Questions of the Ministry of road transport and highways of Turkmenistan

According to the Presidential decree of Turkmenistan from 16 Nowruz of 2004 No. 4031 "About formation of the Ministry of road transport and highways of Turkmenistan" and for the purpose of timely and effective implementation of the tasks and functions assigned to the Ministry I decide:

1. Approve enclosed:

Regulations on the Ministry of road transport and highways of Turkmenistan;

structure of central office of the Ministry of road transport and highways of Turkmenistan;

list of the companies and organizations subordinated to the Ministry of road transport and highways of Turkmenistan.

2. Establish the number of employees of central office of the Ministry of road transport and highways of Turkmenistan in number of 65 units (without service personnel).

3. Permit the Ministry of road transport and highways of Turkmenistan to have 2 deputy ministers, including the one first deputy.

4. Declare invalid:

the resolution of the President of Turkmenistan from 4 Magtymgula 1993 No. 1316 "About approval of the Regulations on State concern of Turkmenavtoyellara and the list of the companies and the organizations which are its part" (Collection of acts of the President of Turkmenistan and decisions of the Government of Turkmenistan, 1993, No. 5, the Art. 1290);

the resolution of the President of Turkmenistan from 6 Gurbansoltan 1994 No. 1742 "About approval of the Regulations on the Ministry of road transport of Turkmenistan" (Collection of acts of the President of Turkmenistan and decisions of the Government of Turkmenistan, 1994, No. 4, the Art. 1944);

the resolution of the President of Turkmenistan from 11 Bitaraplyk 1995 No. 2416 "About amendment of the Regulations on State concern of Turkmenavtoyellara (Collection of acts of the President of Turkmenistan and decisions of the Government of Turkmenistan, 1995, No. 12, the Art. 2944).

Regulations on the Ministry of road transport and highways of Turkmenistan

1. The ministry of road transport and highways of Turkmenistan (the Ministry is referred to as) is the state body providing realization of state policy in the field of development of road transport and highways.

2. In the activities the Ministry is guided by the Constitution of Turkmenistan, the laws of Turkmenistan, acts of the President of Turkmenistan, resolutions of Majlis of Turkmenistan, decisions of the Cabinet of Ministers of Turkmenistan, other regulatory legal acts of Turkmenistan, the conventional principles and rules of international law, international treaties of Turkmenistan and this Provision.

3. In the activities the Ministry is accountable to the President of Turkmenistan and the Cabinet of Ministers of Turkmenistan.

4. The main objectives of the Ministry are:

realization of state policy in the field of road transport and highways according to decisions of the President of Turkmenistan and the Government of Turkmenistan;

implementation of steady and safe work of road transport and proper maintenance of highway network for the purpose of requirements satisfaction of economy and the population of Turkmenistan in motor transportations and well-planned highways public and constructions on them;

ensuring safe transportation of passengers on road transport and high culture of their servicing;

ensuring safety and timely delivery of the transported loads;

provision of forwarding services;

carrying out and enhancement of organizational, production, personnel policy, coordination of activities of subordinated divisions, companies, organizations, educational institutions of the corresponding profile;

increase in level of modernization of jurisdictional enterprises and organizations;

assistance to development of the interstate relations of Turkmenistan with other countries, participation in development and the conclusion of international treaties in the field of road transport and highways;

preparation of drafts of the legal acts governing the relations in the field of road transport and highways;

other tasks assigned by the legislation of Turkmenistan to the Ministry.

5. According to the tasks assigned to it the Ministry performs the following functions:

develops development programs of road transport and highways public in the territory of Turkmenistan and exercises control of their realization;

provides implementation of achievements of science and technology, experience of the advanced companies on road transport during the designing, construction, repair and content of highways and constructions on them;

promotes development and effective use of production capacities of the motor transportation, project, construction, industrial and operational enterprises й the organizations of industry;

will organize work on professional training and retraining of personnel, including in accordance with the established procedure and abroad;

solves problems of improvement of working conditions, ensuring social and legal security of workers of industry;

performs in accordance with the established procedure foreign economic activity, transactions on export and import of the motor transportation and road equipment, equipment, machines, spare parts, construction and other materials, designs, products and consumer goods;

provides financial and credit, legal, organizational servicing of jurisdictional enterprises and organizations, performs general financial and economic policy, control of financial activities, condition of accounting and the reporting at jurisdictional enterprises and in the organizations;

