belarusian railroad, its organizations shall be polite and precautionary to passengers, senders and receivers of baggage, cargo baggage, to show care and attention to them, to take measures to remedial action in servicing of passengers irrespective of by which of workers of rail transport they are allowed.

Passengers shall follow public order, these rules and make thrifty use of property of the Belarusian railroad, its organizations.

In case of disputable situations between the passengers and workers of rail transport who are on duty passengers have the right to address:

at the station, the station - to the station commander, the station or to other authorized person;

in the passenger train (during landing time and journey) - to the chief of the train or the corresponding authorized person which is in the train.

4. According to the transportation agreement of passengers the Belarusian railroad, its organizations shall transport the passenger and his baggage in destination, having provided it the place in the train according to the travel document (ticket).

The conclusion of the transportation agreement of the passenger makes sure the travel document (ticket), and luggage transports, cargo baggage - the carriage document (the carriage document ACS "Express", the luggage receipt, the cargo luggage receipt, the receipt).

Passengers are transported by sleeping (SV), compartment, couchette, general, sedentary cars of locomotive draft, and also motor cars (diesel - trains, electric trains).

Depending on the speed of movement and stops in settlements regional and interregional lines are subdivided into business class and economy class.

The cars intended for transportation of passengers in trains with enumerated places depending on the number of places in them and conditions of journey are subdivided into the following types (classes):

sedentary - without compartment with places for sitting with chairs and the central pass (3rd class);

general - with open compartments with places for sitting (3rd class);

reserved seat - with open compartments with places for lying (3rd class);

compartment - with the closed triple or four-seater compartments with places for lying (the 2nd class);

sleeping (SV) - with the closed double compartments with places for lying (1 class).

In trains of the interregional and regional lines of business class created from motor cars (diesel train and electric trains) with places for sitting, cars are subdivided depending on the number of places and their arrangement, availability of the internal equipment in the car into cars 1, of 2 and 3 class. Reference of cars to certain class is performed by the Belarusian railroad.

Trains of regional lines of economy class ply with route speed at least 30 km/h and have stops according to the schedule of movement approved by the Belarusian railroad.

Trains of regional lines of business class ply with route speed at least 50 km/h and have stops on route at the railway stations and stopping points located in settlements with the number of inhabitants more than 5 thousand people in the district centers or at distance not further of 15 km from them, in the cities of regional subordination, the regional centers and the city of Minsk.

Trains of interregional lines of economy class ply with route speed at least 50 km/h and have stops on route at the railway stations and stopping points located in settlements with the number of inhabitants more than 10 thousand people in the district centers or at distance not further of 15 km from them, in the cities of regional subordination, the regional centers and the city of Minsk. Stops in places of adjunction of several railway directions are allowed.

Trains of interregional lines of business class ply with route speed at least 80 km/h and have stops on route at the railway stations and stopping points located in the cities of regional subordination, the regional centers and the city of Minsk.

Due to the increase (reducing) in steady passenger traffic according to the solution of the Belarusian railroad the quantity of stops of the trains going in separate types of messages can be changed.

The train schedule of interregional, regional and city lines, route of their following, and also their numbering are established by the Belarusian railroad.

5. Terms which are used in these rules have the following values:

the subscription ticket – the travel document (ticket) for reusable journey of the passenger in in trains of city lines and regional lines of economy class during the established period of time;

ACS "Express" - interstate automated control system for passenger traffic;

baggage – things, other material values which are handed over by the passenger for the established payment for delivery by railway transport public in destination;

luggage cash desk – specially equipped room for registration of luggage transport and cargo baggage;

ticket office – specially equipped room for registration of journey of passengers and return of payments for unused travel documents (tickets);

the station – complex of special buildings in which ticket and luggage offices, rooms for receiving and delivery of baggage, left-luggage office, the reference bureaus and other rooms intended for servicing of passengers, rendering to them paid and free services and accommodation of personnel are placed. Landing platforms, pedestrian tunnels, transitions through railway tracks, luggage rooms, part of the station square, adjacent to buildings, are part of station complex. Depending on amounts of work on departure of passengers stations happen out-of-class, 1, 2 and 3 class;

the auxiliary document ACS "Express" – the document issued to the passenger in case of return of the travel document (ticket) to them;

cargo baggage – loads (objects, things, etc.) which are handed over by physical persons or legal entities for the established payment without presentation of the travel document (ticket) for delivery in destination and transported in luggage cars;

the railway station – the division of rail transport performing technological transactions with trains and other vehicles (acceptance and departure, shunting work, etc.) and also transactions on receiving and delivery of loads and baggage and servicing of passengers;

the railway junction – the stations created in areas of large industrial centers, connected among themselves by connecting lines which represent single technological complex on servicing of freight and passenger traffic;

left-luggage office – specially equipped room for short-term storage of hand luggage;

the controlling person – the representative of the Belarusian railroad authorized on control of observance by passengers, senders of baggage, cargo baggage and employees of the organizations of the Belarusian railroad of these rules, other regulatory legal acts;

the passenger – any physical person, except for members of crew of train having the travel document (ticket) and making trip on the vehicle;

variable cliche – the permanent regulation of places allocated for junction relay station in the presence of steady passenger traffic;

crew of train – the employees of the organizations of rail transport performing servicing of passengers in trains in travel time of the train (the chief of the train, the car conductor, the train electrician, the worker of dining-car, the acceptance inspector of baggage and cargo baggage);

all-in cost of journey - the carriage charge including the fare (cost of the ticket and cost of reserved seat), rates for the services rendered in case of sale of the travel document (ticket), other payments established according to the legislation of the Republic of Belarus;

the travel document (ticket) – the carriage document of the established sample certifying the conclusion of the transportation agreement of the passenger railway transport public;

reservation of travel documents (tickets) (booking) – the automated engineering procedure of order placement of passengers on provision of places in trains and execution of travel documents (tickets) by means of electronic systems;

the cost of the ticket – part of the carriage charge in trains with enumerated places which compensates expenses on movement of the car;

reserved seat cost – part of the carriage charge in trains with enumerated places which compensates expenses on preparation in flight, content and servicing of the car;

the authorized person – representatives of the organizations of the Belarusian railroad: chief of the station, deputy chief of the station, assistant to the chief of the station, administrator, ticket senior clerk, ticket clerk, conductor of the train;

electronic registration - the consent of the passenger to implementation of trip in the train based on the transportation agreement supported by the electronic travel document paid by means of the informational and functional resource on the Internet interacting with special computer system (further - Internet resource), without execution of the travel document (ticket) on the form of the strict reporting;

the electronic travel document - the electronic document confirming the conclusion of the transportation agreement of the passenger in which information on transportation of the passenger is provided in electronic and digital form and is stored in the electronic database with use of intersystem interaction.

Chapter 2. General terms of transportation and registration of journey

6. Passengers are transported between all railway stations (further - stations) and the stopping points open for accomplishment of transactions on transportations of passengers, baggage, cargo baggage.

The procedure for provision of services in corporate trains and in trains of the increased comfort is established by the Belarusian railroad.
