About approval of the Regulations on procedure for carrying out employee assessment of customs authorities of the Russian Federation

In pursuance of article 47 of the Federal Law of July 21, 1997 N 114-FZ "About service in customs authorities of the Russian Federation" (The Russian Federation Code, 1997, N 30, Art. 3586; 2000, N 33, Art. 3348; N 46, of Art. 4537; 2001, N 53 (p. I), Art. 5030; 2002, N 27, Art. 2620; N 30, of the Art. 3029, Art. 3033; 2003, N 1, Art. 15; N 27 (p. I), Art. 2700; N 52 (p. I), Art. 5038; 2004, N 27, Art. 2711, N 35, Art. 3607; N 49, of Art. 4846; 2005, N 14, Art. 1212; 2007, N 10, Art. 1151; 2008, N 26, to the Art. 3022), for the purpose of the completing of customs authorities of the Russian Federation and organizations which are under authority of FCS of Russia (daleetamozhenny bodies), highly professional personnel structure, providing objective assessment of office activities of customs officers and also for further enhancement of work on matching and placement of personnel I order:
1. Approve the enclosed Regulations on procedure for carrying out employee assessment of customs authorities of the Russian Federation (further - the Provision).
2. To chiefs of structural divisions of FCS of Russia, customs authorities and certifying commissions of customs authorities to be guided by the Provision when carrying out employee assessment.
3. To chiefs of structural divisions of FCS of Russia, customs authorities to bring this order to the attention of subordinate employees.
4. Declare invalid the order of the State Customs Committee of Russia of October 29, 2003 N 1215 "About approval of the Regulations on procedure for carrying out employee assessment of customs authorities of the Russian Federation" (per is registered by the Ministry of Justice of the Russian Federation on December 5, 2003. N 5299).

Appendix
to the Order of the Federal Customs Service of December 24, 2008 No. 1658
1. Employee assessment of customs authorities of the Russian Federation is carried out in the customs authorities of the Russian Federation and organizations which are under authority of FCS of Russia (further - customs authorities), for the solution of questions:
1) about compliance of the employee of customs authority of post;
2) about representation of the employee of customs authority to the state award of the Russian Federation.
2. Certification for the solution of question of compliance of the employee of customs authority (further - the employee) post can be next and early.
3. The next employee assessment is carried out not more often than once in two years, but at least once in four years.
4. Early employee assessment can be carried out based on the order of customs authority in coordination with the chief of higher customs authority, except the cases specified in Item 6 of this provision on procedure for carrying out employee assessment of customs authorities of the Russian Federation (further - the Provision) not earlier than in 30 calendar days after finishing the relevant order to the employee under the signature.
5. Certification for the solution of questions of representation of employees to the state award of the Russian Federation is carried out taking into account the features provided by Chapter IV of this provision.
6. Certifications are not subject employees:
1) the holding positions less than a year;
2) being at the disposal of the chief of customs authority in connection with holding organizational and regular actions;
3) attached to public authorities of the Russian Federation and the organizations (the specified employee categories are not subject to certification for sending);
4) the employees who are on maternity leave on child care, and expectant mothers (certification of the specified employees is carried out not earlier than in year after exit from leave).
7. In system of customs authorities the following certifying commissions are created:
1) the Highest certifying commission of FCS of Russia;
2) certifying commission of FCS of Russia on employee assessment of law-enforcement divisions;
3) certifying commission of central office of FCS of Russia;
4) certifying commissions of regional customs authorities;
5) certifying commissions of regional customs authorities on employee assessment of law-enforcement divisions;
6) certifying commissions of customs;
7) certifying commission of the Russian customs academy.
According to the decision of the head of FCS of Russia other certifying commissions can be created.
8. Certifying commissions are created by orders of the relevant customs authorities in the following structure: chairman of certifying commission, his deputy (deputies), members of certifying commission and secretary (secretaries).
Can be included in structure of certifying commissions: the deputy chief of customs authority, the chief of personnel division, the chief of division on anti-corruption, the chief of legal division, the psychologist and other officials according to the decision of the chief of customs authority.
9. The certifying commission performs the activities according to the regulations of work of certifying commission (further Regulations) developed taking into account this provision and approved by the order of the relevant customs authority.
10. Positions of the employees who are subject to certification by the corresponding certifying commissions and also the officials responsible for preparation of responses on the certified employees and approval of results of certification, are determined by the standard scheme of employee assessment of customs authorities which affirms the order of FCS of Russia (further - the Standard scheme of certification).
