About approval of the National program of use of production wastes and consumption
The government of the Republic of Moldova DECIDES:
1. Approve the National program of use of production wastes and consumption it (is applied).
2. To the ministries, departments, bodies of local public authority and economic agents:
develop within one year industry and territorial programs of the order waste with inclusion of actions for reducing their amounts, to their maximum involvement in economic circulation as secondary raw materials or to removal without environmental risk;
take measures for ensuring accomplishment of the specified program in structural divisions;
provide in the relevant budgets necessary financial resources for implementation of the program;
represent once a half-year to the Ministry of the environment and improvement of the territory information on the received results.
3. To the ministry of the environment and improvement of the territory on the basis of the analysis and systematization of the materials and documents received from the central and local authorities of public management to provide annually summarized information to the Government.
4. To the Ministry of Economics and reforms to provide in the state order for the corresponding period scientific subject concerning use of waste in the country according to actions for program implementation.

N606 of June 28, 2000 is approved by the Order of the Government of the Republic of Moldova.
The national program of use of waste (in dalneyshemprogramm) is developed according to requirements of article 28 of the Law on production wastes and consumption of N1347-XIII of October 9, 1997. (Official monitor, 1998, N 16-17, Art. 101).
The principles of minimization of waste, their maximum inclusion in economic circulation (conversion, use) and ecologically reasonable placement are the basis for development of the Program.
Now in the country cumulatively about 29,4 of one million tons of production wastes and consumption, 6, million tons were formed of them, according to statistical data, during 1997 (the statistic report "Waste" is constituted since 1997). Nowadays the level of reuse of waste is very low - only 18%. Increase in level of use of some categories of waste will promote decrease in impact on the environment, economy of natural resources and rational use of land resources.
The majority of waste is exported on platforms for warehousing of waste. Waste of mining companies is warehoused in the territories adjoining mines, occupying the space in the amount of 31 hectares that leads to permanent pollution of water resources, degradation of soils, irrational use of land resources.
1. Legislative and regulatory base of waste management
The Republic of Moldova has the adequate legislation in the field of the order waste consisting of the following legal acts:
The law on environmental protection of N1515-XIII of June 16, 1993. (Official monitor, 1993, N 10, Art. 283);
The law on the secondary material resources N787-XIII of March 26, 1996. (Official monitor, 1996, N 31, Art. 319);
The law on the mode of harmful products and the substances N1236-XIII of July 3, 1997. (Official monitor, 1997, N 67-68, Art. 557);
The law on production wastes and consumption of N1347-XIII of October 9, 1997. (Official monitor, 1998, Art. N16-17, 101);
The law on payment for pollution of the environment of N1540-XIII of February 25, 1998. (Official monitor, 1998, N 54-55, Art. 378).
Subitems c), e), h), j) Articles 8, articles 9 and 18-23 of the Law on production wastes and consumption, the subitem b) Article 7 and article 72 of the Law on environmental protection, the subitem b) Item 1 of Article 8 and article 13 of the Law on the mode of harmful products and substances, article 9 of the Law on secondary material resources provide obligations of physical persons and legal entities in the field of the order waste, including procedure for their warehousing, accounting, sorting and packaging, and also transportation, storage, conversion and neutralization. Special attention is paid to the environmentally friendly production aiming:
decrease and prevention of accumulation of waste;
prevention of pollution;
ecological efficiency;
implementation of environmentally friendly technologies.
At the same time listed legal acts prescribe also punishment for non-compliance with ecological requirements.
Also measures of economic incentives which include are provided:
a) establishment of the preferential taxation of profit on collection and supply of secondary raw materials;
b) assignment from state and local budgets for implementation of actions for use and conversion of waste;
c) provision of tax benefits and soft credits to the physical persons and legal entities using waste as raw materials.
The regulatory base of the order waste is constituted by standards and technical rules. For the purpose of strict accounting of all waste from productive activity, collection and sorting depending on their nature economic agents and special services of municipal services apply the following standards:

Basic provisions" (announced by the national decision of Department on technical supervision, standardization and metrology of N462-ST of October 5, 1998 - it is applied since January 1, 1999).
