About approval of the Procedure and conditions of the organization of transportations of passengers and baggage by road transport

(as amended on 08-09-2013)

According to item 4 of general provisions of Rules of provision of services of passenger road transport, the Ministers of Ukraine approved by the resolution of the Office of February 18, 1997 N 176, I ORDER:

1. Approve the Procedure and conditions of the organization of transportations of passengers and baggage by road transport which is applied.

2. To State department of road transport of Ukraine (Dokil L. P.):

2.1. Bring to permission of the ministries, departments, the Government of the Autonomous Republic of Crimea, the regional, Kiev and Sevastopol city public administrations, associations, the companies, organizations and the organizations which activities are connected with provision of transport services, the Procedure and conditions of the organization of transportations of passengers and baggage by road transport.

2.2. Together with Main department for legal services of activities of transport (Loginova L. M.) in accordance with the established procedure tax on registration the Procedure and conditions of the organization of transportations of passengers and baggage by road transport in the Ministry of Justice of Ukraine.

Procedure and conditions of the organization of transportations of passengers and baggage by road transport

1. General provisions

1.1. These the Procedure and conditions of the organization of transportations of passengers and baggage by road transport (further - the Procedure and conditions) developed according to the Rules of provision of services of passenger road transport approved by the resolution of the Cabinet of Ministers of Ukraine of February 18, 1997 N 176, determine the basic principles, methods and technology of the organization of transportations of passengers and are obligatory for accomplishment by carriers, bus stations, bus stations (further - bus stations) all patterns of ownership, customers and drivers.

1.2. Observance of these of the Procedure and conditions shall provide:

timely, complete and high-quality requirements satisfaction of the population in transportations by road transport;

protection of the rights of citizens during their transport servicing;

safe functioning of road transport;

creation of equal conditions for economic activity of the companies of road transport irrespective of patterns of ownership;

restriction of monopolism and development of the competition;

coordination of work of different types of transport;

protection of the surrounding environment from adverse effect of road transport.

1.3. These Procedure and conditions provide requirements to:

organizations of routes;

organizations of bus and route taxi transportations;

conclusion of agreements on the organization of transportations;

the organizations of servicing of the population and passengers at bus stations;

organizations of dispatching management and control of transportations.

1.4. Advertizing on vehicles and in their salons, at stops, bus stations shall be performed with compliance with law about advertizing.

2. Organization of routes

2.1. The organization of routes provides:

studying of passenger traffics on the existing transportation network (further - demand of the population for transportation);

inspection of roads and road objects;

opening, closing, change of routes;

creation of schedules of movement;

execution of passports of routes.

2.2. Studying of demand of the population for transportation

2.2.1. For studying of demand of the population for transportation tabular, matrix and accounting methods of inspection of passenger traffics and correspondence are used.

2.2.2. The tabular method is applied to inspection of passenger traffics on intense routes by capacity more than 200 пас. / hour where the accountant determines the number of passengers who at stops entered the bus and left it. Examination is conducted selectively with modeling of passenger traffics and their transformation in route and interdistrict correspondence.

This method is applied on city and suburban routes.

2.2.3. The matrix method is applied to inspection of route correspondence on routes by capacity of passenger traffics to 200 пас. / hour where the accountant determines the number of passengers who entered at stops, and matrixes of pomarshrutny correspondence of passengers on stops of their exit are filled. During processing of the acquired information modeling of correspondence in passenger traffics is performed.

This method is applied on suburban and long-distance routes.

2.2.4. The accounting method of determination of pomarshrutny correspondence of passengers is applied to processing of data on the tickets sold on each flight or forms (road sheets), with systematization of this information in pomarshrutny correspondence and with further modeling of passenger traffics.

This method is applied on long-distance and international routes.

2.2.5. Studying of demand of the population for transportation is performed based on single methodical and the software for computer aids stated in the Technique of studying of demand of the population for passenger traffic according to appendix 1 to these to the Procedure and conditions.

2.2.6. Studying of demand of the population for transportation is performed:

in a complex - on all city, suburban and long-distance transportation network - at least once for three years;

selectively - on city, suburban, long-distance and international routes if passenger traffics undergo considerable changes;

korigirovochno - on any route in three-four months after its opening.