11. Semi-annual work plans of certifying commission of customs authority, semi-annual schedules of certification and lists of the employees who are subject to certification are constituted by personnel division and affirm the chief of the relevant customs authority.
In graphics of certification it is specified: the name of customs authority, initials, surname, special rank of the employee, the name of structural division, post, date of certification, date of representation in certifying commission of necessary documents with indication of responsible heads of the relevant divisions of customs authority.
When forming the schedule of certification date of position assignment of the employee, date of the last certification is considered.
Schedules of certification for the first and second half-year affirm no later than December 25 and on June 25 respectively.
Not later than 30 calendar days before date of certification the employees who are subject to certification shall be informed of the schedule of certification.
In case of impossibility of presence of the employee in day of carrying out certification on service for reasonable excuses based on the provided data which were not known at the time of scheduling (leave, disease, business trip, etc.) corresponding changes are made to the schedule of certification.
12. Not later than 14 calendar days before date of certification the response about office activities of the employee (further - response) (recommended sample is given in appendix No. 1 to this Provision) prepared by the chief of the certified employee is represented to the secretary of the corresponding certifying commission.
13. The chief of the certified employee by preparation of response shall:
1) to study the operating procedure for employee assessment;
To have 2) with certified individual talk concerning service in customs authorities of the Russian Federation, enhancement of professional qualities, to make necessary recommendations about remedial action, increase in the personal liability for the state of affairs on the charged site of work;
3) to give objective assessment of business and personal qualities of the certified employee, its professional level, managerials ability, condition of office discipline and to determine contents of the characteristic.
14. It is recommended to reflect in the text of the characteristic of the certified employee depending on post the following questions:
a) employee's compliance to requirements for post;
b) the professional training level, knowledge of the Constitution of the Russian Federation, requirements of the legal and other regulations regulating practical activities of the employee, and also knowledge of the job description and its accomplishment in the course of service;
c) organization in work, ability to determine the main thing in the solution of objectives, capability qualitatively to carry out job responsibilities, to show initiative, to be guided quickly and to be effective skillfully in difficult situation;
d) the achieved results of office activities, personal deposit of the employee in accomplishment of objectives;
e) ability to direct subordinates;
e) assessment of condition of structural division, customs authority which is directed by the employee;
g) capability critically to estimate the activities and activities of subordinates; the available shortcomings and omissions of office activities, of management of division, customs authority and recommendations about their elimination;
h) fulfillment of requirements of the oath of the employee, the obligations stated in the Federal Law "About Service in Customs Authorities of the Russian Federation", the Disciplinary charter of Customs Service of the Russian Federation.
15. The secretary of certifying commission at least in seven calendar days prior to certification shall acquaint the certified employee with the provided response under the signature.
16. The employee has the right to express the disagreement with the provided response, and also to provide to certifying commission additional data on office activities for preceding period.
17. The secretary of certifying commission shall report in the terms established by Regulations on the chairman of certifying commission on the number of the arrived documents which are subject to consideration at meeting, to notify members of certifying commission and persons whose presence is necessary at meeting of certifying commission, on time and the venue of meeting, on the questions submitted for its consideration and also to submit to members of certifying commission the documents which are subject to consideration at meeting.
18. In case of impossibility of presence at meeting of certain members of certifying commission or the employees who are subject to certification or invited to meeting, specified persons shall submit beforehand the application addressed to the chairman of certifying commission with indication of the reasons of impossibility of presence at meeting.
19. The meeting of certifying commission is considered competent if at it there are at least two thirds of its structure.
20. For employee assessment, being part of certifying commission, its membership in the commission stops.
21. Certification is carried out in the presence of the certified employee and his immediate superior (or persons, it replacing).
In case of absence of the certified employee on meeting of certifying commission on reasonable excuse certification is transferred to later term.
In case of absence of the certified employee on meeting of certifying commission without reasonable excuse the employee can be brought to disciplinary responsibility in accordance with the established procedure, and its certification is transferred to later term.
The certifying commission for the purpose of objective carrying out certification in case of representation by the certified employee of additional data on its office activities for the period, preceding certification, and its statements for disagreement with the provided response has the right to transfer employee assessment to later term.
22. Office activities of the employee are estimated on the basis of determination of compliance to requirements of the job description, participation in the solution of objectives, efficiency and effectiveness of the performed work, availability of encouragement and not remitted authority punishments.
