About approval of the Regulations on the Ministry of Defence of the Republic of Kazakhstan

According to the Presidential decree of the Republic of Kazakhstan of May 7, 2003 "About measures for further enhancement of structure of Armed Forces of the Republic of Kazakhstan" the Government of the Republic of Kazakhstan DECIDES: No. 1085

1. Approve the enclosed Regulations on the Ministry of Defence of the Republic of Kazakhstan.

2. Declare invalid the subitem 1) of Item 1 of the order of the Government of the Republic of Kazakhstan of March 9, 2000 No. 368 "Questions of the Ministry of Defence of the Republic of Kazakhstan" (SAPP of the Republic of Kazakhstan, 2000, No. 15, the Art. 142).

3. This resolution becomes effective from the date of its signing, except for subitems 38-1), 38-2), 38-3), 38-4), 38-5), 38-6), 38-7) and 38-8) of functions of central office of Item 16 of the Provision which become effective since April 11, 2019 according to the laws of the Republic of Kazakhstan of October 5, 2018 "About standardization" and "About modification and amendments in some legal acts of the Republic of Kazakhstan concerning ensuring unity of measurements and standardization".

Regulations on the Ministry of Defence of the Republic of Kazakhstan

1. General provisions

1. The Ministry of Defence of the Republic of Kazakhstan is the central executive body performing state policy in the field of defense, military-political and military-economic management of Armed Forces of the Republic of Kazakhstan and also authorized body in spheres of the state aircraft and territorial defense.

2. The Ministry of Defence of the Republic of Kazakhstan has in peace time department - the General Staff of Armed Forces of the Republic of Kazakhstan.

3. The Ministry of Defence of the Republic of Kazakhstan performs the activities according to the Constitution and the laws of the Republic of Kazakhstan, acts of the President and the Government of the Republic of Kazakhstan, other regulatory legal acts, and also this Provision.

4. The Ministry of Defence of the Republic of Kazakhstan is legal entity in form of business of public institution, has seals and stamps with the name in state language, forms of the established sample, and also according to the legislation of the Republic of Kazakhstan of the account in bodies of treasury.

5. The Ministry of Defence of the Republic of Kazakhstan enters the civil relations from own name.

6. The Ministry of Defence of the Republic of Kazakhstan has the right to act as the party of the civil relations on behalf of the state if it is authorized on it according to the legislation.

7. The Ministry of Defence of the Republic of Kazakhstan concerning the competence of the procedure established by the legislation makes the decisions which are drawn up by orders and directives of the Minister of Defence of the Republic of Kazakhstan and other acts, stipulated by the legislation the Republic of Kazakhstan.

8. The structure and limit of the number of staff of the Ministry of Defence of the Republic of Kazakhstan affirm according to the current legislation.

10. Full name of the Ministry - republican public institution "Ministry of Defence of the Republic of Kazakhstan".

11. This Provision is the constituent document of the Ministry of Defence of the Republic of Kazakhstan.

12. Financing of activities of the Ministry of Defence of the Republic of Kazakhstan is performed from the republican budget.

13. The Ministry of Defence of the Republic of Kazakhstan is forbidden to enter contractual relations with subjects of entrepreneurship regarding accomplishment of the obligations which are functions of the Ministry.

If the Ministry of Defence of the Republic of Kazakhstan by legal acts is granted the right to perform the activities which are bringing in incomes, then income gained from such activities go to the income of the government budget if other is not established by the legislation of the Republic of Kazakhstan.

2. Mission, main objectives, functions, rights and obligations of the Ministry

14. The mission of the Ministry of Defence of the Republic of Kazakhstan - ensuring defense capability and military safety of the Republic of Kazakhstan.

15. Tasks:

1) implementation of state policy in the field of defense, and also carrying out single military and technical policy in the state;

2) implementation of military-political and military-economic management of Armed Forces;

3) ensuring combat readiness and fighting capacity of Armed Forces for reflection of aggression, the armed protection of territorial integrity and sovereignty of the Republic of Kazakhstan, protection and defense of the state and military facilities, protection of airspace, and also accomplishment of tasks according to the international treaties ratified by the Republic of Kazakhstan.