2.3. Inspection of roads and road objects

2.3.1. Inspection of roads and road objects is carried out for the purpose of determination of compliance of condition, type of covering and width of travel part of the road and roadsides, horizontal and vertical radiuses of curve, longitudinal biases, visibility and arrangement of roads, and also railway crossings to requirements of GSTU 3687-97 "Traffic safety: highways, streets and railway crossings. Requirements to operational condition" and to Single rules of repair and content of highways, streets, railway crossings, instructions for use them and protection, approved by the resolution of the Cabinet of Ministers of Ukraine of March 30, 1994 N 198.

2.4. Opening, closing and change of routes

2.4.1. It is previously necessary for permission of question of feasibility of opening of route:

determine demand in transportations of passengers;

choose the route of movement and conduct examination of road conditions;

constitute the feasibility statement on feasibility of opening of route.

2.4.2. New routes open in the presence of resistant transport correspondence of the population and providing safety conditions of transportations.

2.4.3. For opening of routes it is necessary to provide:

arrangement of initial and final stops of routes in passazhiroobrazuyushchy and passazhiropogloshchayushchy places;

transport communication for the greatest number of passengers on the shortest ways of the direction;

provision of buses of such types which correspond to type of transport;

use of control facilities behind movement regularity;

the coordinated movement of buses on route which matches with other routes, and also with the working schedule of other types of passenger transport;

use on routes of effective forms of labor organization of drivers and systems of the organization of movement.

2.4.4. Regular and irregular international carriages of passengers in the territory of Ukraine are performed in the presence of permission to accomplishment of the international regular and irregular carriages of passengers, according to appendices 2 and 3 to these to the Procedure and conditions.

2.4.5. For opening of international routes of regular transportations of passengers carriers shall:

approve opening of routes with foreign carriers;

send to Ministry of Transport of the request and cooperation agreements with foreign carriers and copies of the special permissions (licenses) issued to them.

Ministry of Transport in turn shall:

2.4.5.1. Consider noted cooperation agreements.

2.4.5.2. Approve schedules of movement of vehicles on international routes.

2.4.5.3. Send to competent authorities of foreign states, according to requirements of international treaties of Ukraine about motor transportations, requests for opening of international routes with request for obtaining from them the corresponding permissions.

2.4.5.4. Transfer to competent authorities of foreign states of permission to accomplishment of international carriages of passengers by foreign carriers in the territory of Ukraine and issue the permissions got from competent authorities of foreign states, to the Ukrainian carriers for accomplishment of international carriages of passengers and baggage in the territory of foreign states.

2.4.5.5. Approve with Goskomgranits, State Customs Service and the Ministry of Internal Affairs time of crossing by buses of international routes of regular transportations of frontier of Ukraine and to issue to carriers of the omission of sample, single for all check points, on extraordinary crossing by bus of frontier of Ukraine (which sample is approved by the order of Ministry of Transport, Goskomgranits, State Customs Services and the Ministry of Internal Affairs of 10.12.97 N 434/14/14/922).

2.4.6. Depending on the size of passenger traffic and road conditions on route, requirements to the equipment of road objects provide availability:

turnaround areas and sediment of buses in starting and terminal points of city routes;

airfields, pavilions, and depending on the passenger turnover size - bus stations at stops of suburban and long-distance routes.

2.4.7. In case of the need for additional equipment of road constructions on route along with the passport of route the actions plan concerning their arrangement with stipulating of term of accomplishment of the corresponding works which affirms along with the passport of route is developed.

2.4.8. Movement of buses on route, depending on the size of passenger traffics and the characteristic of route correspondence, is organized on the regular or express mode.

2.4.9. To each route Ministry of Transport or the relevant local public administration, local government body, within their powers, assign sequence number. Numbering of city and suburban routes is conducted in each city. Routes have single numbering on area: city bus - from 1 to 99; suburban - from 100 to 499. On long-distance and international routes numbering of flights is carried out in the directions: on the North and the West - even numbers of flights, on the East and the South - odd are assigned.

2.4.10. Before opening of bus route the carrier in coordination with the relevant public administration, local government body or Ministry of Transport creates the commission with the assistance of owners of road objects or their authorized persons. The commission performs inspection of roads and road objects based on which draws up the statement of readiness of route for opening with indication of date of its opening.

