About additional measures for traffic safety

For the purpose of realization of single state policy in the field of traffic safety and until adoption of the relevant Federal Laws I decide:

1. To federal executive bodies within the competence to take measures for establishment of single system of rules, standards and technical regulations in the field of traffic safety, and also to develop additional actions for the purpose of strengthening of the state supervision and control in this area.

2. Rename the State automobile inspection of the Ministry of Internal Affairs of the Russian Federation into State Inspection for Road Traffic Safety of the Ministry of Internal Affairs of the Russian Federation (State traffic inspectorate).

3. Approve the enclosed Regulations on State Inspection for Road Traffic Safety of the Ministry of Internal Affairs of the Russian Federation.

4. Determine that the State Inspection for Road Traffic Safety of the Ministry of Internal Affairs of the Russian Federation is legal successor of the State automobile inspection of the Ministry of Internal Affairs of the Russian Federation.

5. Consider the staff of the State automobile inspectorate of the Ministry of Internal Affairs of the Russian Federation serving (working) in State Inspection for Road Traffic Safety of the Ministry of Internal Affairs of the Russian Federation in posts since July 3, 1998 without their recertification and reassignment, and also without holding organizational and regular actions.

6. To the government of the Russian Federation:

bring the regulatory legal acts into accord with this Decree;

submit in accordance with the established procedure within 2-month term offers on modification and amendments in regulatory legal acts of the President of the Russian Federation in connection with the publication of this Decree;

prepare and introduce till September 1, 1998 in the State Duma of Federal Assembly of the Russian Federation drafts of the relevant Federal Laws.

7. Recommend to executive bodies of subjects of the Russian Federation to take additional measures for safety of traffic according to this Decree.

Regulations on the State traffic inspectorate of traffic safety of the Ministry of Internal Affairs of the Russian Federation

1. The State Inspection for Road Traffic Safety of the Ministry of Internal Affairs of the Russian Federation (State traffic inspectorate) performs powers in the field of traffic safety. The state traffic inspectorate is a part of the system of the Ministry of Internal Affairs of the Russian Federation.

2. The state traffic inspectorate provides observance by legal entities irrespective of pattern of ownership and other organizations, officials and citizens of the Russian Federation, foreign citizens, stateless persons (further hereinafter are referred to as - citizens) legislations of the Russian Federation, other regulatory legal acts, rules, standards and technical regulations (regulatory legal acts hereinafter are referred to as further) concerning traffic safety, holding actions for the prevention of the road accidents and to decrease in weight of their effects for the purpose of protection of life, health and property of citizens, protection of their rights and legitimate interests, and also interests of society and the state.

Decisions, requirements and instructions of officials of the State traffic inspectorate for the questions which are within their competence are obligatory for legal entities irrespective of pattern of ownership and other organizations, officials and citizens.

Activities of the State traffic inspectorate are based on the principles of legality, humanity, respect of rights and freedoms of man and citizen, publicity.

3. The state traffic inspectorate in the activities is guided by the Constitution of the Russian Federation, the Federal constitutional Laws, the Federal Law "About Police" , the Russian Federation Code of Administrative Offences, the Federal Law "About Traffic Safety", other Federal Laws, decrees and orders of the President of the Russian Federation, resolutions and orders of the Government of the Russian Federation, regulatory legal acts of the Ministry of Internal Affairs of the Russian Federation, the laws and other regulatory legal acts of subjects of the Russian Federation, and also this Provision.

4. The state traffic inspectorate performs the activities in interaction with federal executive bodies, executive bodies of subjects of the Russian Federation, local government bodies of municipalities, other divisions of law-enforcement bodies of the Russian Federation, the organizations, mass media, and also cooperates in accordance with the established procedure with competent authorities of foreign states.

5. State traffic inspectorates log in:

a) Head department on safety of traffic of the Ministry of Internal Affairs of the Russian Federation (further - division of the State traffic inspectorate at the federal level);

b) The center of special purpose in the field of safety of traffic of the Ministry of Internal Affairs of the Russian Federation;

c) divisions of the State traffic inspectorate of territorial authorities of the Ministry of Internal Affairs of the Russian Federation on subjects of the Russian Federation (further - divisions of the State traffic inspectorate at the regional level);

d) specialized divisions of the State traffic inspectorate of territorial authorities of the Ministry of Internal Affairs of the Russian Federation on subjects of the Russian Federation;

e) divisions of the State traffic inspectorate of managements, departments, departments of the Ministry of Internal Affairs of the Russian Federation on areas, the cities and other municipalities, including on several municipalities, by the closed administrative-territorial educations, and also division of the State traffic inspectorate of Regional Office of the Ministry of Internal Affairs of the Russian Federation on the Baikonur complex (further - divisions of the State traffic inspectorate at the district level);

e) research establishments of the State traffic inspectorate and their branches;

g) other divisions of the State traffic inspectorate created by the Minister of Internal Affairs of the Russian Federation.

