About approval of the Instruction on the organization by divisions of road traffic police of law-enforcement bodies of control of design and technical condition of vehicles

For the purpose of enhancement and increase in efficiency of control of observance of regulatory legal acts, standards and other specifications and technical documentation establishing requirements to design and technical condition of vehicles I ORDER:

1. Approve the enclosed Instruction on the organization by divisions of road traffic police of law-enforcement bodies of control of design and technical condition of vehicles.

2. To chiefs of the Municipal Department of Internal Affairs of the cities of Astana, Almaty, Municipal Department of Internal Affairs-Department of Internal Affairs of areas:

1) to provide studying of this Instruction by the staff of road traffic police;

To organize 2) according to the Instruction work of divisions of road traffic police of law-enforcement bodies on control of observance of the regulatory legal acts, standards and other specifications and technical documentation establishing requirements to design and technical condition of vehicles;

3) to hold events for informing owners of vehicles (legal entities and physical person) on requirements of this Instruction;

4) according to requirements of the order of the Government of the Republic of Kazakhstan of December 19, 2002 No. 1329 "Some questions of safety of traffic" to establish control of adherence to deadlines of step-by-step marking of vehicles light-reflective material.

3. To impose control of execution of this order on the Vice-Minister of Internal Affairs of the Republic of Kazakhstan police major general Otto I. I. and Department of road traffic police (Umurzakov B. N). Ministries of Internal Affairs of the Republic of Kazakhstan.

4. This order becomes effective from the date of state registration in the Ministry of Justice of the Republic of Kazakhstan.

Instruction on the organization by divisions of road traffic police of law-enforcement bodies of control of design and technical condition of vehicles

1. General provisions

1. This Instruction determines procedure divisions of road traffic police of law-enforcement bodies (daleedorozhny police) of control of observance of the regulatory legal acts, standards and other specifications and technical documentation establishing requirements to design and technical condition of automotor-vehicles and trail cars to them (further - vehicles) in the part relating to traffic safety.

In this Instruction the following basic concepts are used:

change of design of the vehicle - exception provided or installation of the components which are not provided by design of the specific vehicle and pieces of the equipment influencing traffic safety;

control of design of vehicles - check of compliance of design of vehicles and pieces of their additional equipment to requirements of regulatory legal acts, standards and other specifications and technical documentation;

control of technical condition transport sredstvproverka of compliance of technical condition of vehicles and pieces of their additional equipment to requirements of regulatory legal acts, standards and other specifications and technical documentation;

the certificate of conformity - the document issued by rules of the state system of certification, specifying that necessary confidence that properly the identified products, process, work, service conform to requirements of technical regulations, standards or other regulating documents is provided.

2. Activities of road traffic police for control of observance of the regulatory legal acts, standards and other specifications and technical documentation establishing requirements to design and technical condition of vehicles are based on the Constitution of the Republic of Kazakhstan, the Laws of the Republic of Kazakhstan, acts of the President and the Government of the Republic of Kazakhstan, other regulatory legal acts of the Republic of Kazakhstan and this Instruction.

3. The main objectives of road traffic police on control of observance of the regulatory legal acts, standards and other specifications and technical documentation establishing requirements to design and technical condition of vehicles are:

1) the prevention and decrease in weight of effects of the road accidents arising because of discrepancy of design, technical condition of vehicles and their additional equipment to requirements of regulatory legal acts, standards and other specifications and technical documentation;

2) the prevention and control of offenses and the administrative offenses in the field of safety of traffic connected with operation of vehicles.

4. Accomplishment of the main objectives on control of observance of the regulatory legal acts, standards and other specifications and technical documentation establishing requirements to design and technical condition of vehicles is performed by road traffic police when carrying out:

1) state registration of vehicles (daleeregistratsionny actions);

2) the state technical inspection of vehicles (further - technical inspection);

3) supervision of traffic;

4) checks of accomplishment by legal entities of requirements of the legislation of the Republic of Kazakhstan in the field of traffic safety (further - checks of legal entities);

5) approvals of project technical documentation on production (assembly) of vehicles;

6) approvals of modification of vehicle design;

7) acceptance tests of prototypes of vehicles;

8) the admission of vehicles to transportation of dangerous goods.

5. Control of design and technical condition of vehicles of foreign citizens, persons without citizenship, foreign legal entities, except diplomatic, consular and other representations, and also the staff of these representations and members of their families using privileges and immunity according to rules of international law is performed according to requirements of this Instruction.

