Chapter 1. General provisions

Article 1. The main terms applied in this Law and their determinations

In this Law the following main terms and their determinations are applied:

the database – set of the structured and interconnected information organized by certain rules on material carriers;

databank – the organizational and technical system including one or several databases and management system them;

the owner of program technical means, information resources, information systems and information networks – the subject of information relations exercising rights of possession, uses and orders of program technical means, information resources, information systems and information networks in the limits and procedure determined by their owner according to the legislation;

the state information system – the information system created and (or) acquired at the expense of means republican or local budgets, state non-budgetary funds, and also means of the state legal entities;

the state information resource – the information resource created or acquired at the expense of means republican or local budgets, state non-budgetary funds, and also means of the state legal entities;

documentary information – information fixed on the material carrier with the details allowing to identify it;

information access – possibility of receipt of information and use of it;

access to information system and (or) information network – possibility of use of information system and (or) information network;

information security – complex of the legal, organizational and technical measures aimed at providing confidentiality, integrity, authenticity, availability and safety of information;

informatization – the organizational, social and economic and scientific and technical process providing conditions for forming and use of information resources and realization of information relations;

information – the information about persons, objects, facts, events, the phenomena and processes irrespective of form of their representation;

information network – set of information systems or complexes of the program technical means of information system interacting by means of networks of telecommunication;

information system – set of databanks, information technologies and complex (complexes) of program technical means;

information technology – set of processes, methods of implementation of search, obtaining, transfer, collection, processing, accumulating, storage, distribution and (or) provision of information, and also use of information and information security;

information service – activities for implementation of search, obtaining, transfer, collection, processing, accumulating, storage, distribution and (or) provision of information, and also information security;

the information relations – the relations arising by search, obtaining, transfer, collection, processing, accumulating, storage, distribution and (or) provision of information, use of information, information security, and also in case of use of information technologies;

the information intermediary – the subject of information relations providing information services to owners and (or) users of information;

information resource – the organized set of documentary information including databases, other sets of the interconnected information in information systems;

complex of program technical means – set of the program and technical means providing implementation of information relations with the help of information technologies;

confidentiality of information – the requirement not to allow distribution and (or) provision of information without the consent of its owner or other basis provided by legal acts;

the owner of information – the subject of information relations who acquired the rights of the owner of information on the bases established by acts of the legislation or under the agreement;

the operator of information system – the subject of information relations performing operation of information system and (or) rendering by means of it information services;

the user of information – the subject of information relations receiving, extending and (or) providing information, exercising the right to use of it;

the user of information system and (or) information network – the subject of information relations who got access to information system and (or) information network and using them;

provision of information – the actions directed to acquaintance with information of certain group of people;

distribution of information – the actions directed to acquaintance with information of the uncertain group of people;

the owner of program technical means, information resources, information systems and information networks – the subject of information relations exercising rights of possession, uses and orders of program technical means, information resources, information systems and information networks.

The term "personal data" is used in this Law in the value determined by the Law of the Republic of Belarus of May 7, 2021 No. 99-Z "About personal data protection".