6. The division of the State traffic inspectorate at the federal level is governing body of the State traffic inspectorate.

The division of the State traffic inspectorate at the federal level in accordance with the established procedure participates in accomplishment of the functions of the state customer assigned to the Ministry of Internal Affairs of the Russian Federation including on production of forms of car driver licenses, the state registration signs on vehicles and other special products necessary for the admission of vehicles and their drivers to participation in traffic which list affirms the Government of the Russian Federation, and also on production of operating-technical means for the State traffic inspectorate which list is determined by the Ministry of Internal Affairs of the Russian Federation.

6.1. The chief state inspector of traffic safety of the Russian Federation has the right on the questions which are within its competence:

a) take part in development and realization of the main directions of state policy in the field of traffic safety, and also in coordination of activities of federal executive bodies and executive bodies of subjects of the Russian Federation in this area;

b) represent the Ministry of Internal Affairs of the Russian Federation in relations with the Government of the Russian Federation, federal executive bodies, public authorities of subjects of the Russian Federation;

c) correspond on behalf of the Ministry of Internal Affairs of the Russian Federation;

d) request and receive in accordance with the established procedure from federal bodies of the government, public authorities of subjects of the Russian Federation, local government bodies of municipalities, the organizations and officials of the data on observance of the legislation of the Russian Federation by them in the field of traffic safety;

e) bring in accordance with the legislation of the Russian Federation in federal bodies of the government, public authorities of subjects of the Russian Federation, local government bodies of municipalities and the organization of the instruction (the resolution, representation, the decision) about elimination of violations of the law of the Russian Federation in the field of traffic safety;

e) create in coordination with the interested state bodies and the organizations advisory and expert bodies (councils, the commissions, groups) on the questions concerning the prevention of the road accidents and decrease in weight of their effects;

g) represent in accordance with the legislation of the Russian Federation the interests of the Russian Federation in the international organizations and in relations with foreign states;

h) perform management of activities of the chief state inspectors of traffic safety for subjects of the Russian Federation.

7. Division managers of the State traffic inspectorate at the regional level are on position the chief state inspectors of traffic safety on subjects of the Russian Federation, and their deputies - deputy chief state inspectors of traffic safety for subjects of the Russian Federation.

The chief state inspectors of traffic safety on subjects of the Russian Federation perform on the questions which are within their competence, management of activities of the chief state inspectors of traffic safety for areas, the cities and other municipalities including on several municipalities, by the closed administrative-territorial educations, and also on the Baikonur complex.

Division managers of Gosavtoinspektion at the regional level, except for persons replacing positions of the highest commanding structure of law-enforcement bodies of the Russian Federation are appointed to position and dismissed by the Minister of Internal Affairs of the Russian Federation on the representation of the division manager Gosavtoinspektion at the federal level approved with the head of territorial authority of the Ministry of Internal Affairs of the Russian Federation on the subject of the Russian Federation.

Deputy managers of divisions of the State traffic inspectorate at the regional level are appointed to position and dismissed by heads of territorial authorities of the Ministry of Internal Affairs on subjects of the Russian Federation.

8. Division managers of the State traffic inspectorate at the district level are on position the chief state areas, cities and other municipalities inspectors of traffic safety, including on several municipalities, by the closed administrative-territorial educations, and also on the Baikonur complex, and their deputies - deputy chief state inspectors of traffic safety for areas, the cities and other municipalities, including for several municipalities, for the closed administrative-territorial educations, and also on the Baikonur complex.

Specified persons are appointed to position and dismissed by heads of territorial authorities of the Ministry of Internal Affairs on subjects of the Russian Federation on representations of heads of territorial authorities of the Ministry of Internal Affairs of the Russian Federation on areas, the cities and other municipalities, including on several municipalities, by the closed administrative-territorial educations, the chief of the department of the Ministry of Internal Affairs of the Russian Federation on the Baikonur complex approved with division managers of the State traffic inspectorate at the regional level.