2. Control of design and technical condition of the vehicles which are in operation

6. Control of design and technical condition of the vehicles which are in operation is performed in the way:

1) verifications of the relevant documents on the vehicle;

2) checks of compliance of design and technical condition of vehicles to requirements of regulatory legal acts, standards and other specifications and technical documentation in the field of traffic safety;

3) registrations of results of control.

7. The list of documents which are subject to check in case of control of design and technical condition of the vehicles which are in operation and also procedure for registration of results of control, is determined by Traffic regulations in the Republic of Kazakhstan, Rules of state registration of vehicles and trail cars to them in the Republic of Kazakhstan, Rules of carrying out the state technical inspection of automotor-vehicles and trail cars to them and other regulatory legal acts.

8. Check of compliance of design and technical condition of vehicles to requirements of regulatory legal acts, standards and other specifications and technical documentation in the field of traffic safety, is performed by survey of vehicles.

9. In case of survey of vehicles compliance of brand, model, modification, color, year of release, identification number (VIN) of the vehicle (if it is appropriated by the organization manufacturer), identification (serial production) numbers of the chassis (frame), body (carriage, trail car), the engine, the state registration sign, to the data specified in registration documents the vehicle is established.

10. In case of survey the attention to features of design of the specific vehicle is paid (type of body, the engine, availability of the special fixed equipment, quantity and placement of passenger seats, fuel tanks and another), and also observance of requirements of regulatory legal acts and standards is checked on:

to marking of contours of the lateral and back faces of vehicles light-reflective material;

to the equipment of vehicles special light and sound signals;

to completing by pieces of the additional equipment without which operation of vehicles is prohibited.

11. In case of identification on the registered vehicle of the changes of design which are subject to introduction and are not brought in registration documents to persons, managing such vehicles and also to the officials responsible for technical condition and operation of vehicles, measures according to the Code of the Republic of Kazakhstan about administrative offenses are taken.

12. The vehicle, its number aggregates and the submitted documents are checked for authenticity using technical means and on special accounting with use of the corresponding automated information retrieval systems.

13. In case of detection of signs of counterfeit of the submitted documents, the state registration signs, marking of vehicles, or detection of discrepancy of numbers of aggregates to the data specified in the submitted documents and also in the presence of good causes to believe that vehicles (number aggregates) or the submitted documents are wanted, measures according to the legislation of the Republic of Kazakhstan are taken.

14. Technical condition of vehicles is checked for compliance to requirements of the regulatory legal acts, standards and other specifications and technical documentation establishing requirements to design and technical condition of the vehicles which are in operation and pieces of their additional equipment.

15. Control of technical condition of vehicles when carrying out technical inspection is exercised in accordance with the established procedure with use of the diagnostic equipment and instrumentations.

16. The bases for stop of vehicles for control of design and technical condition when implementing supervision of traffic are:

absence in the right bottom corner of windshield of the car of the existing coupon about passing of technical inspection;

availability of the technical defects and conditions menacing to traffic safety.

17. Control of design and technical condition of the buses going along the established route can be made only at terminal stations of routes and passenger car parks.

18. Control of design and technical condition of vehicles of legal entities is performed in the procedure established by the legislation when carrying out scheduled and unscheduled inspections of legal entities.

19. Check of design and technical condition of vehicles of legal entities is carried out by road traffic police in places of their dislocation selectively in the quantity sufficient for the characteristic of technical condition of motor park of this legal entity. At the same time check of technical condition of vehicles can be performed with use of mobile units of engineering supervision.

20. In case of identification of violations of requirements of the legislation for traffic safety, the road traffic police issues the instruction, obligatory to execution, with indication of violations and necessary measures for their elimination.

In case of failure to carry out of instructions to official and legal entities measures according to the Code of the Republic of Kazakhstan about administrative offenses are taken.

21. Control of design, technical condition of the vehicles transporting dangerous goods is performed by consideration of question of the admission of vehicles to transportation of dangerous goods.

22. Procedure for the admission of vehicles to transportation of dangerous goods, and also requirements to design, technical condition of vehicles are determined according to the Rules of carrying out the state technical inspection approved by the order of the Minister of Internal Affairs of the Republic of Kazakhstan of November 22, 1999 No. 587 (registered in the Register of state registration of regulatory legal acts for No. 990) and requirements of Item 11 of Appendix "B" of state standard of ST of RK 1086-2003 "Technical diagnosing of automotor-vehicles and trail cars to them. General technical requirements to technology of works.

23. The admission of vehicles to transportation of dangerous goods is made by means of issue of the certificate on the admission of the vehicle to transportation of dangerous goods (Appendix 3).

