According to regulations of the Penitentiary code of Ukraine and for the purpose of timely distribution and the direction for serving sentence of persons condemned to imprisonment from pre-trial detention centers in organizations of execution of punishments and establishment of procedure for their transfer I ORDER:

1. Approve and enact applied:

The instruction about procedure for distribution, the direction and transfer for serving sentence of persons condemned to imprisonment (daleeinstruktion);

Regulations on the commission on questions of distribution, the direction and transfer for serving sentence of persons condemned to imprisonment (further - Regulations on the commission);

Regulations on the Appeal commission of State department of Ukraine concerning execution of punishments concerning distribution, the direction and transfer for serving sentence of persons condemned to imprisonment (further - Regulations on the Appeal commission).

2. To chiefs of territorial authorities of management of State department of Ukraine concerning execution of punishments (further - Department):

2.1. In week time to approve staff of the commissions on questions of distribution, the direction and transfer for serving sentence of persons condemned to imprisonment.

2.2. In two weeks based on Regulations on the commission to develop and approve relevant provisions about the commissions.

2.3. Organize studying of the Instruction with the corresponding categories of officials of territorial authorities of management, organizations of execution of punishments and pre-trial detention centers and in two weeks to accept at them offsettings.

2.4. Provide control of steady fulfillment of requirements of the Instruction.

3. To financial management (Komarov P. O.), to management of material logistics (Romanenko V. M.), management of personnel (Krevsun M. V). Department and information technically to the center under Department (V.M.'s Capon) to perform organizational actions rather financial, material and staffing of work of regional commissions.

4. Recognize invalid orders of Department of 30.08.2001 N 157 "About approval of the Instruction about procedure for distribution and the direction of persons condemned to imprisonment from pre-trial detention centers (prisons) in correctional institutions and Regulations on the commission on questions of distribution and the direction of persons condemned to imprisonment from pre-trial detention centers (prisons) in correctional institutions" (with changes and amendments), registered in the Ministry of Justice of Ukraine 20.09.2001 betweenN and of N 244 "About creation of the Appeal commission of State department of Ukraine concerning execution of punishments concerning distribution and the direction of persons condemned to imprisonment, from pre-trial detention centers (prisons) in correctional institutions and transfer of convicts from one organization in another", registered in the Ministry of Justice of Ukraine 10.01.2002 for N 13/6301.

5. To provide to management on control over the implementation of judgments of Department (O.G.'s Dvoynos) provision of this order in accordance with the established procedure for state registration in the Ministry of Justice of Ukraine.

6. To impose control of execution of this order on the First Deputy Chairman of Department of Ptashinsky O. B.

The instruction about procedure for distribution, the direction and transfer for serving sentence of persons condemned to imprisonment

1. General provisions

1.1. This Instruction is developed according to regulations of Criminal and Criminal and executive codes of Ukraine and regulates the questions concerning distribution, the direction and transfer for serving sentence of persons condemned to imprisonment for certain term and to lifelong imprisonment.

1.2. Distribution, the direction and transfer for serving sentence of persons condemned to imprisonment for certain term and to lifelong imprisonment is performed by the commissions on questions of distribution, the direction and transfer for serving sentence of persons condemned to imprisonment (further - Regional commissions) who are created in territorial authorities of management of State department of Ukraine concerning execution of punishments, and also the Appeal commission of State department of Ukraine concerning execution of punishments concerning distribution, the direction and transfer for serving sentence of persons condemned to imprisonment (further - the Appeal commission) which is created under State department of Ukraine concerning execution of punishments (further - Department).

Control of activities of Regional commissions is imposed on the First Deputy Chairman of Department.

Regional and Appeal the commissions are accountable and under control to the Chairman of Department.