23. The certifying commission considers the submitted documents, hears the message of the certified employee on its office activities, and in case of need - and his immediate superior.
Members of certifying commission have the right to ask the certified employee the questions connected with accomplishment of job responsibilities, including use of the principles of kliyentotsentrichnost by it in activities of customs authorities of the Russian Federation when implementing the office activities.
24. The secretary of certifying commission takes the minutes of certifying commission (the recommended sample is given in appendix No. 2 to this Provision), draws up the appraisal sheet of the employee of customs authority of the Russian Federation (the recommended sample is given in appendix No. 3 to this Provision).
25. By results of certification the certifying commission accepts one of the following decisions:
1) corresponds to post;
2) does not correspond to post.
26. The decision of certifying commission is made by open voting in the absence of the certified employee and his immediate superior by a simple majority vote of the members of certifying commission who are present at meeting.
The chairman of certifying commission, the vice-chairman of certifying commission, members of certifying commission during the vote have the equal rights. The secretary of certifying commission does not participate in vote.
In case of equality of votes the certified employee is recognized corresponding to post.
27. The certifying commission by results of certification has the right to submit for consideration of the head of customs authority motivated recommendations of increase in the employee in position, about inclusion of the employee in reserve on promotion to higher position, about application of authority punishment in the form of the warning of incomplete office compliance by results of certification, about lowering of the employee in position, about dismissal of the employee.
28. Results of certification are fixed in the minutes of certifying commission and the appraisal sheet of the employee. The minutes of certifying commission are signed by the chairman, the vice-chairman, the secretary and members of certifying commission who were present at meeting.
Results of certification are told the certified employee directly after summing up vote.
29. The appraisal sheet of the employee with results of certification signed by the chairman and the secretary of certifying commission is submitted to the chief of the relevant customs authority no later than seven working days after its carrying out.
30. The chief of customs authority shall make the decision on approval (non-confirmation) of results of certification no later than ten working days from the moment of submission of the appraisal sheet on approval.
31. The secretary of certifying commission shall inform the employee of the approved (unconfirmed) appraisal sheet no later than ten working days from the date of its approval (non-confirmation) under the signature (this term is prolonged for the time spent of the employee in business trip, leave, disease, etc.).
32. The chief of customs authority by results of certification can make the decision:
1) about leaving of the employee in post;
2) about inclusion of the employee in reserve on promotion to higher position;
3) about transfer of the employee into other vacant position;
4) about imposing on the employee of authority punishment in the form of the warning of incomplete office compliance by results of certification;
5) about dismissal of the employee from service in customs authorities.
Except the decision on imposing on the employee of authority punishment in the form of the warning of incomplete office compliance by results of certification, the chief of the relevant customs authority accepts the specified decisions no later than two months from the date of carrying out certification.
And the publication of the relevant order the chief of customs authority performs decision making about imposing on the employee of authority punishment in the form of the warning of incomplete office compliance by results of certification no later than month from the date of decision making by certifying commission.
In the terms established for decision making by the chief of customs authority by results of certification the stay period on leave and time of disease of the employee is not set off.
33. When carrying out certification for the solution of questions of representation of the employee to the state award of the Russian Federation response about office activities and the appraisal sheet of the employee are not constituted.
The chief of customs authority (structural division) in whom the certified employee serves prepares prize leaf in the form established by the legislation of the Russian Federation and represents it to the secretary of certifying commission according to the Standard scheme of certification.
34. His specific merits and type of decoration for which it is recommended shall be reflected in the characteristic of the employee containing in prize leaf.
35. By results of certification the certifying commission accepts one of the following decisions:
1) it is recommended for the state decoration of the Russian Federation;
2) it is not recommended for the state decoration of the Russian Federation.
36. In case of adoption by certifying commission of the decision on representation of the employee to the state award of the Russian Federation the prize leaf is drawn up by the secretary of certifying commission, signed by the chief of customs authority and in accordance with the established procedure goes to higher customs authority.
37. In case of the employee's disagreement with the decision of the chief of customs authority made following the results of certification he has the right to appeal this decision in the procedure established by the legislation of the Russian Federation.
38. Protocols of meetings of certifying commissions are stored in personnel division of customs authority. Responses and appraisal sheets of employees are stored in their personal records.
39. Control of the organization of work and activities of certifying commission is performed by the chief of customs authority.
40. The methodical management of activities of certifying commissions exercises Head department of public service and personnel of FCS of Russia.