24. Issue of certificates on the admission of vehicles to transportation of dangerous goods is performed by road traffic police in place of registration (temporary registration) of vehicles based on results of the state technical inspection.

On each vehicle the separate certificate on the admission of the vehicle to transportation of dangerous goods shall be granted, to bring results of survey in the magazine of registration of certificates on the admission of vehicles to transportation of dangerous goods (Appendix 4).

25. Effective period of the certificate on the admission of vehicles to transportation of dangerous goods is established for 12 months from the moment of its issue.

3. Control of design of vehicles in case of their production (assembly) and change of design of the vehicle

26. Control of design of vehicles in case of their production (assembly) is exercised at stages of approval of specifications (further - TZ), engineering designs (further - TP), specifications (further - TU), and also when testing prototypes of vehicles and their acceptance in production.

27. Control of design of vehicles in case of modification of their design if it is connected with change of dimensions and weight parameters, of model of the engine, its weight and capacity, fuel supply systems, the brake system, quantity, installation sites, viewing angles, light and color characteristics of devices of lighting and the light alarm system, running gear, steering, and also components of design providing visibility, visibility, passive and postemergency safety is performed at stages of approval of TU and when conducting acceptance tests of prototypes of vehicles. At the same time modification of design of buses is not allowed.

28. Control of design of vehicles at stages of approval of TZ, TP, TU is performed by Department of road traffic police of the Ministry of Internal Affairs of the Republic of Kazakhstan (further - DDP).

29. In case of approval of TZ availability of the following data in them connected with traffic safety is controlled:

1) short characteristic of scope of product;

2) road conditions and the modes of operation for which the vehicle intends;

3) traction and high-speed characteristics of the vehicle;

4) engine parameters;

5) weight parameters (weight in the equipped condition, the complete mass, load-carrying capacity, quantity of passenger seats, distribution of complete weight on axes, the complete mass of the towed trail car, semitrailer truck), overall dimensions (width, height, length);

6) road gleam, turn radiuses;

7) number of wheels, axes, drive of the main axis, size and characteristic of tires;

8) design of brake systems on axes, drive type;

9) design of steering, amplifier of the drive;

10) design, number of external light devices;

11) the used means of passive safety;

12) other requirements of regulatory legal acts and standards in the field of traffic safety.

30. On approval the TZ projects which previously underwent approval in other state bodies according to their competence are approved.

31. On the TZ projects submitted for approval the authorized employee of DDP constitutes the written conclusion in duplicate. The first copy of the conclusion goes to the TZ developer, the second together with the draft copy remains in DDP for control.

32. In case of lack of notes approval of the TZ project is drawn up by the signature of the first head of DDP, or person fulfilling its duties, under signature stamp "Is approved" also by the confirmed seal or the separate document (letter). At the same time under signature stamp "Is approved" date, number and the name of the document which approves the TZ project is specified.

33. If in the TZ project requirements of regulatory legal acts, standards and other specifications and technical documentation in the field of safety of traffic are not considered or it does not give complete idea of vehicle design, then the project is not approved with transfer in the conclusion on the project of the available shortcomings.

34. In case of approval of TP remedial action in TZ and its approval, completeness of implementation of the requirements of regulatory legal acts and standards specified in TZ is controlled.

TP join general views of the vehicle and the components of design influencing traffic safety and also the explanatory note.

35. Approval of TP are performed according to the procedure, provided in Items 30-33 of this Instruction.

36. Along with TP submitted in DDP for review approval of the program technique of testing of prototypes of vehicles is carried out. If in products components of serial vehicles are applied, then the program technique of testing of these products can provide check only of those parameters which are changed.

37. Approval of the program technique is performed according to the procedure, established for TZ.

38. Control at stage of testing and acceptance of prototypes of vehicles in production is performed by means of participation in the commission on acceptance tests.

39. As a part of the commission on acceptance tests of prototypes of vehicles the authorized employee of DDP or according to the written order DDP the representative of Management of Municipal Department of Internal Affairs road traffic police of the cities of Astana, Almaty, the Municipal Department of Internal Affairs-Department of Internal Affairs of areas (further - UDP) takes part in the territory of which carrying out testing is supposed.

40. Acceptance tests of prototypes of vehicles are carried out according to the program technique of testing of prototypes of vehicles approved in accordance with the established procedure DDP.

41. During acceptance tests the design and technical condition of prototypes of vehicles are checked for compliance to requirements of the corresponding project technical documentation, and also regulatory legal acts, standards and other specifications and technical documentation in the field of traffic safety.

42. By results of testing of prototypes of vehicles by inspection the protocol and the acceptance act of prototypes of vehicles is drawn up.

