I.O'S ORDER. MINISTER OF ECONOMY AND BUDGET PLANNING OF THE REPUBLIC OF KAZAKHSTAN

of March 2, 2009 No. 30

About approval of requirements to development and examination of the feasibility statement on the budget investment project and concessionary project requiring joint financing from republican or local budgets and recognition voided some decisions of the Ministry of Economy and Budget Planning of the Republic of Kazakhstan

According to Item 2 of Article 154 and Item 3 of Article 155 of the Budget code of the Republic of Kazakhstan, I ORDER:

1. Approve enclosed:

1) Requirements to development and examination of the feasibility statement on the budget investment project;

2) Requirements to development and examination of the feasibility statement on the concessionary project requiring joint financing from the republican or local budget.

2. To department of investment policy and planning (Tortayev B. K.) and to Legal Department (Eshimova D. A.) provide state registration of this order in the Ministry of Justice of the Republic of Kazakhstan.

3. To impose control of execution of this order on the vice-Minister of Economy and Budget Planning of the Republic of Kazakhstan Kusainov M. A.

4. Declare invalid:

1) order of the deputy. The Minister of Economy and Budget Planning of the Republic of Kazakhstan of September 30, 2004 No. 142 "About approval of requirements to the conclusion of economic examination of the budget investment project (program)" (it is registered in the Register of state registration of regulatory legal acts of the Republic of Kazakhstan on November 5, 2004 for No. 3186);

2) order of the deputy. The Minister of Economy and Budget Planning of the Republic of Kazakhstan of September 30, 2004 No. 144 "About approval of requirements to the feasibility statement on budget investment projects (programs)" (it is registered in the Register of state registration of regulatory legal acts of the Republic of Kazakhstan on November 5, 2004 for No. 3184).

5. This order becomes effective after ten calendar days from the date of its state registration in the Ministry of Justice of the Republic of Kazakhstan.

Requirements to development and examination of the feasibility statement on the budget investment project

1. General provisions

1. These Requirements to development and examination of the feasibility statement (further - the feasibility study) the budget investment project (further - the project) are developed according to Item 2 of Article 154 of the Budget code of the Republic of Kazakhstan and determine general structure and requirements to contents of the feasibility statement (further - the feasibility study) and to experimental testimony of the feasibility study for the budget investment project.

2. According to Item 7 of Article 154 of the Budget code of the Republic of Kazakhstan economic examination of republican budget investment projects, and also the local budget investment projects planned to financing at the expense of target transfers for development and the credits from the republican budget is performed by the legal entity determined by the Government of the Republic of Kazakhstan.

3. According to Item 8 of Article 154 of the Budget code of the Republic of Kazakhstan economic examination of local budget investment projects is performed by the legal entities determined by local executive bodies.

4. Economic examination - result of complex assessment of the economic analysis, provided in the feasibility statement on the project, allowing to determine feasibility and efficiency of project implementation.

5. The positive conclusion or the negative conclusion are result of economic project appraisal.

The positive conclusion of economic examination is submitted on the feasibility statement on the project, the structure and content which conforms to these requirements and confirms the set technical and economic parameters, and also are available premises to feasibility and efficiency of project implementation.

The negative conclusion of economic examination is submitted on the feasibility statement on the project which results of assessment of the economic analysis show on impracticability and/or inefficiency of project implementation.

Feasibility studies for the project are sent to completion in cases of discrepancy of its structure and/or content to these requirements.

These Requirements are obligatory for use in case of development of the feasibility study for projects and are recommended for use in case of development of the feasibility study for the investment projects offered to financing at the expense of means of non-state loans under the state guarantee of the Republic of Kazakhstan.
