Section I. General provisions

Article 1. Scope of the Law

1. This Law is applied to the international commercial arbitration in case of observance of the interstate agreements supported by the Azerbaijan Republic.

2. Provisions of this Law (except for Articles 8, of 9, 35 and 36) are applied only if the place of arbitration is in Azerbaijan.

3. The arbitration is considered international in cases:

if the companies of the parties of the arbitral agreement in case of its conclusion are in the different states;

if outside the state where there are own companies of the parties, there is one of the following places:

a) the arbitration place if the specified place is not established in the arbitral agreement or according to it,

b) any place of execution of the main part of the obligations following from trade relations or the place which is closely connected with matter in issue:

if the parties came to the final agreement that the subject of the arbitral agreement is connected with more than one country.

4. For the purposes of Item 3 of this Article:

if the party has more than one commercial enterprise, the company which has the greatest relation (concern) to the arbitral agreement is considered commercial;

if the parties have no company, the permanent residence of the party is taken into account.

5. This Law does not affect operation of the laws of the Azerbaijan Republic which provide that certain disputes cannot be referred to arbitration or can be referred to arbitration according to provisions others, than those which contain in this Law.

Article 2. Basic concepts

The basic concepts used in this Law have the following values:

a) "arbitration" - any arbitration irrespective of whether it is performed by permanent arbitral management or not;

b) "Arbitration Court" - the single arbitrator or board of arbitrators;