8(2). Powers and subordination of the division managers of the State traffic inspectorate specified in the subitem "zh" of Item 5 of this provision are determined by the Minister of Internal Affairs of the Russian Federation.

9. Instructions and orders of higher chief state inspectors of traffic safety concerning safety of traffic are obligatory for execution by subordinate chief state inspectors of traffic safety.

11. The following obligations are assigned to the State traffic inspectorate:

a) control (supervision) in the field of traffic safety, the state control (supervision) of realization of subjects of the Russian Federation by executive bodies and local government bodies, their officials of the powers connected with safety of traffic and observance of requirements in the field of traffic safety;

b) holding examinations on the right of control of vehicles of the corresponding categories and subcategories, stipulated in Item 1 article 25 of the Federal law "About Traffic Safety", issue of car driver licenses; approval of programs of professional training of transport drivers of the corresponding categories and subcategories, issue of the conclusions about the compliance to the established requirements of educational material resources of the organizations performing educational activities and realizing the main programs of professional training of transport drivers of the corresponding categories and subcategories, and job seekers of licenses for implementation of educational activities for the specified programs according to the procedure determined by the Ministry of Internal Affairs of the Russian Federation;

c) registration and accounting of the automotor-vehicles and trail cars to them intended for movement on highways public, issue of registration documents and the state registration signs on the registered automotor-vehicles and trail cars to them, and also issue of passports of vehicles according to the procedure, determined by the Government of the Russian Federation;

d) participation according to the procedure, determined by the Government of the Russian Federation, in technical inspection of buses;

e) traffic regulation, including with use of technical means and the automated systems, providing the organization of movement of vehicles and pedestrians in venues of wrecking and mass actions;

e) participation in actions for protection of public order and to ensuring public safety;

g) the organization and carrying out according to the procedure, determined by the Ministry of Internal Affairs of the Russian Federation, work on search of the hijacked and stolen automotor-vehicles, and also automotor-vehicles of the participants of traffic who fled places of the road accidents;

h) implementation in accordance with the legislation of the Russian Federation productions on cases on administrative offenses;

i) implementation on site the road accident of urgent actions for rescuing of people, including taking measures to evacuation of people, rendering in accordance with the legislation of the Russian Federation first aid by the victim, and also assistance in transportation of the damaged vehicles and protection of the property which was left without supervision;

j) ceased to be valid according to the Presidential decree of the Russian Federation of 01.06.2013 No. 527

k) implementation according to the procedure, determined by the Government of the Russian Federation, state accounting of indicators of security status of traffic;

l) accounting of forms of car driver licenses, the state registration signs on vehicles and other special products necessary for the admission of vehicles and their drivers to participation in traffic;

m) studying of conditions of traffic, taking measures to enhancement of the organization of movement of vehicles and pedestrians, approval in accordance with the established procedure programs of preparation and retraining of security specialists of traffic;

o) implementation in accordance with the established procedure escorts of vehicles;

o) participation in work of town-planning and technical councils, and also in consideration of offers on establishment or change of interregional routes of regular transportations of passengers by road transport and urban land electric transportation;

p) explanation of the legislation of the Russian Federation on traffic safety with use of mass media, and also own editions, carrying out for this purpose reviews, tenders, competitions, assistance of the executive authority to relevant organs in the organization of training of citizens in rules of safe behavior at roads, in promotion of traffic regulations;

c) development of offers on increase in traffic safety, including together with the interested federal executive bodies, executive bodies of subjects of the Russian Federation, local government bodies of municipalities, legal entities and public associations;

r) identification of the reasons and conditions promoting making of the road accidents, road traffic offenses, other illegal actions attracting traffic safety hazard, taking measures to their elimination;

s) issue of permissions to legal entities and individual entrepreneurs to implementation of activities for production of forms of car driver licenses, the state registration signs on vehicles and other special products necessary for the admission of vehicles and their drivers to participation in traffic which list affirms the Government of the Russian Federation, and also on works on installation and servicing of the technical means of the organization of traffic, maintaining the register issued, suspended and the cancelled permissions;

t) issue in accordance with the established procedure permissions to installation on vehicles of devices for giving of special light and sound signals, conventional identification marks (signals);

