According to the Law of Ukraine "About fire safety" I ORDER:

1. Approve Fire safety regulations for objects of storage of transportation and realization of oil products (further - Rules) which are applied, becoming effective since April 15, 2009.

2. To department of physical protection, fire safety and health and safety (Ivanov P. A.):

2.1. Submit this order on state registration to the Ministry of Justice of Ukraine in accordance with the established procedure.

2.2. After state registration in the Ministry of Justice of Ukraine to send to State department of fire safety of the Ministry of Emergency Situations of Ukraine required materials for inclusion of Rules in the state register and the automated databank of information fund of regulations concerning fire safety.

Fire safety regulations for objects of storage, transportation and realization of oil products

I. General provisions

1. Scope

1. These rules establish the main requirements of fire safety which need to be observed during operation of objects of storage, transportation and realization of oil products.

2. Warehouses of oil products with complex of the main and auxiliary technological objects are carried to objects of storage of oil products (drain and bulk platforms, pumping for pumping of oil products, reservoir parks and so forth), objects of the main oil pipelines are carried to objects of transportation of oil products, gas stations are carried to objects of realization of oil products.

These rules do not extend to commodity and raw reservoir parks of oil refineries, raw parks of the petrochemical companies, account warehouses of the oil products which are part of the companies (industrial, transport, energy and so forth).

3. These rules are obligatory for accomplishment at all companies connected with storage, transportation and realization of oil products in Ukraine irrespective of types of their activities and patterns of ownership.

4. For ensuring fire safety of objects of storage, transportation and realization of oil products it is also necessary to be guided by requirements of the Fire safety regulations in Ukraine approved by the order of the Ministry of Emergency Situations of Ukraine of 19.10.2004 of N 126, registered in the Ministry of Justice of Ukraine 04.11.2004 for N 1410/10009 (further - NAPB A.01.001-2004), and other regulatory legal acts existing in Ukraine proceeding from the sphere of their action.

II. Organizational actions concerning ensuring fire safety

1. Establishment of fire prevention regime

1. Fire prevention regime is set by the instruction approved by the order of the director (further - the instruction) in which shall be determined:

possibility (places) of smoking, use of naked flame, household heating appliances;

procedure for carrying out temporary fire-dangerous works (including welding);

rules of journey and parking of vehicles;

places for storage and admissible amount of raw materials, semifinished products and finished goods which can be in production rooms and in the territory of the company (in storage locations);

procedure for cleaning of combustible dust and waste, storages of the oiled overalls and rags, cleanings of air ducts of ventilating systems of combustible deposits;

procedure for disconnection from network of electric equipment in case of fire;

inspection routine and closing of rooms after completion of work;

procedure for passing by officials of training and examination concerning fire safety, and also carrying out with workers of fire-proof instructing and occupations on fire technically minimum with appointment responsible for their carrying out;

procedure for the organization of operation and servicing of available technical means of fire protection (systems of fire-water supply, pumping points, automatic systems of the fire alarm and fire extinguishing, systems of gas-smoke removal, fire extinguishers and so forth);

procedure for carrying out Party of Pensioners of Russia and surveys of electroinstallations, heating, ventilating, processing and other engineering equipment;

actions of workers in case of fire detection;

procedure for collection of members of voluntary fire team and responsible officials in case of the fire, challenge at night, in days off and holidays.

2. All employees of the company shall be informed of requirements concerning providing fire prevention regime on instructing, during passing of fire and technical minimum and so forth.

3. Statements of basic provisions from the instruction need to be hung out on foregrounds.

4. Works managers, carried out by contract organizations, shall provide observance by employees of contract organizations of the fire prevention regime set at the company.

5. The director shall accept (within the powers conferred to him) adequate measures of response to the facts of violations or failure to carry out by officials, other employees of the company of the set fire prevention regime, requirements of the fire safety regulations and other documents existing in this sphere.

2. Determination of obligations of officials and workers concerning ensuring fire safety

1. Ensuring fire safety of the companies is assigned to their heads and persons authorized by heads if another is not provided by the relevant agreement.

