General Technical regulation "About Safe Operation and Utilization of Machines and the Equipment"

Chapter 1. General provisions

Article 1. Purposes and scope of this Law

1. This Law (further - the Technical regulation) according to the Law of the Kyrgyz Republic "About bases of technical regulation in the Kyrgyz Republic", for the purpose of protection of life and health of citizens, property of physical persons or legal entities, the state-owned or municipal property, environmental protection, life or health of animals and plants against the dangerous and harmful factors arising in use and utilization of machines and the equipment, establishes:

objects of technical regulation, including methods (rules) of their identification;

the mandatory requirements ensuring safety of processes of operation and utilization of machines and the equipment except specified in part 3 of this Article;

forms of assessment of conformity of processes of operation and utilization of machines and equipment to requirements of this Technical regulation.

2. Action of this Technical regulation extends to the processes of operation and utilization of machines and the equipment performed within the territory of the Kyrgyz Republic in case of which there can be dangerous and/or harmful factors, including on explosion safety, mechanical and electric safety. The list of the specified processes is given in appendix to this Technical regulation.

3. This Technical regulation does not include the requirements established in other general technical regulations and providing in case of operation of machines and the equipment electromagnetic compatibility regarding safety of operation of devices and the equipment, biological, fire, thermal, chemical, nuclear and radiation safety, safety of radiations. This Technical regulation does not include the requirements of ecological safety established in other general technical regulations.

Objects of technical regulation of this Technical regulation are not also the processes of operation and utilization of machines and the equipment applied by households and processes of operation and utilization of household appliances.

4. The requirements for safe operation of machines and the equipment determined by this Technical regulation are obligatory for all persons and other participants of the legal relationship performing operation and utilization of machines and the equipment according to the enclosed list of processes.

Article 2. Objects of technical regulation and procedure for their identification

1. Objects of technical regulation of this Technical regulation (taking into account the requirements determined by part 2 Articles 1, and except for objects, specified regarding 3 Articles 1) are:

1) any processes of operation of machines and equipment;

2) any processes of utilization of machines and equipment.

2. Identification of processes of operation of machines and the equipment is carried out by means of comparison of the actions made with machines and the equipment and the actions provided in operational documentation. For the purposes of identification of processes of operation of machines and the equipment the operator, other interested person shall be convinced that with machines and the equipment one of the following actions is performed:

1) machines and the equipment are put into operation;

2) machines and the equipment are used for designated purpose;

3) maintenance and/or repairs of machines and the equipment is made (without their removal from operation);

4) machines and the equipment are taken out of service.

3. Identification of processes of utilization of machines and the equipment is carried out by means of comparison of the actions made with machines and the equipment and the actions provided in operational documentation. For the purposes of identification of processes of utilization of machines and the equipment the operator, other interested person shall be convinced that with machines and the equipment actions (transaction) as a result of which their further operation is impossible are performed.

Article 3. Basic concepts

For the purposes of application of this Technical regulation the following concepts are used:

accident of machines and the equipment (further - accident) - destruction or damage of machines and the equipment, the uncontrollable explosion and/or emission of dangerous substances which arose in use machines and the equipment;

blocking - the device providing impossibility of turning on of the machine or equipment in case of threat of origin supernumerary (including emergency) situations in case of operation of machines and the equipment, because of violation by personnel of the requirements ensuring safety or other origins supernumerary (including emergency) situations;

input of machines and the equipment in operation - the event fixing the beginning of use of machines and the equipment by the operator to destination;

explosion - the bystry exothermic chemical transformation of the explosive environment which is followed by allocation of energy and formation of the compressed gases;

explosion safety - condition of operation, utilization of machines and the equipment in case of which or the possibility of explosion is excluded or in case of its origin is prevented possibility of impact on personnel and other persons of the dangerous or harmful factors caused by it and safety of property of physical persons and legal entities is ensured;

the explosive environment - chemically active circle which is under such circumstances in case of which there can be explosion;

harmful factor - the factor of the circle, labor process which is characterized by negative impact which impact per capita under certain conditions can cause occupational disease, temporary or permanent decrease in working capacity increase the frequency of somatic and infectious diseases, lead to violation of health of posterity;

hygienic standard rates of working conditions (maximum allowable concentration, PDU) - levels of harmful factors which in case of normative employment duration, according to the Labor code of the Kyrgyz Republic, and also in the remote terms of life working and it the been born children shall not cause afterwards the diseases or variations in the state of health found by modern methods of researches. Observance of hygienic standard rates does not exclude violation of the state of health at persons with hypersensibility to the corresponding harmful factor (factors);

Maximum allowable concentration - threshold limit value;

PDU - maximum permissible level;

the protective barrier - the technical device for protection against inadmissible touch or penetration of the person, parts of body of the person, clothes and tools to dangerous parts of machines and the equipment (moving, current carrying and other parts), and also for protection of personnel against the harmful and dangerous factors arising or able to arise in case of operation of machines and the equipment;