x) creation, ensuring functioning and maintaining according to the procedure, determined by the Minister of Internal Affairs of the Russian Federation, information banks (bases) of data, and also provision of the data containing in them to federal executive bodies, executive bodies of subjects of the Russian Federation, local government bodies of municipalities, the organizations and citizens according to the procedure, established by the legislation of the Russian Federation;

v) participation in interaction with the relevant divisions of bodies of the state protection in ensuring safe and free journey of vehicles in which objects of the state protection follow;

w) implementation of reception of citizens, providing timely and in full considerations of their oral and written addresses with the subsequent notification of citizens on the made decisions in the time established by the legislation of the Russian Federation;

x) issue of certificates on compliance of vehicles with the changes made to their design to safety requirements, and also certificates on the admission of vehicles to transportation of dangerous goods.

12. The state traffic inspectorate for accomplishment of the obligations assigned to it has the right:

a) request and receive in accordance with the established procedure from executive bodies of subjects of the Russian Federation, local government bodies of municipalities, the organizations and officials of the data on observance of the legislation of the Russian Federation by them in the field of traffic safety;

b) ceased to be valid according to the Presidential decree of the Russian Federation of 11.02.2023 No. 83

c) participate in project development of legislative and other regulatory legal acts, technical regulations and documents on standardization in the field of traffic safety, to make in accordance with the established procedure offers on their enhancement;

d) order or resolve the relevant organizations installation and removal of technical means of the organization of traffic;

e) prohibit in case of non-compliance with requirements of regulatory legal acts in the field of traffic safety transportation of bulky, heavy or dangerous goods, and also public transport service along the established routes;

g) prohibit operation of automotor-vehicles and trail cars to them, tractors and other self-propelled machines in cases, stipulated by the legislation to the Russian Federation, before elimination of the reasons which formed the basis for such prohibition and also with defects and conditions which list affirms the Government of the Russian Federation, and operation of trolleybuses and trams - with the defects provided by the corresponding rules of technical operation; prohibit operation of vehicles which have the hidden, counterfeit, changed numbers of nodes and aggregates or the state registration signs and it is equal in case of discrepancy of marking of vehicles to the data specified in registration documents;

k) examine on alcohol intoxication, direct to medical examination on state of intoxication of managing directors of vehicles of persons who are suspected of making of administrative offense in the field of traffic and concerning whom good reasons to believe are had that they are in state of intoxication, and also to direct or deliver to medical examination on state of intoxication of persons who are suspected of crime execution against traffic safety and operation of transport, for objective consideration of the case according to the procedure, established by the legislation of the Russian Federation;

l) use in accordance with the established procedure special technical and vehicles for identification and fixing of road traffic offenses, control of technical condition of vehicles and roads, forced stop and detention of vehicles, decoding of indications of tachographs;

m) perform in the procedure established by the legislation of the Russian Federation administrative detention and personal inspection of the citizens who made administrative offense, survey of vehicles and loads with participation of the drivers or citizens accompanying loads to make examination of vehicles in case of suspicion that they are used in the illegal purposes;

o) cause in the State traffic inspectorate of citizens and officials on the cases and materials which are in production, to receive from them necessary explanations, references, documents (their copy);

o) constitute protocols on administrative offenses, impose administrative penalties to the legal entities, officials and citizens who made administrative offense within the competence, to apply other measures provided by the Russian Federation Code of Administrative Offences;

p) use for delivery in the medical organizations of the citizens needing delivery of health care in the emergency or urgent form, for transportation damaged in case of accidents of vehicles and also in others stipulated by the legislation cases of the Russian Federation vehicles of the companies, organizations, organizations, public associations and citizens, except the vehicles belonging to diplomatic, consular and other representations of foreign states, the international organizations and vehicles of special purpose;

c) use freely in the office purposes the means of communication belonging to legal entities and citizens;

t) participate in accordance with the established procedure in work of the international organizations for problems of traffic safety, develop and perform together with the interested organizations and organizations of action, providing accomplishment of the international obligations of the Russian Federation in this area;

x) perform in accordance with the legislation of the Russian Federation about administrative offenses detention of vehicles with the room them to specially allotted places before elimination of the reasons of detention;

Divisions of the State traffic inspectorate at the regional level in accordance with the legislation of the Russian Federation can be separate divisions of territorial authorities of the Ministry of Internal Affairs of the Russian Federation on subjects of the Russian Federation, be allocated with property, have accounts, and also seals, stamps and forms with the name.