16. Functions:

functions of central office:

1) performs state policy in the field of defense;

2) develops the Military doctrine, the concept of construction and development of Armed Forces, other troops and military forming, and also concepts concerning military safety and defense;

2-1) coordinates development and submits the plan of defense of the Republic of Kazakhstan and the directive of the Supreme Commander by Armed Forces of the Republic of Kazakhstan for approval;

3) develops structure of the Ministry of Defence of the Republic of Kazakhstan, structure and the number of staff of the General Staff of Armed Forces of the Republic of Kazakhstan and the republican public institutions which are under authority of the Ministry of Defence of the Republic of Kazakhstan and its department, states, sheets to states, records states and sheets to states of bodies of military management within approved as the President of the Republic of Kazakhstan and the Government of the Republic of Kazakhstan of limits of the number of staff of Armed Forces of the Republic of Kazakhstan, Ministry of Defence of the Republic of Kazakhstan and public institutions subordinated to Ministry of Defence of the Republic of Kazakhstan;

4) pursues single military and technical policy in the state;

5) will be organized by activities of bodies of military investigation of the Ministry of Defence of the Republic of Kazakhstan in the territory of the Republic of Kazakhstan and beyond its limits for the purpose of ensuring the military constituting national security of the state according to regulatory legal acts of the Republic of Kazakhstan;

6) is determined by operational purpose and tasks of types of Armed Forces, types of military forces and special troops, their application in interaction with other troops and military forming, and also armed forces of foreign states according to the international treaties ratified by the Republic of Kazakhstan;

6-1) will organize anti-terrorist protection of military units and organizations of the Ministry of Defence of the Republic of Kazakhstan, vulnerable in the terrorist relation;

7) performs management of defense researches, research, developmental and other works in the field of military safety and defense, will organize control of their quality;

7-1) will organize and coordinates scientific ensuring defense, including defense researches;

8) performs inspection of troops and control of expense of financial resources in Armed Forces;

Develops 9) and approves the regulatory legal acts regulating acceptance, the organization of teaching and educational process in departmental military educational institutions;

9-1) determines procedure for financing of defense researches;

10) exercises control of activities and quality of teaching and educational work of the departmental military schools and other organizations of education performing military preparation;

11) coordinates training of preinduction and draft youth for military service;

11-1) realizes the state youth policy;

11-2) takes measures for military patriotic education of youth;

11-3) performs interaction and cooperation with the youth organizations for defense and military service;

11-4) develops rules of preparation for peacekeeping transaction, and also will organize their execution;

11-5) develops and approves the plan of preparation for peacekeeping transaction;

11-6) participates in the organization of mobilization preparation of economy, state bodies and the organizations, irrespective of patterns of ownership;

11-7) determines procedure for execution of personal accounting and military papers, their issue, accounting, storage and destruction, and also will organize production of forms of personal accounting and military papers;

11-8) it is excluded

12) takes part in development and accomplishment of state programs of development of defense industry;

13) is performed by the international military and military-economic cooperation;

13-1) participates in implementation of military and technical cooperation;

14) participates in safety of air, water and land space when conducting anti-terrorist operation;

Supports 15) and provides defense capability of the state, permanent combat and mobilization readiness of Armed Forces performing within the competence foreign intelligence, counteraction to terrorism and extremism, and also interagency coordination of activities for ensuring military safety;

15-1) determines procedure for voluntary temporary conveyance of buildings, premises of table, bath-and-laundry plants and the republican public institutions of Armed Forces of the Republic of Kazakhstan which are in them military property in property hiring (lease) by heads to the physical persons and legal entities fulfilling contractual commitments on catering services and bath-and-laundry servicing;

16) exercises control of respecting the rule of law and law and order in Armed Forces and provides social and legal guarantees by the serviceman, to members of their families and civil personnel;

17) adopts within the competence regulatory legal acts concerning passing of military service, defense and Armed Forces of the Republic of Kazakhstan and controls their execution;

