For the purpose of enhancement of regulatory framework of rail transport in the conditions of development of market economy and according to article 2 of the Law of the Republic of Uzbekistan "About rail transport" the Cabinet of Ministers decides:

1. Approve the Charter of the railroad of the Republic of Uzbekistan according to appendix.

2. Enact the Charter of the railroad of the Republic of Uzbekistan since January 1, 2009.

3. To impose control of execution of this resolution on the Deputy prime minister of the Republic of Uzbekistan Hanov N. M.

Charter of the railroad of the Republic of Uzbekistan

Chapter I. General provisions

1. The charter of the railroad of the Republic of Uzbekistan determines the rights, obligations and responsibility of the railroad, legal entities and physical persons, and also the citizens using services of rail transport are regulated by procedure for forecasting and accomplishment of the forecast of amount of transportations, creation, the conclusions and agreement performances on transportations by railway transport, the main conditions of transportations of passengers, loads, baggage and mail, basic provisions on operation of railroad side tracks, and also relations of the railroad, its companies with consignors, consignees, passengers.

Operation of this Charter extends to transportations of passengers, loads, baggage and mail across the railroads public, including to transportation of goods which loading and unloading is made on railroad side tracks.

The charter is binding both for the railroad, and for senders and receivers of loads, passengers and other users services of rail transport.

2. According to the legislation and this Charter the Ministry of transport of the Republic of Uzbekistan approves Rules of transportation of goods on rail transport (further - Rules of transportation of goods) and the Specifications of loading and fixture of loads on rail transport (further - cargo loading Specifications) developed by the railroad.

Rules of transportations of passengers, baggage and cargo baggage on rail transport (further - Rules of transportations of passengers, baggage and cargo baggage) affirm the Cabinet of Ministers of the Republic of Uzbekistan.

3. In this Charter terms and the following concepts are applied:

the railroad (rail transport) - single production and technological complex with entering it the companies, organizations and the organizations of production and social appointment providing the needs for transportations. Control of railway transport is exercised on a centralized basis and is within the competence of authorized body of public administration by railway transport;

the organizations - the companies, the organizations, organizations of the ministries and departments of the Republic of Uzbekistan and other legal entities, irrespective of patterns of ownership;

the railway station - the division of rail transport public performing technological transactions with trains and other vehicles (acceptance and departure, shunting work, etc.) and also transactions on receiving and delivery of loads and baggage, servicing of passengers;

rail transport public - the rail transport which is carrying out the transport works and services based on obligation of their accomplishment according to the appeal of any physical person or legal entity;

divisions of the railroad - the companies transporting passengers, loads and baggage in certain regions of railway transportation network, and also performing other transport works and providing services to legal entities and physical persons;

hand luggage - easily transported objects and things, irrespective of sort and type of their packaging which by the sizes and weight (on the amount of three dimensions shall not exceed 180 cm and to weight, as a rule, of not over 36 kg) without difficulty are located in cars on the places provided for their placement;

baggage - the things, goods and other material values transferred by the passenger and which are with it along the line in the car;

cargo baggage - the object of rail hauling transported in passenger and post and luggage trains;

the load prohibited to transportation - load which transportation is not allowed on railway rolling stock according to the legislation of the Republic of Uzbekistan and Rules of transportation of goods;

places public - the covered warehouses, and also sites of way which are specially allocated for the territories of the railway station for accomplishment of transactions on loading, unloading, sorting, storage of loads and baggage belonging to the companies of the railroad;

places not of general use - the covered warehouses, platforms and other constructions which are specially allocated for the territories of the railway station and handed over by the companies of the railroad in temporary use to consignors, consignees for accomplishment of transactions on loading, unloading, storage of loads, and also the corresponding objects outside the territory of the railway station which are not belonging to the railroad, its companies;

carriage documents - documents which draw up transportation of goods, passengers, baggage, cargo baggage and railway vehicles (the superimposed, road sheet, forwarding delivery note, the forwarding sheet, the travel document (ticket), the luggage receipt, the cargo luggage receipt);

the transport rail waybill (superimposed) - the main carriage document of the established form. The delivery note is obligatory form of the transportation agreement of load which consists between the consignor and the company of the railroad for benefit of the third party - the consignee and accompanies load on all transit;

railroad side tracks - the railway tracks intended for transport servicing of one or several companies;

