About approval of the National registry of sources of the ionizing radiation and physical persons and legal entities having permissions
The preamble is excluded according to the Order of the Government of the Republic of Moldova of 24.01.2014 No. 54
The government DECIDES:
1. Create the National registry of sources of the ionizing radiation and physical persons and legal entities having permissions.
2. Approve Regulations on the National registry of sources of the ionizing radiation and physical persons and legal entities having permissions it (is applied).
3. Maintaining the National registry of sources of ionizing radiation of the physical persons and legal entities having permissions performs National agency on regulation of nuclear and radiological activities.
4. To the bodies of public management, physical persons and legal entities having permissions to provide accomplishment of provisions of this resolution and to organize inventory count of sources of ionizing radiation with representation of the relevant information to National agency on regulation of nuclear and radiological activities in 45-day time from the effective date of this resolution and further annually, till December 31.
5. Provide to Customs Service monthly representation, to the 5th, to National agency on regulation of nuclear and radiological activities by e-mail with the digital signature of information on import/export of sources of ionizing radiation and nuclear materials with indication of the name of source and its goods item according to appendix No. 10 to the Regulations on approval of the National registry of sources of the ionizing radiation and physical persons and legal entities having permissions and also to provide on-line access to the Single customs information system for verification of the relevant data.
6. To impose control over the implementation of provisions of this resolution on the Ministry of the environment.

1. The regulations on the National registry of sources of the ionizing radiation and physical persons and legal entities having permissions (further - the Provision) are developed according to the Law on registers No. 71-XVI of March 22, 2007 (The official monitor of the Republic of Moldova, 2007, Art. No. 70-73, 314) and other existing regulations.
2. The provision establishes procedure for creation and maintaining by the National agency on regulation of nuclear and radiological activities (further - NARYaRD) the National registry of sources of the ionizing radiation and physical persons and legal entities having permissions (further - the Register), and is obligatory for execution by all physical persons and legal entities having permissions which perform activities with sources of ionizing radiation (further - III) with nuclear materials (further - HOLES) and/or radioactive waste (further - Russian joint stock company), irrespective of pattern of ownership and departmental subordination.
3. The register is Single national system of accounting and control III HOLES and Russian Joint Stock Company, with creation and management of NARYaRD of databases for III, HOLES, Russian joint stock company and nuclear/radiological objects and is created for the purpose of state registration, control of placement and movement, carrying out quantitative and qualitative analysis, planning of their accumulating and servicing, the prevention of radiation accidents and their illegal use.
4. For the purpose of ensuring reliable filling and updating of the Register the physical persons and legal entities having permissions shall record III, HOLES and Russian joint stock company, and also to carry out their annual inventory.
5. The Register joins data of the physical persons and legal entities having permissions which own III of HOLES and Russian joint stock company on the property rights, uses or other legal basis on their import and export, the locations, quantity, types and activity (except for those which are used in the military purposes).
6. The register is kept electronically. Additional maintaining the Register on paper basis is option.
7. The information access of the Register is allowed according to provisions of the current legislation. The procedure for use of information containing in the Register affirms NARYaRD.
8. NARYaRD includes information on III, HOLES, Russian joint stock company in the Register according to the appendices No. 1-10 to this Provision filled and provided on paper basis or electronically by the physical persons and legal entities having permissions in case:
1) import;
2) export;
3) acquisitions;
4) production;
5) changes of the owner;
6) transfers;
7) changes of the location;
8) transfers of III on maintenance;
9) carrying out annual inventory;
10) references of III and HOLES to category of radioactive waste;
11) implementation of other activities provided by the current legislation.
9. NARYaRD performs the following functions:
1) providing material and technical resources necessary for creation and maintaining Register;
2) development of departmental regulating documents which establish procedure for filling and use of the Register;
3) reference of III to categories according to appendix No. 8, HOLES and the fulfilled III according to the developed and approved criteria;
4) preparation of the national report on maintaining the National registry according to the Code of behavior on safety and safety of radioactive sources of International Atomic Energy Agency (IAEA) and its submission to IAEA on demand;
5) development of requirements imposed to accounting and control III, HOLES and Russian joint stock company by the physical persons and legal entities having permissions;
6) informing and cooperation with the central public bodies, physical persons and legal entities concerning terms and procedure for accomplishment of inventory count of III, HOLES and Russian joint stock company;
7) participation, if necessary, in work of the commissions on inventory count of the physical persons and legal entities having permissions;
8) requesting from the physical persons and legal entities having permissions, the additional information necessary for filling of the Register according to provisions of regulations;
9) data analysis of the Register for the purpose of development and submission of the national report on management of Russian joint stock company;
10) the state control and supervision of procedure of accounting and inventory count of III, HOLES and Russian joint stock company by the physical persons and legal entities having permissions;
11) provision by applicants of information from the Register according to the current legislation;
12) establishment of levels of release of III from the state control and state supervision;
13) periodic development and submission of the national report about HOLES;
14) submission by authorized state bodies of information on quantity and movement of III and HOLES over the country, and also data on their import and export in strict accordance with the current legislation;
15) informing authorized bodies in case of loss of control over III or HOLES;
16) international cooperation in the field of accounting of III, HOLES and Russian joint stock company according to the current legislation and international treaties which party the Republic of Moldova is;
17) ensuring physical safety and safety of data of the Register;
18) assignment of registration numbers NARYaRD for III, HOLES and Russian joint stock company on the basis of the registration sheets completed and provided electronically or on paper basis by the physical persons and legal entities having permissions according to requirements of appendices No. 1-10;
19) ensuring obtaining online of information directed by the physical persons and legal entities having permissions.