18) is provided by participation of Armed Forces of the Republic of Kazakhstan in protection and defense of Frontier of the Republic of Kazakhstan according to the procedure, established by the legislation of the Republic of Kazakhstan;

19) assists in training of the military personnel passing military service under the contract in educational institutions;

20) is approved by allocation and use of radio-frequency range in the ranges of joint use for radio-electronic means of civil appointment, and also provides implementation of regulation of use of radio-frequency range and the appropriate radio-electronic means for the purpose of ensuring needs of defense and safety of the state;

21) will organize public procurements for needs of Armed Forces of the Republic of Kazakhstan;

Will organize 22) and carries out the cryptographic work, protection of the state secrets and information security, designing, production, implementation, maintenance of cryptographic remedies of the data constituting the state secrets in Armed Forces of the Republic of Kazakhstan;

22-1) carries out monitoring of information space in the field of military safety and counteraction to sources of its threats within the competence;

23) participates in the organization of civil defense;

24) exercises state regulation, the state control and supervision of use of airspace and activities of the state aircraft;

30) exercises quality control and goods acceptance of military (products), the goods (products) of dual purpose (application), military works and military services delivered within the state defense order;

30-1) appropriates code names to military units of Armed Forces of the Republic of Kazakhstan and the organizations, governing bodies of civil defense of authorized body in the field of civil protection, to bodies of homeland security, military units of Service of the state protection of the Republic of Kazakhstan on representation of the head of authorized state body;

31) participates in the prevention of the emergency situations caused by provocative actions from other states for the purpose of imposing of armed conflict, violations of territorial integrity of the Republic of Kazakhstan;

32) will be organized by material logistics of Armed Forces of the Republic of Kazakhstan;

32-1) will organize military and historical and cultural work in Armed Forces of the Republic of Kazakhstan;

33) within the competence is controlled by activities of the central and local executive bodies concerning preparation and ensuring territorial defense;

33-1) develops and approves regulations on territorial troops, rules of providing and content of territorial authorities of territorial troops, regulatory legal acts concerning territorial defense, in interaction with local executive bodies performs management of territorial troops, determines procedure and terms of submission by the central and local executive bodies of information on questions of territorial defense;

33-2) performs training of Armed Forces, coordinates training of other troops and military forming, territorial troops, voyennoobuchenny reserve, except as specified, provided by the laws of the Republic of Kazakhstan for mobilization, warlike situation and wartime;

34) provides realization of single state personnel policy in Armed Forces of the Republic of Kazakhstan;

34-1) develops and approves the concept of personnel policy of Armed Forces of the Republic of Kazakhstan, performs placement of personnel and assignment of military ranks within the competence, submits for consideration to the President of the Republic of Kazakhstan offers to destination to positions and to assignment of military ranks according to the list of positions;

35) is transferred by military property within the Ministry of Defence and public institutions of Armed Forces of the Republic of Kazakhstan, and also provides in property employment (lease) not used defense objects;

35-1) recognizes military property of Armed Forces of the Republic of Kazakhstan not used;

35-2) approves together with authorized body in the field of defense industry and the state defense order collateral actions on destruction of the ammunition carried to idle property;

36) within the competence signs the international agreements of the Republic of Kazakhstan;

36-1) interacts with the central and local executive bodies concerning observance of international treaties in the field of arms control and watches accomplishment of these agreements by other State Parties;

38) realizes programs in the field of providing military medicine;

38-1) approves the list of the measurements relating to state regulation together with authorized body in the field of technical regulation and metrology;

38-3) performs preparation and introduction of offers on development, the modification, review and cancellation of national, interstate standards, national qualifiers of technical and economic information, recommendations about standardization in authorized body according to the procedure established by the legislation of the Republic of Kazakhstan;

38-4) performs development of national standards and national qualifiers of technical and economic information in coordination with authorized body in the field of standardization;

38-5) considers draft documents on standardization and the national plan of standardization;

38-6) performs preparation of offers on creation of technical committees on standardization;

38-7) participates in work of technical committees on standardization and national authority on standardization, International Organizations for Standardization;

38-8) participates in realization of single state policy in the field of ensuring unity of measurements;