In the presence of shortcomings the commission specifies in the act terms and persons, responsible for their elimination. In this case the route opens taking into account time for remedial action, noted in the act.

2.4.11. About opening, closing of route and change of the schedule of movement on city routes is reported through mass media (the local press, radio) and special announcements in buses, at stops and in bus stations not later than in three days, suburban and long-distance - not later than in five days, and international - in fifteen days.

2.4.12. After opening of route the carrier provides: regularity of transportations and proper service quality of passengers, observance of the schedule of movement, transportation in the bus of the maximum permissible number of passengers, and also proper efficiency of use of vehicles.

2.4.13. Change of route is carried out according to Items 2.4.1 - 2.4.8 these About and conditions.

2.4.14. In case of natural disaster, epidemic, epizooty or other emergency situation the carrier can close route or limit on it movement, having as soon as possible reported about it to local executive bodies and local government bodies.

2.5. Requirements to placement, the equipment and content of stops on routes of passenger road transport

2.5.1. These requirements establish procedure for placement, the equipment and content of stops of passenger road transport in the cities and settlements of city type of Ukraine, on suburban routes, and is obligatory for all companies, organizations and the organizations which are engaged in designing, construction and operation of stops.

2.5.2. Requirements are developed according to provisions BDN 360-92 "Town-planning. Planning and building of residential and rural locations", GSTU 2586-94 "Route signs. General specifications. Rules of application", GSTU 2587-94 "Marking road. General specifications. Rules of application", GOST 25859-90 "Distinctive marks and information support of structure of the passenger land transport, stopping points and passenger stations. General technical requirements".

2.5.3. Stops on city bus routes shall be located near passazhiroobrazuyushchy and passazhiropogloshchayushchy Items: residential arrays, companies, cultural and community institutions, shopping centers, places of mass rest of the population, railway stations, river and seaports, airports, stations of the subway and so forth.

2.5.4. The choice of the location of stops is assigned to carriers who transport passengers in the settlement and on suburban routes.

2.5.5. Double stops place only when they are provided for servicing of several routes of one type of vehicles with total frequency of movement of more than 30 units in hour.

2.5.6. Placement of stops on street road net shall conform to such main requirements:

the most convenient and safe approach to the main objects in large quantities visited by citizens;

the smallest capacity reduction of the city street (road);

the smallest mutual obstacles between different types of urban transportation;

conveniences of change from one type of urban transportation or route on another;

traffic safety.

2.5.7. In places of crossing, branch or convergence of bus routes placement of stops shall provide not only convenience of changes, but also convenience of use of routes of one direction.

2.5.8. In places of crossing of routes of stop it is necessary to place so that passengers did not cross travel part of the street (road).

2.5.9. Bus-stops should be placed, as a rule, behind the intersection of streets and roads.

2.5.10. Placement of bus-stops to the intersection of streets and roads is admissible in exceptional cases, in particular if:

to the intersection there is object visited by citizens big in large quantities or entrance to the underground crosswalk;

the reserve of handling capacity of travel part of the street (road) to the intersection is more, than behind it;

time which passengers spend for change is considerably reduced;

near the intersection the entrance to the bridge, platform, tunnel, the overpass and so forth begins or there is railway crossing.

2.5.11. On airfields there shall not be green plantings, booths, advertizing media and other objects and constructions (except booths for sale of tickets and canopies or pavilions for passengers) which would create obstacles to normal functioning of stop.

Exception are airfields which are placed on sidewalks or dividing strips between them and travel part where trees grow.

2.5.12. Placement of constructions of household and trade appointment and advertizing media near stops should be performed according to Single rules of repair and content of highways, streets, railway crossings, instructions for use them and protection, approved by the resolution of the Cabinet of Ministers of Ukraine of March 30, 1994 N 198.

2.5.13. Stops of buses on city, express, suburban, route taxi, passenger-and-freight routes are equipped with avtopavilyona, cliches with the name of stop and number of route, data on operating mode of buses (the name of initial and final Items, time of the beginning and the end of movement on route, interval of movement or time of sending buses) (appendices 4-7 to these to the Procedure and conditions) and information on traffic safety.

Information on operating mode of buses in days off and holidays moves in the form of notes to the main information.