Heads of the companies shall:

organize studying and accomplishment of fire safety regulations all ITR, employees and workers;

develop complex actions concerning ensuring fire safety, implement achievements of science and technology, positive experience;

according to regulatory legal acts concerning fire safety to develop and approve provisions, instructions, other documents existing within the company, to exercise constant control behind their observance;

provide observance of fire-proof requirements of standards, regulations, rules, and also fulfillment of requirements of instructions and resolutions of bodies of the state fire supervision;

in case of absence in regulating documents of the requirements necessary for ensuring fire safety to take adequate measures, approving them with bodies of the state fire supervision;

provide in necessary quantity and contain in good repair means of fire protection and communication, the fire fighting equipment, emergency firefighting equipment, not to allow their inappropriate use;

create in case of requirement according to established procedure of division of the Ministry of Emergency Situations and material and technical resources, necessary for their functioning;

create DPD or DPK, PTK and to organize their activities according to requirements of the existing regulatory legal acts of Ukraine;

give upon the demand of the state fire supervision of the data and documents on condition of fire safety of the company and products;

perform actions concerning implementation of ASP and Union of Right Forces and use for this purpose of production automatic equipment;

to timely inform divisions of the Ministry of Emergency Situations on defects of the fire fighting equipment, fire protection systems, water supply, and also on closing of roads and drives in the territory;

make office investigation of cases of the fires;

determine obligations of officials (including deputy managers) concerning ensuring fire safety, to appoint the order of workshops, responsible for fire safety, certain buildings, constructions, rooms, sites and so forth, the processing and engineering equipment, and also for content and operation of technical means of fire protection.

2. Responsibility for fire safety of workshops, installations, production sites of the company (further - structural divisions) is assigned to their heads or persons fulfilling their duties.

The heads of structural divisions, other workers appointed responsible for fire safety shall:

provide observance in the structural divisions of the set fire prevention regime subordinated to them;

know characteristics of fire risk of buildings, constructions, engineering procedures, processing and production equipment, substances and materials which address, used and stored in production;

organize control of operability of systems of heating, ventilation, electroinstallations, processing and other production equipment, to take measures concerning elimination of the revealed defects owing to which emergence of the fire is possible;

after completion of work to provide cleaning of workplaces and rooms, shutdown of electroinstallations, except for emergency lighting, fire-proof and security installations, and also electroinstallations which under the terms of technology shall work round the clock;

the nobility of the rule of content and use of the fire fighting equipment (including emergency firefighting equipment, ASP and Union of Right Forces), means of communication, systems of gas-smoke removal and the notification about the fire which are available in division and constantly to contain them in good repair;

develop plans of evacuating during the fire of people and material values and carry out at least once a year their practical working off according to the procedure established at the company.

3. The workers responsible for operation of processing equipment and engineering constructions shall:

organize timely performing routine inspections and scheduled preventive maintenance of the equipment, installations, power supply networks and so forth, and also elimination of the revealed violations which can lead to the fire;

organize training and instructing of service personnel concerning ensuring fire safety during operation (repair) of the processing and engineering equipment;

provide development of necessary operational documentation and control of its maintaining, to develop and perform measures concerning prevention of the fires from the processing and engineering equipment.

4. Workers, employees, other employees of the company shall:

observe established at the company, in division, on workplace fire prevention regime, nobility and fulfill requirements of the these rules and other existing regulatory legal acts concerning fire safety existing at the company;

be able to apply the fire extinguishing means which are available in division;

in case of identification of the fire or ignition to be effective according to requirements of the Section X of these rules.

5. In each room the plate with indication of surname, name, middle name and position of the worker responsible for fire safety is in a visible place hung out.

6. Obligations of workers concerning ensuring fire safety, content and operation of technical means of fire protection are displayed in the relevant official documents (functional obligations, job descriptions, provisions and so forth).

7. Obligations of the Parties concerning ensuring fire safety of leased property are determined in the lease agreement.

3. Development of instructions about actions of fire safety and plans of evacuating during the fire

1. At each company according to requirements applications 1 to these rules are developed:

the all-object instruction about measures of fire safety;

instructions for all explosive and fire-dangerous rooms (sites, workshops, warehouses, workshops, laboratories and so forth);

instructions for carrying out fire-dangerous work types, operation of technological installations and so forth.