38-9) will organize and carries out special examinations of republican public institutions of Armed Forces of the Republic of Kazakhstan and certification of commanders (chiefs) with participation of representatives of bodies of homeland security for receipt of the permissions to work connected with use of the data constituting the state secrets;

38-10) will organize and conducts special examinations and special researches in Armed Forces of the Republic of Kazakhstan;

38-11) provides protection of the data transferred to the Ministry of Defence of the Republic of Kazakhstan by other state bodies and the organizations of the Republic of Kazakhstan constituting the state secrets;

38-12) books internal state audit and financial control within competence;

38-13) develops, approves, takes part in development, change and cancellation of military national standards of the Republic of Kazakhstan;

38-14) will organize projects implementation in the field of military space activities;

38-15) realizes together with authorized body in the field of space activities projects in the field of space activities double and military;

38-16) issues permissions to use of strips of frequencies, radio frequencies (radio-frequency channels) for radio-electronic means of bodies of defense, safety and protection of law and order;

38-17) develops and approves regulatory legal acts concerning metrological support of Armed Forces of the Republic of Kazakhstan;

38-18) develops and approves the subordinate regulatory legal acts determining procedure for rendering the state services;

38-19) carries out internal control behind quality of rendering the state services according to the legislation of the Republic of Kazakhstan;

38-20) develops rules of establishment of prohibited areas in case of arsenals, bases and warehouses of Armed Forces of the Republic of Kazakhstan, other troops and military forming and forbidden areas in case of arsenals, bases and warehouses of Armed Forces of the Republic of Kazakhstan, other troops and military forming;

38-21) approves flights of unmanned aerial vehicles over borderland;

38-22) will organize and holds events for counteraction to technical investigations in Armed Forces of the Republic of Kazakhstan;

38-23) develops rules of provision of the parcel of land in temporary free use under agreements of public-private partnership, including under the agreement of concession, for construction, reconstruction and operation of defense objects;

38-24) develops rules of alienation of defense objects under agreements of public-private partnership, including under the agreement of concession, for cost recovery to the private partner and the concessionary;

38-25) develops the list of alienable defense objects under agreements of public-private partnership, including under the agreement of concession;

39) performs other powers provided by the laws of the Republic of Kazakhstan, acts of the President of the Republic of Kazakhstan and the Government of the Republic of Kazakhstan.

Functions of department:

1) is performed by operational strategic planning, application and management of fighting and daily activities of Armed Forces, determines their fighting structure;

2) is developed by the plan of defense of the Republic of Kazakhstan and the directive of the Supreme Commander by Armed Forces of the Republic of Kazakhstan;

2-1) accepts normative legal orders on the questions entering competence of department with direct competence on their approval of orders of the Minister of Defence of the Republic of Kazakhstan, except for the regulatory legal acts affecting rights and freedoms of man and citizen;

3) performs planning, preparation and mobilization expansion of troops;

4) it is excluded

5) is developed with participation of state bodies by the plan of defense of the Republic of Kazakhstan, participates in development of the mobilization plan of Armed Forces of the Republic of Kazakhstan;

Will organize 6) and holds events for maintenance of combat and mobilization readiness of Armed Forces;

6-1) develops rules of determination of mobilization needs of Armed Forces of the Republic of Kazakhstan, other troops and military forming, special state bodies from economy industries;

6-2) develops rules of military transport obligation in the territory of the Republic of Kazakhstan for mobilization, warlike situation and in wartime;

7) provides protection and protection of airspace of the Republic of Kazakhstan;

8) will organize and performs interaction of Armed Forces with other troops and military forming in the field of the organization of defense;

9) develops rules of use of Armed Forces of the Republic of Kazakhstan, the rule of the operational equipment of the territory of the Republic of Kazakhstan and the rule of planning of defense of the Republic of Kazakhstan;

11) coordinates plan development of territorial defense, action of forces and means participating in accomplishment of tasks of territorial defense;

Will organize 12) and carries out completing of Armed Forces by the military personnel of conscription service, under the contract and acceptance of civil personnel;

