According to the Law of Ukraine "About state regulation of the security market in Ukraine", the Law of Ukraine "About mortgage bonds", Procedure and conditions of licensing for implementation of activities for management of the mortgage covering and its cancellation approved by the decision of State commission on securities and the stock market of October 9, 2007 N 2009 and the mortgage covering registered in the Ministry of Justice of Ukraine on November 19, 2007 for N 1285/14552, and for the purpose of streamlining of the mechanism of control of managers State commission on securities and the stock market SOLVED:

1. Approve Regulations on procedure for creation and provision of administrative data concerning activities by managers by mortgage covering it (is applied).

2. To provide to the chief of staff of State commission on securities and the stock market Yu. Nazarenko:

submission of this decision for implementation of examination on compliance of the Convention on human rights protection and fundamental freedoms in the Secretariat of the Government representative for cases of the European Court of Human Rights of the Ministry of Justice of Ukraine;

submission on state registration of this decision to the Ministry of Justice of Ukraine;

publication of this decision according to the legislation of Ukraine.

3. Control over the implementation of this decision to assign to the Chief of staff of State commission on securities and the stock market Yu. Nazarenko.

4. This decision becomes effective from 01.04.2009.

Regulations on procedure for creation and submission of administrative data concerning activities by managers mortgage covering

This Provision is developed according to the Law of Ukraine "About state regulation of the security market in Ukraine", the Law of Ukraine "About mortgage bonds", Procedure and conditions of licensing for implementation of activities for management of the mortgage covering and its cancellation approved by the decision of State commission on securities and the stock market of October 9, 2007 N 2009 and the Regulations on mortgage covering of regular mortgage bonds, procedure for maintaining the register of mortgage covering and management of the mortgage covering of regular mortgage bonds approved by the decision of State commission on securities and the stock market of September 1, 2006 N 774 registered in the Ministry of Justice of Ukraine on November 19, 2007 for N 1285/14552, and registered in the Ministry of Justice of Ukraine on November 15, 2006 for N 1205/13079.

Section I. General provisions

1. This Provision determines structure, terms and procedure for representation of State commission by securities and the stock market (further - the Commission) administrative data concerning activities by managers mortgage covering (further - Data).

2. Action of this Provision extends to managers mortgage covering (further - the Manager) who based on the license granted by State commission on securities and the stock market have the right to perform activities for management of mortgage covering, and banks which perform activities for management of mortgage covering, from signature date of the agreement on management of mortgage covering.

3. In this Provision terms are used in such value:

the magazine of acceptance of Data - the online magazine in which date and registration number of acceptance of Data are fixed;

date of emergence of irregular Data - date when the Manager knew of emergence of changes in the register of mortgage covering, replacements of the manager of mortgage covering, replacements of the financial institution servicing mortgage assets as a part of mortgage covering, the address of collection on mortgage covering, carrying out unplanned audit of the register of mortgage covering regarding identification of compliance of condition of mortgage covering to data of the register of mortgage covering and to requirements of the Law of Ukraine "About mortgage bonds".

4. The data provided by this Provision except cases, stipulated in Item 7 it undressed, move (are sent) to the Commission taking into account method of data presentation, the electee Upravitelem according to Item 2 of the Section ІІІ this provision.