Instructions are hung out on foregrounds and studied during fire-proof instructing, special training (fire and technical minimum), and also in system of inservice training.

2. The all-object instruction is developed by administration of the company with the assistance of specialists of object fire protection (in case of its availability), the chief of DPD, other interested services and divisions of the company.

The all-object instruction affirms the director or person fulfilling its duties.

3. Instructions about measures of fire safety are developed for certain sites of workshops, warehouses, workshops, laboratories, workplaces, fire-dangerous work types and so forth by heads and specialists of the relevant structural divisions, services and affirm the deputy manager or the chief engineer of the company.

4. For workers of protection (security guards, porters, guard and so forth) the administration of the company develops instructions in which their obligations concerning control of observance of fire prevention regime are determined, of survey of the territory and rooms, mode of operation in case of identification of the fire, operation of systems of the fire alarm and fire extinguishing systems, and also (in the absence of dispatching service at the company) it is specified which of officials of administration is called at night, in days off and holidays in case of fire. The list of officials of the company with indication of their home address, numbers of office and home phones is attached to instructions. Instructions are hung out in locations of protection (on checkpoints, posts and so forth) and studied by all workers of protection.

4. Training in measures of fire safety, evident propaganda

1. All workers who are employed and on place of employment shall undergo instructing in questions of fire safety (further - fire-proof instructing). Fire-proof instructing are subdivided on: introductory, primary, repeated on workplace, unplanned and target.

Persons who are employed, connected with the raised fire risk shall previously (prior to independent performance of work) to undergo special training (fire and technical minimum). The workers occupied at works with the raised fire risk shall undergo examination of the corresponding regulatory legal acts concerning fire safety once a year.

The procedure for the organization and carrying out fire-proof instructing, training and examination on fire technically minimum is established by Standard regulations on instructing, special training and examination concerning fire safety at the companies, in organizations and the organizations of Ukraine, the approved order of the Ministry of Emergency Situations of Ukraine of 29.09.2003 N 368 and registered in the Ministry of Justice of Ukraine 11.12.2003 for N 1148/8469 (further - NAPB B.02.005-2003). The list of works (professions) connected with the raised fire risk and on which in case of acceptance persons shall undergo special training (fire and technical minimum), and also annual examination of regulatory legal acts concerning fire safety is determined by NAPB B.02.005-2003, and also appendix 1 to these rules.

2. Officials prior to accomplishment of the obligations and periodically once in three years shall undergo training and examination concerning fire safety. Officials who shall be trained are determined by the List of positions, in case of appointment to which faces shall undergo training and examination concerning fire safety and procedure for their organization, the approved order of the Ministry of Emergency Situations of Ukraine of 29.09.2003 N 368 and registered in the Ministry of Justice of Ukraine 11.12.2003 for N 1147/8468 (further - NAPB B.06.001-2003).

3. The admission to work of persons who were not trained fire-proof instructing and examination concerning fire safety, is forbidden.

4. Studying of actions of fire safety at the company should be provided in system of inservice training of workers, employees, ITR also. Besides, for this purpose local systems of broadcasting, evident propaganda and so forth, available at the company, are used.

5. Training programs concerning fire safety shall be approved with bodies of the state fire supervision.

5. Creation of fire-proof forming

1. For the purpose of employees engagement to holding actions concerning prevention of the fires, the organizations of their suppression at the companies are created by DPD (DPK) which activities are performed according to the Regulations on voluntary fire teams (teams) approved by the order of the Ministry of Emergency Situations of Ukraine of 11.02.2004 N 70 and registered in the Ministry of Justice of Ukraine 19.02.2004 for N 221/8820 (further - NAPB B.02.004-2004).

Members of DPD (DPK) which are subject to compulsory personal insurance (on case of death (death), wound (contusion, injuries or mutilations), the disease got during liquidation of the fire or effects of accident), it is necessary to insure according to the Regulations on procedure and conditions of compulsory personal insurance of workers of departmental and local fire protection and members of voluntary fire teams (teams) approved by the resolution of the Cabinet of Ministers of Ukraine of 03.04.95 N 232 (further - NAPB B.02.012-95).

