About approval of Regulations about permission National Bank of Moldova of some currency transactions

Based on articles 11 and 51 of the Law on National Bank of Moldova No. 548/1995 (The official monitor of the Republic of Moldova, 1995, Art. No. 56-57, 624), with subsequent changes and amendments, provisions of the Law on currency control No. 62/2008 (The official monitor of the Republic of Moldova, 2008, Art. No. 127-130, 496) DECIDES: Administrative board of National Bank of Moldova

I. Approve Regulations about permission by National Bank of Moldova of some currency transactions it (is applied).

II. Recognize invalid the Instruction about implementation of transfer of the capital in the form of investments approved by the Resolution of Administrative board of National Bank of Moldova No. 186 of July 29, 2004. (The official monitor of the Republic of Moldova, 2004, Art. No. 138-146, 285), with subsequent changes and amendments.

III. The instruction about transfer from the Republic of Moldova of money separate categories of physical persons approved by the Resolution of Administrative board of National Bank of Moldova No. 184 of July 13, 2006. (2006, 426), with subsequent changes and amendments, to change the official monitor of the Republic of Moldova to Art. No. 116-119, as follows:

1. The subitem b) Item 1.2 to exclude.

2. Exclude Chapter III.

3. In appendix No. 1 to the instruction:

1) part I:

a) to exclude the text from the name of part "/National Bank of Moldova";

b) 1, 2 and 6 to exclude Items;

c) to exclude the text from Item 7 "/receipts of permission of National Bank of Moldova";

2) part II:

a) in the name of part "Items 1-7 of this appendix" to replace the text with the text "this appendix";

b) state Item 1 in the following edition:

"1. The document specified in Item 5, is submitted and is stored in licensed bank in the original.";

c) in Item 2:

- in the first offer the text "2-4 and 6-7" to replace with the text "3, 4 and 7", and "/National Bank of Moldova" to exclude the text;

- from the second offer to exclude texts "/National Bank of Moldova" and "/National Bank of Moldova";

- from the third offer to exclude texts", 6" and "/National Bank of Moldova";

4. To exclude appendix No. 2 to the instruction.

IV. Residents which submitted to National Bank of Moldova applications for issue of permissions to implementation of the currency transactions regulated by the regulations specified in Item I of this resolution and did not get permission of National Bank of Moldova for the date of entry into force of this resolution, shall execute provisions of the mentioned regulations.

V. The operating permissions issued to residents by National Bank of Moldova before entry into force of the Law on currency control No. 62-XVI of March 21, 2008. (The official monitor of the Republic of Moldova, 2008, No. 127-130, of the Art. 496) according to the instructions specified in Items II and III of this resolution, and individually based on the Regulations on currency control in the territory of the Republic of Moldova approved by the Decision of Administrative board of National Bank of Moldova of January 13, 1994, the protocol No. 2 (repeated publication: The official monitor of the Republic of Moldova, 2003, as Art. No. 56-58, 75), with subsequent changes and amendments, on currency transactions for which implementation according to this law there is no need to get permissions are considered invalid from the date of entry into force of the specified law.

VI. The residents having the operating permissions issued by National Bank of Moldova before entry into force of the Law on currency control No. 62-XVI of March 21, 2008. (The official monitor of the Republic of Moldova, 2008, No. 127-130, of the Art. 496) according to the instructions specified in Items II and III of this resolution, and individually based on the Regulations on currency control in the territory of the Republic of Moldova approved by the Decision of Administrative board of National Bank of Moldova of January 13, 1994, the protocol No. 2 (repeated publication: The official monitor of the Republic of Moldova, 2003, No. 56-58, of the Art. 75), with subsequent changes and amendments, shall submit in National Bank of Moldova reports according to provisions of the regulations specified in Item I of this resolution since month under report in which this resolution becomes effective.

Chapter I. General provisions

1. In these regulations the concepts determined by the Law on currency control No. 62/2008 are used (repeated publication: Monitorul Oficial al Republicii Moldova, 2016, No. 423-429, the Art. 859) which further is referred to as - the Law No. 62/2008. Also for the purpose of these regulations the following concepts are used:

a) permission to implementation of currency transaction (permission of NBM) - the official document issued by National Bank of Moldova (on paper or electronically) permitting to its owner to perform the corresponding currency transaction;
