About the amount of compensation in 2009 of interest rate for the loans attracted by the companies of agro-industrial complex

The Cabinet of Ministers of Ukraine decides:

1. Determine that in 2009 compensation is provided to the companies of agro-industrial complex of interest rate:

1) on the credits and the directions of their use, stipulated in Item 3 Procedures for use in 2009-2013 of budgetary funds which are allocated in support of the companies agro-industrial to complex via the mechanism of the reduction in cost of the credits approved by the resolution of the Cabinet of Ministers of Ukraine of February 26, 2009 N 153 (The Official Bulletin of Ukraine, 2009, N 15, by the Art. 479): attracted in national currency - in the amount of 1,5 of discount rate of National Bank which affects accrual date of interest for using the credits, and in foreign currency - in the amount of 12 annual interest rates, but not higher than the sizes provided by credit agreements;

2) on attracted in national currency in 2007-2008 short-term, in 2005-2008 medium-term and in 2008 to long-term loans the companies of agro-industrial complex determined in accordance with the established procedure by the Ministry of Emergency Situations or Chamber of Commerce and Industry which suffered losses as a result of the natural disaster which happened in June - July, 2008 and to which according to orders of the Cabinet of Ministers of Ukraine of July 28, 2008 N 1010 and of August 2, 2008 N 1045 the right to partial compensation of losses and/or on partial indemnification, and the decisions made by tender committees according to the Procedure for use in 2008 of the means provided in the government budget for implementation of financial support of the companies of agro-industrial complex via the mechanism of reduction in cost of the credits approved by the resolution of the Cabinet of Ministers of Ukraine of February 27, 2008 N 126 (The Official Bulletin of Ukraine, 2008, N 18, is granted to the Art. 483), the right to compensation on the following credits, - in the sizes provided according to Items 5, 6 and 7 noted About is granted;

2-1) on the short-term loans attracted by the companies of agro-industrial complex (the agricultural, grain procurement, flour-grinding, hlebopekarsky, formula-feed enterprises, krupozavoda, the spirits plants, DAK "Bread of Ukraine" and its affiliated enterprises) for purchase of food and fodder grain of harvest of 2008 on condition of purchase of foodgrain at the prices which developed in the stock exchange market for date of its purchase, but not below the minimum purchase prices, and fodder grain at the prices which developed in the stock exchange market for date of its purchase in amounts of their annual requirement according to the agreements signed directly with agricultural producers - in the amount of double discount rate of National Bank which affects accrual date of interest for using the credits, but it is not higher than the sizes, provided by credit agreements;

3) on the long-term loans attracted by agricultural enterprises in 2007-2008 for construction of poultry-farming complexes and irrigation systems, construction and reconstruction of rooms, acquisition of the machinery and equipment for content and servicing of animals (except bird) and purchases of the breeding cattle and on the long-term loans attracted by agricultural enterprises, the companies of agro-industrial complex (grain procurement, flour-grinding, hlebopekarsky, formula-feed, krupozavoda, the spirits plants) it is exclusive in 2008 for construction of elevators and floor warehouses for storage of grain and oil-bearing crops which the decisions made by tender committees according to the Procedure for use in 2008 for the means provided in the government budget for implementation of financial support of the companies of agro-industrial complex via the mechanism of reduction in cost of the credits approved by the resolution of the Cabinet of Ministers of Ukraine of February 27, 2008 N 126 (The Official Bulletin of Ukraine, 2008, N 18, the Art. 483), is granted the right to compensation on such credits, - in national currency in the amount of 1,5 of discount rate of National Bank which affects accrual date of interest for using the credits, but it is not higher than the sizes, provided by credit agreements, and in foreign currency - in the amount of 12 annual interest rates, but it is not higher than the sizes, provided by credit agreements;

4) on the long-term loans attracted by agricultural enterprises in the current year for reconstruction of livestock and poultry-farming complexes and farms, purchase of the breeding cattle, the equipment and processing equipment - in the amount of double discount rate of National Bank which affects accrual date of interest for using the credits, but is not higher than the sizes, provided by credit agreements;

4-1) on the long-term loans attracted in the current year in national and foreign currency - in the amount of 90 percent of loan interest rate:

to agricultural enterprises - for construction of production rooms, livestock and poultry-farming complexes and farms, storages for storage of grain, vegetables and fruit;

to subjects of housekeeping - for construction of the wholesale markets of agricultural products;

5) on the average and long-term loans attracted by the companies of agro-industrial complex in 2006-2008 and the current year for implementation of the innovative projects aimed at the development of agro-industrial complex which underwent state registration in the procedure established by the legislation - in the amount of 1,5 of discount rate of National Bank which affects accrual date of interest for using the credits, but is not higher than the sizes, provided by credit agreements.

2. Payment of compensation of interest rate for the loans attracted by the companies of agro-industrial complex is performed in the sizes determined by this resolution within the corresponding budget settings established to the Ministry of agrarian policy in the Government budget of Ukraine for 2009.