provides accomplishment by jurisdictional enterprises and organizations of financial liabilities before the Government budget of Turkmenistan, performs the analysis of their financial and economic activities, gives them methodical and information help;

proves the needs of industry for financial and currency resources, material resources, creates special funds;

disposes of means of road fund within the annual amounts allocated by the Ministry of Economics and finance of Turkmenistan;

in accordance with the established procedure develops rates for transportation of goods, baggage and passengers;

coordinates work of the companies and organizations of industry for mobilization preparation, civil defense and creation in accordance with the established procedure of reserves of the material resources necessary for performance of works on mitigation of consequences of emergency situations on highways public;

takes measures for providing ecological safety on transport, exercises control of observance of regulations of emissions of pollutants in the atmosphere;

participates in preparation of suggestions for improvement of the legislation of Turkmenistan in the field of road transport and highways;

takes measures for strengthening of the state, agreement and labor discipline in industry, considers in accordance with the established procedure applications and claims of citizens;

at the request of the Cabinet of Ministers of Turkmenistan within competence of the Ministry represents the interests of Turkmenistan at the international forums;

performs other functions within the powers.

6. The ministry has the right:

in accordance with the established procedure to create, reorganize and liquidate jurisdictional enterprises, the organizations and other structural divisions, including joint with foreign firms, in Turkmenistan and beyond its limits;

use and dispose of the property which is on its balance and acquired at the expense of the means received as a result of the activities in the limits set by the legislation of Turkmenistan, and also funds allocated from the Government budget of Turkmenistan for implementation of target state programs;

finance scientific research, scientific and practical conferences, symposiums, meetings, including in accordance with the established procedure international, and also actions for preparation and advanced training of personnel;

take measures for attraction and increase in efficiency of use of investments, grants and other financial aid allocated by the foreign and international organizations for development of road transport and highways in Turkmenistan;

check efficiency of use of the funds allocated by the foreign and international organizations for development of road transport and highways in Turkmenistan;

place at the companies and in the organizations of industry state orders on construction of highways and constructions on them with involvement of specialized enterprises and organizations, irrespective of patterns of ownership, on the basis of agreements of sub contracting;

approve within the competence the design estimates according to the conclusion of Head department of state examination of the Ministry of Construction and Building Materials Industry of Turkmenistan, the list and amounts of works on design and exploration work, construction and reconstruction of highways of the state and local value and constructions on them, to appoint in accordance with the established procedure for acceptance them in operation the state inspections.

7. The ministry is headed by the Minister appointed to position and dismissed by the President of Turkmenistan.

The minister has two deputies, including the one first deputy appointed to position and dismissed by the President of Turkmenistan.

8. Minister:

directs activities of the Ministry and bears the personal responsibility for accomplishment of the tasks and functions assigned to it;

distributes obligations between the deputies and coordinates their activities;

issues within the competence according to the legislation of Turkmenistan the orders which are subject to obligatory execution by employees of the Ministry and also workers, the logging-in road transport and highways of divisions, the companies and the organizations;

signs on behalf of the Ministry of the agreement, contracts, agreements and other documents;

acts on behalf of the Ministry, represents its interests in bodies of the state and executive authority, in the organizations, at the companies, in organizations and at the request of the Cabinet of Ministers of Turkmenistan in the international organizations;

approves in coordination with the Ministry of Economics and finance of Turkmenistan the staff list of central office of the Ministry;

approves regulations on structural divisions of central office of the Ministry;

appoints and dismisses the staff of central office of the Ministry, heads and the chief (seniors) accountants of jurisdictional enterprises and the organizations;

makes in accordance with the established procedure decisions on creation, reorganization and liquidation of jurisdictional enterprises, organizations and structural divisions;

performs other powers according to this Provision and the legislation of Turkmenistan.

9. The number of employees of central office of the Ministry affirms the President of Turkmenistan.

10. Financing of maintenance costs of central office of the Ministry is performed due to assignments from profit, being at the command jurisdictional enterprises and the organizations.

11. Financial accounting and the reporting in the Ministry are conducted according to the procedure, established by the legislation of Turkmenistan.

12. The ministry is legal entity, has seal with the image of the State Emblem of Turkmenistan and with the name, and also settlement, currency and other accounts in bank institutions.