All other data shall be applied on the information plate which has the same width and color, as route sign and which is established as it is direct under sign, and directly near it, in the place convenient for survey.

2.5.14. If the movement interval on route does not exceed 20 minutes, then on cliches the movement interval within a day is specified and if exceeds - time of sending buses from stop.

2.5.15. At stops of buses which carry out express, route taxi and passenger and cargo transportation over the name of stop on cliche red paint puts text "Express", black, respectively - "The share taxi" and "Passenger and cargo transportation".

Stops are on demand equipped with cliche with text black paint "Upon the demand of" (appendix 8 to these to the Procedure and conditions).

The sizes of texts on cliches and information plates shall be such that it was possible to read them from distance at least than 3 m.

2.5.16. It is allowed in the upper part of sign, over the image of type of railway vehicles, to put the name of the organization responsible for sanitary condition of stop.

2.5.17. Information on change of movement of vehicles in days off and holidays moves in the form of notes to the main information.

2.5.18. Coverings and all compound equipment of stops shall be permanent in proper operational condition and meet safety requirements of traffic.

2.5.19. The covering of stop should be removed regularly from garbage, to clear as soon as possible of snow and ice.

2.5.20. With ice approach it is necessary to sand the airfield, and the place of stop route transport sredstvpeschano-salt mix, at the rate of 300-400 g of mix on 1 sq.m.

2.5.21. After cleaning of travel part of snow, it is necessary to clear away immediately snow drift which is formed in tray on all length of the airfield and on 5-10 m in both parties.

2.5.23. Paint booths of sale of tickets, benches, canopies, pavilions, ballot boxes, brackets, struts and other elements of the equipment of stops follows in process of requirement, but at least every 2 year.

2.6. Schedule of movement

2.6.1. The schedule of movement is basis of the organization of movement on routes and obligatory for accomplishment by workers of passenger road transport.

2.6.2. The schedule of movement shall be developed with observance of such requirements:

timely satisfaction of demand of the population for transportation;

uses of spaciousness of buses according to the passport of manufacturing plant;

minimum expenses of time of passengers on trips;

regularities of movement of buses on route;

comforts of conditions of trip of passengers;

observance of the modes and working conditions of drivers and conductors according to the legislation;

effective use of buses on routes.

2.6.3. Carriers constitute such types of the schedule of movement:

summary - for city, suburban, long-distance, international, tourist, express and taxi маршрутовв to form of tables. In it time of sending buses from starting point and arrival in terminal point is specified;

autostation - on suburban, long-distance and международныхдля terminal and intermediate points of routes. In it arrival time and sendings from initial and intermediate points, arrival in terminal point, duration of stops and all flight is specified;

the worker - the schedule of movement what driver receives before departure on route - for city, suburban, long-distance, international, tourist, express and taxi routes. In it sending time from initial stop and checkpoints and arrival in terminal point is specified.

The corresponding samples of the schedule of movement are provided in tables 1-3 of appendix 9 to these to the Procedure and conditions.

2.6.4. The schedule of movement on city and suburban routes affirms, and on intraregional - is approved by the relevant local public administrations or local government bodies within their powers. The schedule of movement on interregional routes affirms, and on mezhdunarodnykhsoglasovyvatsya with State department of road transport.

2.6.5. Bus stations based on the suburban, long-distance, international schedules of movement constituted by carriers develop autostation schedules of movement which are placed in bus station for informing passengers, and also are published in information leaflets, brochures and so forth for distribution among the population.

2.6.6. The schedule of movement on city, suburban, long-distance and international routes are constituted for the spring and summer and autumn and winter periods of year, and on city, suburban and long-distance - also separately on working and the days off.

The term of transition to the corresponding schedule of movement on city, suburban and intraregional routes is annually determined by the relevant local public administrations and local government bodies, and on long-distance and international - State department of road transport.

Changes in the schedule of movement on suburban, long-distance and international routes are approved by carrier with the relevant bus stations.

2.7. Execution of the passport of route

2.7.1. On route the passport according to the order of the Ministry of Transport and Communications of Ukraine of 07.05.2010 No. 278 "About approval of the Procedure for development and approval of the passport of bus route", registered in the Ministry of Justice of Ukraine 17.06.2010 for No. 408/17703 is drawn up.

