About approval of the Procedure for distribution of the tariff quota to import to Ukraine of raw sugar from reed

According to the Law of Ukraine "About establishment of the tariff quota on import to Ukraine of raw sugar from reed" the Cabinet of Ministers of Ukraine decides:

1. Approve the Procedure for distribution of the tariff quota to import to Ukraine of raw sugar from reed which is applied.

2. This resolution becomes effective since January 1, 2009.

Procedure for distribution of the tariff quota to import to Ukraine of raw sugar from reed

1. This Procedure determines the mechanism of annual distribution of the tariff quota to import to Ukraine from member countries of the WTO of raw sugar from reed years.

2. Import to Ukraine of raw sugar within the tariff quota is performed based on the licenses granted by Ministry of Economics in coordination with Minagropolitiki. The specified approval is applied by the subject of foreign economic activity to the request for receipt of the license.

Any deliveries of raw sugar (code according to UKTVED 1701 11) which are imported according to the bilateral or regional trade agreements signed by Ukraine according to article XXIV GATT in 1994 are not considered such which influence the total amount of the tariff quota. Import of raw sugar according to schemes which include its processing for the following export (with return of the paid duty or according to arrangements on return of means), is also not considered use of the tariff quota (Item 2.4 of the table 14 "Administration of the Tariff Quota" of the Protocol on the entry of Ukraine into the WTO ratified by the Verkhovna Rada of Ukraine on April 10, 2008).