Rules of transportation of goods - the regulatory legal act approved according to this Charter and containing obligatory for the railroad, its companies, consignors, consignees, owners of sidings of condition of transportations taking into account their features for the purpose of safety of movement, safety of loads and railway railroad train, and also ecological safety;

Rules of transportations of passengers, baggage and cargo baggage the regulatory legal act approved according to this Charter and containing obligatory for the railroad, its companies, passengers, senders and receivers of baggage and cargo baggage of condition of transportations taking into account their features for the purpose of safety of movement, timeliness of transportations of passengers and delivery of baggage, cargo baggage, high-quality servicing of passengers at stations and in trains;

Tariff management - the systematized edition in which the rates for transportations by railway transport public of loads, passengers approved in accordance with the established procedure, baggage, cargo baggage, rates and obligatory payment for extra works and services, procedure for their calculation and application, and also lists of railway stations with the cargo and passenger operations which are carried out on them are published;

the commercial act - the act of the established form which is drawn up by the railroad according to Rules of transportation of goods and stating results of check of condition of load, its weight or the number of places in the car (container) and compliance to its carriage documents;

universal cars - the cars of the main types intended for transportation of loads, different in properties (closed cars, gondola cars and platforms);

specialized cars - the cars of different types having special design and intended for transportation of one or several groups of loads (tanks, hoppers, mineral wagons, bunker gondola cars, rail reefers, etc.);

special tanks - the tanks intended for transportation of certain types of cargo;

private cars - the rail cars which are not belonging to the railroad, but used for rail transportations under certain conditions;

container - the transport equipment of reuse providing safe transportation of goods with one or several modes of transport;

the universal container - is applied to transportation of tarnoshtuchny loads and subdivided on load-carrying capacity on medium-tonnage (3 - 5 ton) and large-capacity (10, 20, 30, 40-foot and more);

specialized containers - the containers belonging to consignors and consignees, differing from universal in appointment and design of separate parts and which are applied to the loads requiring special conditions of transportations;

transport-forwarding service - the type of transport service connected with the organization of process of departure and receipt of load, and also accomplishment of other works concerning cargo hauling according to the freight forwarding agreement;

the freight forwarder - the legal entity who is engaged in the organization of accomplishment of complex of works on transportation of goods by railway transport according to the contract for transport-forwarding servicing;

transportation devices - devices and devices of reuse intended for fixture and safety of load on all transit. Pallets, cartridges, hoisting slings, tourniquets, turnstile devices, thyroid barriers, tarpaulins, pyramids, multicurrent assets of fixture belong to transportation devices: bindings, couplers, brackets, racks, laying, etc.

4. The companies of rail transport, and also legal entities and physical persons - consignors, consignees shall observe in transit strictly loads economic interests of the state, provide full and rhythmical implementation of the forecast of amount of the transported loads as in general, and on each sort of load, rational use of railway vehicles, traffic safety of trains, safety of the car park of the railroad and safety of the transported loads.

5. Transportation of goods on rail lines under construction before delivery of these lines in continuous operation is made by rules, the approved railroad according to the legislation

6. Transportation of goods, passengers and baggage in the international railway service is made based on international agreements (agreements) of the Republic of Uzbekistan.

Chapter II. Cargo economy. devices for servicing of passengers

7. The railroad performs transportation of goods, passengers, baggage and mail between the railway stations open for production of the corresponding transactions. Railway stations make transactions on acceptance, loading, unloading and issue of loads car and small sendings, in containers, and also the transactions connected with transportations of passengers, baggage and cargo baggage. Railway stations can open for production of all or some transactions depending on the hardware. In commodity offices and in cash desks the basic rules of receiving and delivery of loads, baggage and cargo baggage, and also sale of travel documents (tickets) shall be hung out. If necessary at railway stations reference bureaus will be organized.
