Questions of import to customs area of Ukraine of energy saving materials, equipment, mechanisms and component parts
According to Items 14 and 16 of part one of Article 282 of the Customs code of Ukraine and Item 197.16 of article 197 of the Tax Code of Ukraine, the Cabinet of Ministers of Ukraine decides:
1) subjects of housekeeping which import energy saving materials on customs area of Ukraine the equipment, equipment and components (further - goods) which according to Items 14 and 16 of part one of Article 282 of the Customs code are exempted from payment of import duty, and also perform transactions on import of such goods to customs area of Ukraine which according to subitems 197.16.1 and 197.16.2 of Item 197.16 of article 197 of the Tax Code of Ukraine are exempted from taxation on value added, give to the Ministry of Economic Development and Trade:
the statement for release from taxation on value added of the goods planned to import to customs area of Ukraine, and payment of import duty with indication of the name of goods, their code according to UKTVED (in case import of complete objects is supposed, - with indication of the name of such objects and their code according to UKTVED), quantities and costs;
the copy of the external economic contract (contract) for delivery of goods or other document certified in accordance with the established procedure which is the basis for commodity importation on customs area of Ukraine;
information on the predicted profit of the subject of housekeeping (with indication of obligatory payments in the government budget);
the conclusion of state examination on energy saving about compliance of the project on which goods are imported to requirements of regulatory legal acts and normative and technical documents in the field of energy saving with indication of the name of goods, their code according to UKTVED (in case import of complete objects is supposed, - with indication of the name of such objects and their code according to UKTVED);
the document which confirms the obligation of the subject housekeeping concerning use of the imported goods only for own production with the corresponding reasons and calculations;
information of the relevant ministry or another central executive body that goods with similar qualitative indexes are not made in Ukraine;
2) the Ministry of Economic Development and Trade taking into account offers of the central executive bodies prepares the draft decision of the Cabinet of Ministers of Ukraine about modification of the inventory and in accordance with the established procedure sends it to consideration of the Cabinet of Ministers of Ukraine;
3) subjects of housekeeping which imported goods according to the list approved in accordance with the established procedure submit within three years monthly to the 5th of the next period to customs authority which performed registration of goods, the report on use of goods to destination in triplicate, two of which with mark about acceptance of goods are sent by customs authority monthly to the 13th of the next period to tax authority in place of registration of the subject of managing and the State agency on energy efficiency and energy saving. The report form is developed and affirms the State Customs Service in coordination with the State Tax Administration;
4) customs authority in place of registration of the subject of housekeeping and the State agency on energy efficiency and energy saving exercise in accordance with the established procedure control of use of the goods imported on customs area of Ukraine to destination.
In case of identification of the fact of violation of requirements of rather target use of goods the customs authority which performed registration of goods sends the relevant information to body of the State Tax Service for place of registration of the company for collection of outstanding amounts of the VAT, import duty and penalty fee according to Item 197.16 of article 197 of the Tax Code of Ukraine and part two of Article 282 of the Customs code of Ukraine.
2. Approve the List of energy saving materials, the equipment and component parts which are exempted from import duty and which transactions on import to customs area of Ukraine are exempted from taxation on value added it (is applied).
3. This resolution becomes effective from the date of publication.