13) takes part in plan development of operational application and interaction of Armed Forces, other troops and military forming with armed forces of foreign states according to the international treaties ratified by the Republic of Kazakhstan;

15) performs placement of personnel and assignment of military ranks, submitting for examination to the Minister of Defence of offers to destination to positions and to assignment of military ranks according to the nomenclature;

16) the routine and advance planning of providing Armed Forces with necessary types of arms, military equipment, ammunition and other appliances will organize, their operation, safety, accounting, write-off and utilization, and also planning of accumulating and placement in peace time of inventories of these means for mobilization expansion of troops;

16-1) will organize implementation in Armed Forces of military automated control systems;

16-2) based on the appeal of authorized body in the field of defense industry and the state defense order renders assistance in destruction of the ammunition carried to idle property;

17) develops offers on the directions of development of military science;

18) will organize work on moral and psychological and ideological providing troops for the purpose of forming at staff of high fighting and moral qualities;

19) holds events for providing ecological safety and environmental protection in connection with activities of troops;

20) is notified by authorized body in the field of emergency situations of natural and technogenic nature, and through local authorities of military management - regional, city managements on emergency situations on introduction of the corresponding degree of combat readiness, and also the announcement of mobilization;

Will organize 21) and carries out military charges in Armed Forces of the Republic of Kazakhstan;

22) interacts with authorized body in the field of emergency situations of natural and technogenic nature in case of the solution of tasks on protection of the population and the territories against effects of use of modern weapons of destruction, and also the prevention and mitigation of consequences of emergency situations of natural and technogenic nature;

23) will organize the encoded, coded, secret communication, protection of the state secrets, safety of information in Armed Forces;

24) exercises control in sphere of activity of the state aircraft;

25) exercises supervision of safety of flights of aircrafts in the state aircraft;

25-1) performs forming, collection, storage and use of documents of kartografo-geodetic fund of the Ministry of Defence of the Republic of Kazakhstan;

25-2) develops rules of safety of military service in Armed Forces of the Republic of Kazakhstan;

25-3) according to the procedure, established by the Government of the Republic of Kazakhstan, writes off military property which during conducting military operations came to unsuitable condition or was lost in case of threat of life of staff of Armed Forces of the Republic of Kazakhstan;

25-4) according to the procedure, established by the Government of the Republic of Kazakhstan, records the military property which is in their operational management;

25-5) develops rules of the organization of military transportations in Armed Forces of the Republic of Kazakhstan and the rule of registration and payment of military transportations in Armed Forces of the Republic of Kazakhstan;

26) their interaction with other troops and military forming according to the legislation of the Republic of Kazakhstan performs others of functions in the field of planning of application and management of Armed Forces.

17. Rights and obligations:

1) to adopt regulatory legal acts, obligatory for execution, within the competence;

2) to request and receive in the procedure established by the legislation from state bodies, the organizations, their officials necessary information and materials;

3) to receive and use the sponsor's, charitable help, and also help given within military and technical cooperation;

4) to perform other rights provided by the existing legal acts.

3. Organization of activities of state body

18. Management of the Ministry of Defence of the Republic of Kazakhstan is performed of the Minister of Defence of the Republic of Kazakhstan who bears the personal responsibility for accomplishment of the tasks assigned to the Ministry of Defence of the Republic of Kazakhstan and implementation of the functions by it.

19. The Minister of Defence of the Republic of Kazakhstan is appointed to position and dismissed by the President of the Republic of Kazakhstan.

20. The Minister of Defence of the Republic of Kazakhstan has deputies who are appointed to positions and are dismissed according to the legislation of the Republic of Kazakhstan.