3. Organization of transportations

3.1. Technical condition of buses and passenger-and-freight cars which work at routes shall meet the requirements of Traffic regulations and instructions of manufacturing plants.

3.2. On routes in the mountain area use of buses and passenger-and-freight cars with run more than 200 thousand km since the beginning of their operation is not allowed, at the same time autotires shall have degree of depreciation of no more than 50 percent from normative.

3.3. Release to the line of buses and passenger-and-freight cars is inadmissible:

with defective speedometer and damage to machinery of emergency opening of hatches, doors, windows in inside of buses;

not provided with the necessary fire-fighting equipment, medical first-aid kits, signs of emergency stop, antiretractable emphasis;

without noted in appendix 12 of these of the Procedure and conditions of the relevant visual information.

3.4. In buses and passenger-and-freight cars which carry out transportation of passengers there shall not be structural elements which are not provided by manufacturing plant, including the blocked doors and emergency exits; damages of upholstery of seats and internal walls of salons and painting; blots and scratches, and also opaque materials for glass replacement shall not be used.

3.5. Buses and passenger-and-freight cars on routes in the mountain area shall be equipped with fog lights and headlights of backing.

3.6. The carrier shall exercise control of observance by drivers of the schedule of movement and regulations of capacity of buses and passenger-and-freight cars regarding compliance to the passport of manufacturing plant.

On city and suburban routes the number of passengers in the bus shall not exceed the total capacity provided by the instruction of manufacturing plant.

On long-distance, international and taxi routes the number of passengers shall not exceed the number of places for sitting.

3.7. The driver only of that category which allows to work at passenger road transport is allowed to work by bus.

3.8. Landing (disembarkation) of passengers is carried out to route taksomotor and passenger-and-freight cars at stops and on the way of the direction of transport upon the demand of passengers. Landing on demand on the way of the direction is carried out only in the presence of empty seats, with observance of Traffic regulations.

3.9. Route taxi transportations and passenger and cargo transportation are performed respectively by the certified buses (minibuses) and passenger-and-freight cars.

3.10. Requirements to placement of visual information by buses, minibuses and passenger-and-freight cars are submitted in appendix 12 to these to the Procedure and conditions. Visual information can be placed using electronic boards.

3.11. On taksomotor it is necessary to establish taximeter, alarm lamp with green and red light above to the right on windshield, identification lamp of orange color on taxi roof with composition from the black squares located in chessboard order (fig. 4, of the 8th appendix 12 to these to the Procedure and conditions).

4. Conclusion of agreements on the organization of transportations of passengers

4.1. Passengers by road transport are transported based on one of such documents:

the ticket which certifies the citizen's right to use of road transport and transportation for a fee of baggage on city (including route taxi), suburban and long-distance routes. The form of the ticket and luggage receipt for international carriages of passengers, the Instruction for execution of the ticket and the luggage receipt on travel by buses of international routes are established according to appendix 13 to these to the Procedure and conditions;

the long-term agreement of transportation of organized groups of children which sample is approved by the order of Ministry of Transport and Ministry of Education of 10.12.97 N 431/7, of the agreement of one-time transportation of organized groups of children in the order form which sample is approved by the order of Ministry of Transport and Ministry of Education of 09.01.98 N 4/8, and also authorities for the move of organized groups of children which sample is approved by the order of Ministry of Transport and Ministry of Education of 09.01.98 N 5/9;

the external economic cooperation agreement, connected with the international regular delivery of passengers, on the sample which is found room into appendix 14 to these to the Procedure and conditions, and agreements on the international irregular and pendular motor transportations of passengers, on the sample given in appendix 15 to these to the Procedure and conditions;

the long-term agreement on transportation of tourists which sample is approved by the order of Ministry of Transport and Goskomturizm of 10.12.97 N 433/5 and agreements of one-time transportation of tourists which sample is approved by the order of Ministry of Transport and Goskomturizm of 09.01.98 N 6/4;

cooperation agreement, connected with servicing of passengers road transport on the sample which is found room into appendix 16 to these to the Procedure and conditions;

lease contracts of the room the companies which provide services to the population and passengers, on the sample which is found room into appendix 17 to these to the Procedure and conditions.
