About approval of the Procedure for realization in Ukraine of radio-electronic means and the radiating devices

According to Articles 14, of 16, "About radio-frequency resource of Ukraine" the National commission on questions of regulation of communication of Ukraine SOLVED 29 Laws of Ukraine:

1. Approve the Procedure for realization in Ukraine of radio-electronic means and the radiating devices which is applied.

2. Resolve till 30.06.2009 inclusive realization in Ukraine of terminals, the IMEI codes which are not brought in the generalized database of the IMEI codes.

3. To mobile operators till 30.09.2009 to give to the Ukrainian state center of radio frequencies the IMEI codes of terminals which are serviced by such operators as of 01:09. 2009, for their entering into the generalized database of the IMEI codes.

4. In accordance with the established procedure to provide to department of licensing and radio frequencies and Legal management submission of this decision on state registration in the Ministry of Justice of Ukraine.

Procedure for realization in Ukraine of radio-electronic means and the radiating devices

I. General provisions

1.1. This Procedure developed according to the Law of Ukraine "About radio-frequency resource of Ukraine" (further - the Law), determines rules of realization the procedure of registration, idea and consideration of the applications of provision of permissions to realization in Ukraine of radio-electronic means (further - RES) and the radiating devices (further - IU), held for use radio frequencies public in strips, and additional measures for non-admission of realization of radio telephones and other final equipment of networks of the cellular communication having the international codes of identification (further - the terminal) which are not allowed for use in Ukraine.

1.2. Action of this Procedure extends to all subjects of managing - legal entities and physical persons which enable the realization of RES and IU intended for application in strips of radio frequencies public in the territory of Ukraine.

1.3. Wholesale and retail sale in the territory of Ukraine of RES and IU including through network of commission trade and the Internet shops (electronic trading), it is performed on allowing basis.

Subjects of managing have the right to enable the realization of RES and IU in the presence of the permission to realization of radio-electronic means and the radiating devices (further - permission to realization) on each separate Item of realization issued by the State company "Ukrainian State Center of Radio Frequencies" (further - UGTsR) or its branch in place of registration of the subject of managing.

1.4. Realization only of those types of RES and IU which are specified in permission to realization is allowed to the subject of managing.

1.5. The list of RES and IU for which realization permissions are not necessary is given in appendix 1.

1.6. The subject of managing has the right to enable the realization of RES and IU which answer the conditions of their application established by the legislation in Ukraine.

1.7. Realization of terminals, the international codes of identification is not allowed (further - the IMEI code) which are absent in the generalized database of the IMEI codes of terminals.

1.8. UDTsR for own means creates the automated information system of accounting of terminals in the territory of Ukraine which component is the generalized database of codes? ME? terminals, also creates in it the complex system of information security certified according to the legislation of Ukraine in the field of information security. As users have access to the specified database on bezoplatny basis employees of the State inspectorate of communication (further - GIS) and mobile operators, and also in the procedure established by the legislation the controlling and law enforcement agencies and official manufacturer representatives.