21. Powers of the Minister of Defence of the Republic of Kazakhstan:

1) determines obligations and powers of the deputies, officials of the Ministry and its structural divisions, commanders-in-chief of types, commanders of types of military forces and troops of regional commands of Armed Forces;

2) establishes structure, the number of staff of types, types of military forces of Armed Forces, and also the number of staff of public institutions subordinated to the Ministry within the approved as the President and the Government of the Republic of Kazakhstan of limits of the number of staff of Armed Forces, the Ministries and public institutions subordinated to it;

3) determines structure of the Ministry and the number of staff of its divisions within the approved limit of the number of staff;

4) appoints to positions and dismisses employees of the Ministry;

5) is represented by the Ministry in all state and other organizations;

6) exercises control of alert of Armed Forces;

7) represents to the President of the Republic of Kazakhstan candidates for generals and officers according to the established nomenclature for substitution on positions in Armed Forces and to assignment of the highest military ranks;

8) issues orders and directives;

9) submits to the President of the Republic of Kazakhstan for approval offers on construction of Armed Forces, plans of their application, mobilization expansion and financial provision;

10) within the powers appoints to positions, resolves movement issues on service, assignments and deprivations of military ranks, and also dismissals of the military personnel from armed forces;

11) approves regulations on structural divisions of the Ministry and governing bodies of types, childbirth and troops of regional commands;

12) is approved by distribution of order amount, purchases of main types of arms, military equipment, capital investments and other material means, and also budgetary appropriations by types of Armed Forces, types of military forces, regional commands and dovolstvuyushchy structural divisions of the Ministry;

13) approves Rules of acceptance on arms of Armed Forces of other troops and military forming of the Republic of Kazakhstan of arms and military equipment;

13-1) approves Rules of removal from arms of Armed Forces, other troops and military forming of the Republic of Kazakhstan of arms and military equipment;

14) is approved by the inventory of arms and military equipment of Armed Forces, other troops and military forming;

15) approves rules of wearing military uniform of clothes and signs of distinction of Armed Forces of the Republic of Kazakhstan, other troops and military forming, and also other signs;

Represents 16) to rewarding with the state awards and assignment of honorary titles of the Republic of Kazakhstan, encourages military personnel and civil personnel of Armed Forces, and also imposes penalties;

17) will organize consideration of claims, petitions from citizens and protection of the rights, freedoms and legitimate interests of the military personnel and members of their families, pensioners, employees and workers of Armed Forces;

18) takes the measures directed to anti-corruption in the Ministry and bears the personal responsibility for acceptance of anti-corruption measures;

19) approves the Instruction for work of military representative offices of the Ministry of Defence of the Republic of Kazakhstan in the organizations, irrespective of patterns of ownership;

19-1) approves rules of military preparation in higher educational institutions and military faculties under the organizations of higher education;

Claims 19-2) in coordination with the central authorized body on budgetary planning of regulation of supply of Armed Forces;

19-3) approves rules about procedure for conducting military accounting of persons liable for call-up and recruits;

19-4) it is excluded

19-5) approves rules of the organization of activities and condition of service by the military personnel of the device of military attaches;

19-6) approves regulations on local authorities of military management;

19-7) approves rules of training of citizens for military service;

19-8) approves procedure for the organization and carrying out, and also forming of educational material resources of basic military training;

19-9) approves programs of general military education;

19-10) approves rules of conducting military-medical examination and regulations on bodies of military-medical examination;

19-11) approves the list of areas in which service grants the serviceman the right to provision of 10 days of leave in addition to annual main leave;

19-12) in coordination with the first heads of the relevant authorized state bodies and the central authorized body on budgetary planning approves the amount of compensation on mailings to the military personnel of conscription service, cadets of the first and second years of military educational institutions;

19-13) approves rules of state registration of motorized vehicles and trail cars to them Armed Forces of the Republic of Kazakhstan;

19-14) approves rules of carrying out obligatory technical inspection of the motorized vehicles and trail cars to them registered in bodies of military police of Armed Forces of the Republic of Kazakhstan;

19-15) approves rules of investigation of aviation incidents and incidents in the state aircraft of the Republic of Kazakhstan;

19-16) approves the description of the personified signs, breastplates and other military and heraldic signs, signs about the termination of military educational institutions, for cool specialists, prize medals (badges) for prize-winners of military and applied, office and applied, technical and other sporting events, and also procedure for their issue and carrying Armed Forces of the Republic of Kazakhstan by the military personnel;

19-17) approves rules of assignment to military units and the organizations of the valid and code names and their applications when conducting correspondence in Armed Forces of the Republic of Kazakhstan;