43. If samples did not pass tests, in the protocol offers on completion of design and the acceptance act of prototypes of vehicles by the authorized staff of road traffic police register it is not signed. Modifed components of design are subjected to re-testing.

44. In case of approval of TU it is controlled:

availability of full range of requirements to vehicle design, its production, control and acceptance;

compliance of the regulations established by TU, to mandatory requirements of the state, interstate and international standards in the field of traffic safety;

availability of the protocol and act by results of acceptance tests;

availability of certificates of conformity on prototypes of vehicles.

45. Are developed by TU on series of specific types of vehicles, and also according to the solution of DDP TU can be developed on one specific vehicle.

46. The term of approval of the TU project shall not exceed 15 days from the date of their receipt.

47. Registration of approval of projects of specifications is carried out according to the procedure, provided in Items 30-33 of this Instruction.

48. The changes made to THAT are approved according to the procedure, established for TU.

49. After approval, specifications are subject to state registration in the procedure established by the legislation. By results of state registration of TU of DDP the decision on issue of the organization performing production, or modification of design of the vehicle, the Certificate on approval of design of the vehicle in the part relating to traffic safety is made (further - the Certificate) (appendix 1).

50. On each organization performing production, or modification of design of vehicles, DDP run the observation business where the documents concerning approval of TZ, TP, TU, acceptance tests, state registration TU and other documentation relating to activities of this organization are stored.

51. DDP informs UDP information on the organizations to which the Certificate on approval of design of the vehicle in the part relating to traffic safety is granted.

52. About production cases, or modification of vehicle design with violations of requirements of TU, regulatory legal acts, standards and other specifications and technical documentation in the field of safety of traffic, UDP inform DDP for acceptance of stipulated by the legislation measures.

53. It is allowed to perform without development of project technical documentation, but in strict accordance with model of transport means analog of manufacturing plant and in coordination with road traffic police, the following of modification of design of vehicles:

1) change like body connected with installation on the chassis of cars and trail cars standard, made by manufacturing plants for this model of the vehicle, dumping and onboard bodies, tanks, bodies vans certified as a part of this brand of the vehicle, using the fasteners similar on design, quantity and material to elements of fixture of body or the tank of transport means analog of manufacturing plant;

2) installation on cargo vehicles according to model analog of manufacturing plant of the auxiliary fuel tanks of factory production certified as a part of this brand of the vehicle using the fasteners similar on design, quantity and material, fasteners of model analog of manufacturing plant;

3) installation on cargo vehicles according to model analog of manufacturing plant of load-lifting boards, winches and hydraulic elevators for independent loading and unloading of the loads certified as a part of this brand of the vehicle, using the fasteners similar on design, quantity and material, fasteners of model analog of manufacturing plant;

4) installation according to model analog of manufacturing plant on cars and trail cars, including in interior of the car, the special fixed equipment certified as a part of this brand of the vehicle, using standard fasteners;

5) installation on cargo onboard vehicles and onboard two-axis trail cars of horsemen instead of boards using the standard fasteners and devices excluding the increased noise;

6) installation according to model analog of manufacturing plant on the chassis of cargo vehicles of bodies vans of workshops, for transportation of mail, the manufactured and food products certified as a part of this brand of the vehicle using the fasteners similar on design, quantity and material, fasteners of model analog of manufacturing plant.

54. Statements on modification of design of vehicles, specified in Item 53 of this Instruction, are considered by DDP and/or UDP in the place of accounting of vehicles.

55. Statements are taken cognizance with the detailed description of the made changes in vehicle design.

56. By results of consideration of the application on modification of vehicle design by road traffic police the written answer with indication of the made decision is issued to the applicant.

57. In the positive decision technical requirements of regulatory legal acts and standards according to which it is necessary to make modification of vehicle design are specified, recommendations about the choice of technological base on which accomplishment of the corresponding works is possible are made, and also the name of division of road traffic police authorized for survey of the vehicle is specified.

58. Vehicles to which design changes are made are subject to certification in the procedure established by the legislation.

59. The design and technical condition of the vehicle after modification and certification are checked by road traffic police for compliance to requirements of regulatory legal acts and standards in the field of traffic safety, with issue to the owner of the Inspection report of the vehicle (appendix 2).

60. When checking design and technical condition of the vehicle to which design changes are made compliance of amount and quality of the performed works specified in supporting documents about the performed works by the organizations which make modification of vehicle design is controlled. Data on it join in the column "Notes on the Violations Revealed during Check and the Additional Information" of the Inspection report of the vehicle.
