About approval of the Regulations on provision of the conclusion of Minprompolitiki that the imported goods are not made in Ukraine

According to the Item "about" of article 19 of the Law of Ukraine "About the Common customs tariff", the resolution of the Cabinet of Ministers of Ukraine of 28.09.98 N 1540 "About the State register of publishers, manufacturers and distributors of publishing products" and Item 12 of appendix 1 to the Procedure for provision of the documents confirming the right of subjects of business activity to use of the tax benefits established by the legislation during customs clearance of goods which are imported on customs area of Ukraine or are exported from customs area of Ukraine, N 514, approved by the order of the State Customs Service of Ukraine of 22.06.2006 registered in the Ministry of Justice of Ukraine 07.07.2006 for N 816/12690, I ORDER:

1. Approve Regulations on provision of the conclusion of Minprompolitiki that the imported goods are not made in Ukraine which is applied.

2. To the head of department of organizational and information and analytical support of work the Minister Yumasheva P. V. to post this order on the website of the Ministry.

3. To department of general mechanical engineering (Kozyrev V. O.), to Development department of the chemical industry (Meshkov V. V.) to accept in accomplishment of the requirement of the Provision;

4. (Kozyrev V. O.) to submit to department of general mechanical engineering the specified order on registration to the Ministry of Justice of Ukraine.

5. To impose control of execution of this order on the deputy minister of Padalko V. G.

Regulations on provision of the conclusion of Minprompolitiki that the imported goods are not made in Ukraine

1. This Provision is developed according to the Item "about" of article 19 of the Law of Ukraine "About the Common customs tariff", of 28.09.98 N 1540 "About the State register of publishers, manufacturers and distributors of publishing products" and Item 12 of appendix 1 to the Procedure for provision of the documents confirming the right of subjects of business activity to use of the tax benefits established by the legislation during customs clearance of goods which are imported on customs area of Ukraine or are exported by the resolution of the Cabinet of Ministers of Ukraine from customs area of Ukraine, approved by the order of the State Customs Service of Ukraine of 22.06.2006 of N 514, registered in the Ministry of Justice of Ukraine 07.07.2006 for N 816/2690.

2. This Provision determines procedure for receipt of housekeeping by subjects (further - the applicant) Minprompolitiki's conclusions that the imported goods are not made in Ukraine (daleezaklyucheniye). The conclusion is issued on the imported goods which are imported on customs area of Ukraine for use in publishing activities and activities for production of book products which is made in Ukraine.

3. The conclusion is provided based on inventories which are made by the companies and the organizations of Ukraine, taking into account the conclusion of Chamber of Commerce and Industry of Ukraine or its regional departments concerning production in Ukraine of goods, similar subjects which are imported.

4. For receipt of the conclusion the applicant addresses with the letter in Minprompolitiki in whom are specified:

4.1 purpose and basis of receipt of the conclusion;

4.2 the name and the location of regional customs (customs) which the conclusion moves;

4.3 full name of the imported goods, its brand or model according to documentation of the supplier;

4.4 name of the producer and supplying country;

4.5 commodity code according to UKT foreign trade activities.

5. Enclose to the letter:

5.1 the copy of the contract for the imported goods which are imported on customs area of Ukraine;

5.2 copy of the certificate on entering of the subject of publishing into the State register of publishers, manufacturers and distributors of publishing products;

5.3 the copy of the conclusion of Chamber of Commerce and Industry of Ukraine, or its regional departments concerning production in Ukraine the specified goods.

6. In case of need receipts of the conclusion on spare parts, components, the special equipment and consumable materials, the name of the printing equipment for which they are intended surely is specified.

7. For more total characteristic of goods of Minprompolitiki in addition to information submitted the applicant can request: descriptions, technical characteristics, drawings, recommendations of the producer to the imported goods.

8. The letter is drawn up on the form of the subject of housekeeping with indication of the applicant's details (reference number and date, identification code on EGRPOU, the location, phone), signed by the head (deputy) of the applicant, and sealed.

9. Minprompolitiki in 20-day time from receipt date of the letter and documents, necessary for provision of the conclusion, considers the letter and provides the conclusion to the applicant.

10. If the goods specified in the letter are not made in Ukraine, Minprompolitiki by results of consideration of the letter issues to the applicant the conclusion in which are specified:

10.1 outgoing details of the letter of the applicant;

10.2 full name of the imported goods, brand or model;

10.3 the country of the producer and commodity code according to UKT foreign trade activities;

10.4 information that the imported goods in Ukraine are not made.

11. If the goods are made in Ukraine, Minprompolitiki sends the applicant the letter with information that the imported goods are made in Ukraine, at the same time the name of similar domestic goods, the location and phones of his producer are specified.

12. The conclusion prepares the relevant structural division of Minprompolitiki, is drawn up on Minprompolitiki's form, signed by the deputy minister and is registered structural division as which registration of the entering and outgoing correspondence of Minprompolitiki enters.

13. Minprompolitiki sends to the State Customs Service of Ukraine the card certified of the procedure established by the legislation with specimen signatures of the officials authorized on signing of the conclusion.

14. In case of change of the list of persons which are granted right to sign of the conclusion Minprompolitiki sends to the State Customs Service of Ukraine the new card certified of the procedure established by the legislation with specimen signatures of the officials authorized on signing of the conclusion.