2. At the companies with the number of 50 and more workers for the solution of labor collective PTK are created. Their work is organized according to the Standard regulations on the fire and technical commissions approved by the order of the Ministry of Emergency Situations of Ukraine of 11.02.2004 N 70 and registered in the Ministry of Justice of Ukraine 19.02.2004 for N 222/8821 (further - NAPB B.02.003-2004).

3. In the device of each merging of the companies (associations, corporations, concerns and so forth) for accomplishment of the functions delegated to consolidation in the field of fire safety SPB according to the Standard regulations on service of fire safety approved by the order of the Ministry of Emergency Situations of Ukraine of 29.09.2003 N 369 and registered in the Ministry of Justice of Ukraine 10.12.2003 for N 1121/8442 is created (further - NAPB B.02.010-2003). Activities of SPB are regulated by provisions which are developed by the relevant ministries, departments, associations of the companies.

III. Requirements of fire safety concerning content of the territory, buildings, rooms and constructions

1. Content of the territory

1. The territory of the company is constantly kept clean and systematically cleared of garbage, production wastes, container, fallen leaves which are regularly removed (are taken out) to specially allotted places. The entrance of strangers on the territory of the company is forbidden.

2. To all buildings and constructions the free entrance is provided. Roads, drives and passes to buildings, constructions, systems of fire-water supply, approaches to outside fire-escapes, emergency firefighting equipment, technical means of fire extinguishing always contain free.

In the territory of the companies, especially the gas station, is organized, as a rule, one-way traffic of vehicles, and also separate arrival and departure.

3. For ensuring safe journey all roads and drives in the territory of the company contain operational, are timely repaired, are cleared of snow in the winter, and at night are lit.

4. For operational content of roads, drives and entrances responsibility is born by persons designated by the relevant order on the company.

5. The divisions of the Ministry of Emergency Situations servicing the company are immediately informed on closing of sections of roads or drives for repair (or for other reasons). For closing of roads in appropriate places direction signs of detour are established or convenient moving with width of at least 3,5 of m, always free for journey of fire trucks are equipped.

6. On moving the parking of cars without locomotives is forbidden.

7. On sites of possible accumulation of combustible gases or vapors driving of cars and other transport through the territory of the company is forbidden, about it the corresponding texts (indexes) are hung out.

8. The construction in the territory of the companies of new buildings and constructions (including temporary) can be performed only in the presence of the project documentation which passed preliminary expert examination (check) in bodies of the state fire supervision on compliance to the regulating documents concerning questions of ensuring fire safety.

9. It is not allowed to attach to buildings with protective metalwork which contains combustible polymeric heaters (expanded polystyrene, polyurethane foam and so forth), storage rooms, masterful and other rooms.

10. On free sites of the territory of the company planting of trees and bushes only of deciduous breeds, and also the planned lawns is allowed.

Use for gardening of the territory of the company of deciduous breeds of the trees and bushes allocating flakes, fibrous substances or the trimmed seeds and also planting of trees and bushes that promotes accumulation of vapors or gases, is not allowed by dense groups and strips.

Planting of trees and bushes, planting of lawns in the obvalovanny territory of the reservoir park is forbidden in production zone on the site of railway and automobile discharge filling of oil products, and also in caret of embankment of reservoir parks.

12. Smoking in the territory of the company, except for specially certain places, is forbidden.

13. The territory of the company, and also the building, construction, the room are ensured by the corresponding signs safety concerning prohibition of smoking, use of naked flame and electric heaters and so forth which shall correspond to the existing regulating documents.

14. In the territory of the company on foregrounds plates with indication of procedure for challenge of divisions of the Ministry of Emergency Situations, indexes of locations of emergency firefighting equipment, fire hydrants, fire reservoirs are established; traffic patterns of transport in which placement of buildings is specified, reservoirs, hydrants, piers and градирень (need of installation of such schemes at each specific company is determined by local authorities of the state fire supervision).

15. The route of the main oil pipelines within 3 m in each party is constantly supported in fireproof condition by periodic clearing from bushes and other woody vegetation.
