RESOLUTION OF COUNCIL OF MINISTERS OF THE REPUBLIC OF BELARUS

of November 26, 2008 No. 1801

About creation, state registration of mortgages and accounting of the rights on them

(as amended on 14-10-2025)

Based on parts of the second or fourth of Item 5 of article 16 of the Law of the Republic of Belarus of June 20, 2008 "About mortgage" the Council of Ministers of the Republic of Belarus DECIDES: No. 345-Z

1. Establish approximate form (form) of the documentary mortgage according to appendix.

2. Approve:

The instruction about procedure for creation of the documentary mortgage (is attached);

The instruction about procedure for creation and transfer of the paperless mortgage on centralized storage in Central Securities Depository in the Republic of Belarus, accounting of the rights according to such mortgage in depositary system (is attached).

2-1. Determine that:

2-1.1. state registration of mortgages is performed in the special register of mortgages which is component of the Single state register of real estate, the rights to it and transactions with it;

2-1.2. the following data are subject to entering into the special register of mortgages by registrars of the organizations for state registration of real estate, the rights to it and transactions with it:

about creation and transfer of the mortgage;

about partial execution of the obligation provided with mortgage;

about transition of the rights according to the mortgage and the new owner of the mortgage;

about pledge of the documentary mortgage or the termination of pledge of the documentary mortgage;

about cancellation of the mortgage;

about creation and transfer of the new documentary mortgage instead of damaged;

about error correction in the mortgage and (or) in marks in the mortgage;

about modification of the mortgage and (or) of marks in the mortgage;

about issue of the duplicate of the documentary mortgage;

2-1.3. the procedure for entering into the special register of mortgages by registrars of the organizations for state registration of real estate, the rights to it and transactions with it of the data specified in subitem 2-1.2 of this Item is determined by the State committee on property.

3. This resolution becomes effective since December 27, 2008, except for the paragraph of the third Item 2, becoming effective since June 27, 2009.