10. Physical persons and legal entities carry out the following obligations:
1) conducting strict accounting of III, HOLES, Russian joint stock company, the associated equipment managed in any form;
2) annual inventory of III, HOLES, Russian joint stock company at the scheduled time;
3) representation annually, till December 31, to the National agency of reliable data about availability, placement, quantity, movement, export, import, write-off, temporary or final storage of III and HOLES, Russian joint stock company;
4) representation within three working days to NARYaRD of data on any changes in the status of III, HOLES, Russian joint stock company, including location, transfer, sale, loan, the cassation, import/export, and also about transfer of Russian joint stock company on temporary or permanent storage;
5) provision of the additional information at the request of NARYaRD relating to structure of the Register;
6) obligatory informing NARYaRD and law enforcement agencies within 24 hours from the moment of detection of loss of control over III, HOLES, Russian joint stock company. NARYaRD shall be informed also on transfer/acceptance unsuitable for use of III, HOLES, Russian joint stock company, with their detailed characteristic according to appendix No. 2;
7) in case of submission of information to the National agency in writing or online it is certified by the signature, including, if necessary, digital, and protected depending on the level of its confidentiality.
11. Accounting and control III, HOLES and Russian joint stock company are performed by the legal entities and physical persons having permissions:
1) with use of information technologies for collection, processing, transfer and protection against unauthorized information access, exchange of information with other information systems on the basis of the existing national legal system;
2) on the basis of data of primary accounting at production phases, operation, processings, write-offs, movement and temporary or permanent storage, including upon transition of customs border;
3) quantitatively, on amount, activity, radionuclide structure, physical condition, the location, temporary or permanent storage;
4) from initial phase of production before transfer on temporary or permanent storage.
12. Accounting of III, HOLES and Russian joint stock company covers:
1) the opened and closed radioactive sources which quantity and activity exceed the established exception level;
2) nuclear materials which amount and activity exceed the established exception level;
3) radioactive waste;
4) generators of ionizing radiation and accelerators of particles.
13. The made III are registered in case of revenues to finished goods warehouse.
14. Radio pharmacological medicines, sets for immunological analyses, the radioisotopes used in medicine, radionuclides markers, radio isotope medicines and solutions on the basis of radionuclides from half-life period to 60 days including iodine-125 with total activity less than 10 GBq (1010 Bq), are registered only in the organizations users.
15. Inventory count is carried out in all territory of the Republic of Moldova by the physical persons and legal entities having permissions, III using in the activities, HOLES and Russian joint stock company (except for those which are in transit through the territory of the country).
16. Inventory counts, according to this Provision, are not subject:
1) III which are exempted from the state control and supervision;
2) the model (calibrating) and control sources included in set of radiometric devices for which capacity of ambient equivalent dose at m 0,1 distance from surface of III does not exceed 1,0 чЗв / hour;
3) the radioactive waste formed as a result of use of III in medical and scientific practice with specific activity which does not exceed exception levels.
17. The III metrological calibrating sets in case of assembly by the producer are registered in case of inventory count as one III.
18. The total quantity of the III metrological calibrating sets is noted in the inventory report in the established form.
19. For each III metrological calibrating set one registration form is filled in.
20. Inventory count of III, HOLES and Russian joint stock company is carried out annually by the commissions on inventory count approved by management of the relevant organization.
21. The commissions on inventory count person responsible for radiation safety in the relevant organization surely is included.
22. Commission on inventory count:
1) gets acquainted with this Provision;
2) checks data of entering - outgoing documents on III, HOLES and Russian joint stock company in the organization;
3) checks the documents confirming III, HOLES and Russian joint stock company;
4) is confirmed by availability of III, HOLES and Russian joint stock company at users or in warehouses of the organization;
Develops 5), fills and signs final documentation on inventory count of III, HOLES and Russian joint stock company;
6) officially transfers results of inventory count of NARYaRD till December 31 of the current year.
23. As a result of inventory count of III, HOLES and Russian joint stock company the following documents are filled in:
1) the act of result of inventory count of III, HOLES and Russian joint stock company according to appendix No. 9;
2) appendices No. 3-7 for each III, HOLES and Russian joint stock company which are inventory report component.
24. Information on III entered in Item 1 of the inventory report shall correspond to number of entries in the register of accounting.
25. Information on III entered in Item 2 of the inventory report shall correspond to number of the filled appendices.
26. Information on discrepancy of accounting data to real-life III is specified in Item 3 of the inventory report.
27. Cases of loss of control over III and HOLES are brought to the attention of police and NARYaRD within 24 hours from the moment of detection.
28. In case of identification of the unregistered III the commission on inventory count makes the decision on their accounting, fills the corresponding appendix and informs NARYaRD.
29. The acts of results of inventory count of III, HOLES and Russian joint stock company constituted in strict accordance with appendices to this Provision are signed by members of the commission on inventory count and affirm the head of the organization.
30. Results of inventory count of III, HOLES and Russian joint stock company are kept in the organization according to the current legislation, and one copy of the inventory report with the corresponding appendices is transferred to NARYaRD.
